Division of Water Quality (DWQ) on February 22, 2006. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3400 (WQC3400). The Certification allows you to use the CAMA Major Permit when issued by the NC Division of Coastal Management. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non- discharge, and stormwater regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 6. Upland Disposal Prior to beginning construction of the new bulkhead and prior to performing maintenance dredging at the subject site, a jurisdictional determination must be made by the USACE to verify that the proposed upland disposal site(s) will not result in additional fill of Section 404 Wetlands. If the upland disposal site must be relocated due to the presence of wetlands at the proposed site(s), revised upland disposal site plans must be submitted to this office and the 401 Oversight Unit in Raleigh prior to beginning work. This Certification replaces Water Quality Certification Number 3025 issued on September 6, 1995, Water Quality Certification Number 3112 issued on February 11, 1997, Water Quality Certification Number 3274 issued June 1, 2000 and Water Quality Certification Number 3371 issued March 18, 2002. This WQC is rescinded when the Corps of Engineers re-authorizes Regional General Permit 0291 or when deemed appropriate by the Director of DWQ. The State of North Carolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with conditions hereinafter set forth. Conditions of Certification: 1. Activities authorized by CAMA major permits require written concurrence from the Division of Water Quality as well as compliance with all conditions of this General Certification; 2. Activities authorized by Coastal Area Management Act (CAMA) Minor or General Permits do not require written authorization from the Division of Water Quality as long as they comply with all other conditions of this General Certification; 3. In accordance with North Carolina General Statute Section 143-215.3D(e), any request for written concurrence for a 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees. The fee shall be collected and distributed between the two agencies in accordance with agreements reached between the Division of Water Quality and the Division of Coastal Management; 4. In accordance with 15A NCAC 2H .0506 (h) compensatory mitigation may be required for impacts to 150 linear feet or more of streams and/or one acre or more of wetlands. In addition, buffer mitigation may be required for any project with Buffer Rules in effect at the time of application for buffer impacts resulting from activities classified as "allowable with mitigation" within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer Rules. A determination of buffer, wetland and stream mitigation requirements shall be made for any Certification for this Nationwide Permit. The most current design and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval as required in those protocols. When compensatory mitigation is required for a project, the mitigation plans must be approved by DWQ in writing before the impacts approved by the Certification occur. The mitigation plan must be implemented and/or constructed before any permanent building or structure on site is occupied. In the case of public road projects, the mitigation plan must be implemented before the road is opened to the travelling public; WQC #3400 5. Compensatory stream mitigation shall be required at a 1:1 ratio for not only perennial but also intermittent stream impacts that require application to DWQ in watersheds classified as ORW, HQW, Tr, WS-1 and WS-II unless the project is a linear, publicly- funded transportation project, which has a 150-foot per-stream impact allowance; Impacts to any stream length in the Neuse and Tar-Pamlico River Basins (or any other major river basins with Riparian Area Protection Rules [Buffer Rules] in effect at the time of application) requires written concurrence from DWQ in accordance with 15A NCAC 213.0200. New development activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not) within the Neuse and Tar- Pamlico River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B .0200. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices. Activities listed as "exempt" from these rules do not need to apply for written concurrence under this Certification; 7. All sediment and erosion control measures placed in wetlands or waters shall be removed and the original grade restored after the Division of Land Resources has released the project; 8. If an environmental document is required, this Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse; 9. That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to assure compliance with the appropriate turbidity water quality standard; 10. Measures shall be taken to prevent live or fresh concrete from coming into contact with freshwaters of the state until the concrete has hardened; 11. Additional site-specific conditions may be added to projects which have applied for CAMA major permits which are proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 12. When written concurrence is required, the applicant is required to use the most recent version of the Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 13. Concurrence from DWQ that this Certification applies to an individual project shall expire three years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding General Permit 198000291, whichever is sooner. Non-compliance with or violation of the conditions herein set forth by a specific fill project shall result in revocation of this Certification for the project and may result in criminal and/or civil penalties. WQC #3400 The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity that requires written concurrence under this certification, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland or downstream waters are precluded. Public hearings may be held for specific applications or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of Water Quality. PROJECT DESCRIPTION The applicant's project is located at 425 West Brunswick Street, adjacent to the northwestern end of the Southport Yacht Basin ("Old Boat Harbor"), in Southport, Brunswick County. To find the property from the intersection of South Howe Street and West Moore Street, turn west onto West Moore Street and travel approximately 0.25 miles to West Brunswick Street. Turn right onto West Brunswick and travel approximately 0.20 miles around the yacht basin to Short Street. The property is located at the intersection of Short Street and West Brunswick Street. The property is a 0.112 acre parcel of land on the Southport Yacht Basin. The Southport Yacht Basin is located at the confluence of the Cape Fear River and the AIWW and is a federally maintained navigation project. The high ground area of the property measures approximately 25 feet in width by approximately 160 feet in length along the yacht basin. The high ground property consists entirely of an asphalt parking area adjacent to West Brunswick Street. The