The Wilmington Regional Office received your Pre Construction Notification application for a
US Anny Corps of Engineers (USACE) Nationwide 18 Permit. The wetland/waters impacts proposed for
the Saylor's Watch Subdivision in New Hanover County is for the purpose of a discharge structure and
rip rap to dissipate energy and prevent erosion within the jurisdictional canal. You are authorized to
impact 113 square feet to help reduce erosion into wetlands/waters under the General Water Quality
Certification (GC) # 3402 (enclosed). This Certification allows you to use your 404 Pen-nit when the
Corps of Engineers issues it. Written concurrence from the Division of Water Quality (DWQ) is not
required provided that you can meet all of the conditions of the General Certification.
If at anytime during construction of your project you determine that you cannot meet these
conditions or if there are any additional impacts to wetlands or water quality not described in your
application, you must contact this office immediately.

On behalf of Emmart Holdings, LLC, we are requesting authorization from the USACE to use
NWP 18 for the installation a stormwater discharge pipe into a "Water of the US". This PCN is
being provided to DWQ as a courtesy copy. A copy of this PCN has also been provided directly
to Ms. Joanne Steenhuis in the Wilmington Field Office.
The site is located in Wilmington, on the west side of S. College Road (Hwy 132), just south of
the Coastal Community Vineyard. The project is approximately 10.02 acres in size. The project
is located in the Cape Fear River basin. The wetland delineation was reviewed and approved by
Ms. Jennifer Frye (AID #200500047). A copy of the signed JD Survey has been provided as an
Appendix to the enclosed PCN.
The current request is for 0.0026 acres of impacts to "Waters of the US" (see the attached
maps and PCN for details).

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction

long leaf/loblolly pine uplands and Carolina Bay wetlands, see attached aerials. The general

north, and medium density residential to the east, see attached aerials. The proposed project
is concurrent with the approved zoning and surrounding land use.
10. Describe the overall project in detail, including the type of equipment to be used:
The proposed project will consist of a single-family attached development (townhomes).
Typical heavy equipment i.e. excavators, front-end loaders, etc) will be utilized to construct
the proposed project.
11. Explain the purpose of the proposed work: The project is intended to meet the growing
demand for residential housing in Wilmington.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules. The onsite wetlands were approved by Ms. Jennifer Frye with the US
Army Corps of Engineers on May 17, 2005. The AID number is 200500047, see Appendix 2.
V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
There is no anticipated future development associated with the proposed project.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from
riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an
accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation map, whether or not impacts are proposed to these systems.

Photographs may be included at the applicant's discretion. If this proposed impact is strictly for
wetland or stream mitigation, list and describe the impact in Section VIII below. If additional

1. Provide a written description of the proposed impacts: The proposed impacts to Waters of the
US will result from the installation of the discharge structure into a man made canal along the
northwestern project boundary, see Appendix 3 and site plan. The discharge structure will
consist of a mitered end pipe, which will discharge directly onto rip-rap placed into the
bottom of the canal. The rip-rap is needed to dissipate energy and prevent erosion and
downstream sedimentation.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and

financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts._ The proposed project has been
designed to avoid and minimize all impacts to onsite wetlands The only proposed impacts to
onsite jurisdictional areas are 0.0026 acres of impact to a man-made drainage canal which was
claimed as "Waters of the US". The proposed impacts to onsite "Waters of the US" are
necessary for installation of the stormwater discharge pipe in the eastern bank of the canal and
the placement of rip-rap for erosion preventative measures. Also, per DWO General
Certifications, a "Deed Notification" will be incorporated into the Home Owners Association
(HOA) documents to inform all property owners that there are wetlands on the property see
Appendix 4.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
littp://li2o.enr.state.nc.us/ncwetlands/strmgide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a

description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Due to the minimal size of proposed impacts to a roan made drainage canal there is no
mitigation anticipated for this project.
2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement
Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at
(919) 715-0476 to determine availability, and written approval from the NCEEP indicating
that they are will to accept payment for the mitigation must be attached to this form. For
additional information regarding the application process for the NCEEP, check the NCEEP
website at hqp://h2o.enr.state.nc.us/wrp/index.htm. If use of the NCEEP is proposed, please

contain anv impervious area. The proposed vroiect will result in 35.3% impervious area. The
proposed impervious area consists of rooftops (12.5%), walks (3.4%), parking (16.3%) and
access road (3.1%). DWO has issued a Stormwater Management Permit for the proposed

The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Saylor's Watch on January 25, 2006. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 060120
dated January 31, 2006, for the construction of the subject project.
This permit shall be effective from the date of issuance until January 31, 2016, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within sixty (60) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built-upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.

13. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may
.subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.