entire shoreline is stabilized by a failing wooden bulkhead measuring approximately 176 feet in length. The applicant states that the failure appears to be the result of a failure of the tieback system causing the top of the bulkhead to lean outward towards the yacht basin. The existing asphalt parking lot is sliding or depressing into the void created where the wall has moved outward. The applicant fears that if the bulkhead is not repaired, the parking area grade will fail and the integrity of the road (West Brunswick Street) will be compromised. Coastal Wetlands consisting entirely of Smooth Cordgrass (Spartina alterniflora) exist in two areas directly adjacent to the existing bulkhead. One area on the eastern side of the property measures approximately 54 feet in length by approximately five feet in width. The other area on the western side of the property measures approximately 17 feet in length by approximately 3 feet in width. The bulkhead is the normal high water line (NHW) for the entire property shoreline. The mean low water (MLW) contour line lies between 22 and 50 feet waterward of the existing bulkhead. The existing marina structures is located just to the east of the City of Southport municipal dock and consist of a six feet wide by 130 feet long floating dock and six finger pier measuring approximately four feet in width by approximately 10 feet in length. The main floating dock structure is accessed from the center of the parking area by a ramp and an existing floating platform measuring nine feet in width by fourteen feet in length. The marina currently provides docking space for twelve vessels. Existing water depths at the marina range from 0.0 feet to 1.5 feet at MLW. This project was originally permitted under State Permit No. 163-83, issued to Gene Sellers on October 20, 1983. The waters of the Southport Yacht Basin are classified as "SC" by the North Carolina Division of Water Quality. The area is not designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries and is Closed to the harvest of shellfish. PROPOSED PROJECT The applicant is proposing to replace the existing failing existing bulkhead; replace and re-configure the existing boat slips and perform maintenance dredging within the existing basin. The existing 176 linear feet of wooden bulkhead would be replaced with a composite fiberglass sheet-pile bulkhead tied back with helical anchors drilled under the existing pavement. In order to maintain the integrity of the existing parking area and public road, the applicant is proposing to replace the bulkhead an average of 3.9 feet waterward of the existing structure. Where no coastal wetland vegetation is present adjacent to the existing bulkhead, the applicant proposes to construct the new bulkhead approximately five feet waterward of the existing structure. As the attached photos illustrate, the existing wall is leaning outward and would preclude the construction of a vertical wall directly adjacent to the existing structure. The main floating dock would be increased in size to 138 feet in length and 8 feet in width. The new finger piers (six) would measure 3 feet 6 inches in width by 28 feet in length. The new landing platform would measure 14 feet 6 inches in length by 9 feet seven inches in width. The applicant states that the increase in the size of the docks is needed for safety in getting on and off boats and would provide for a sturdier design for the tying up of boats and a more substantial dock during storms. The structure would still provide docking space for 12 vessels. The applicant is also proposing to perform maintenance excavation within the yacht basin. The area of excavation would measure approximately 78 feet in width by 150 feet in length and would be maintained to a depth of -5.0 feet at MLW. There is no excavation proposed within 10 feet of the existing coastal wetland areas. The applicant estimates that approximately 1,000 cubic yards of material would be removed by mechanical excavator and taken to one of two available a high ground disposal sites, a 0.89 acre site located on West West Street and a 4.73 acre tract located at 900 West West Street. The applicant claims title to both disposal sites. A wetland delineation has not been conducted for either of the disposal sites. 10. ANTICIPATED IMPACTS The proposed bulkhead replacement would result in the filling of approximately 194 square feet of Spartina alterniflora marsh and approximately 689 square feet of shallow intertidal bottom area. The proposed dock structure would incorporate approximately 1,830 square feet of Estuarine Waters and Public Trust Area. This represents an increase of approximately 684 square feet of additional incorporation compared to the existing structure. We are also requesting a maintenance dredging permit. The bulkhead at the "old boat harbor" is failing from what appears to be a failure of the tiebacks. We and the City of Southport are concerned that if the wall is not rebuilt soon and the wall fails that the parking area grade will fail and the integrity of the road adjacent to the parking lot (Brunwick Street) will be compromised. Due to the increase in construction and retail activity around the old boat harbor, the amount of traffic and the size of vehicles on Brunswick Street has increased substantially. Bruswick Street started as a path in front of the houses and was not designed for heavy traffic. In 2003, the City installed deep, waterline extension in the street. We believe that along with the storm water runoff down Short Street has exacerbated stress on the bulkhead causing it to fail. We are requesting permission to install a new bulkhead to replace the failing bulkhead. It will be constructed of composite fiberglass with helical anchors. We request that it be constructed to the water side of the existing wall. This will allow us to keep the existing wall in place and install the new wall before the existing wall is dismantled. The structural engineer, Rod Andrews, Andrews Engineering, is also designing the wall to deal with hydrostatic pressure. The area behind the new bulkhead will be compacted and resurfaced. An additional benefit of allowing the wall to be built out from the existing wall should be to help mitigate some of the pressure/ energy from the vehicles as they stop to park. We have 12 dedicated spaces for the boat slips; the rest the City has the right to use for their "City Docks" which have no designated parking other than a small area along the roadside. Typically, these are large heavy duty pickup trucks. Admiral is also requesting permission to install new boat docks at this time. The floating docks will be prefabricated and delivered to the site. The docks will be close in footprint to the existing docks. Sound Marine has suggested a different anchoring plan than we currently have for the piles. We feel this will provide a finger pier design which is more stable and safer for the users and will help limit storm action on the dock. New, safer electrical and water service will be provided.
