PROJECT SUMMARY: The applicant proposes to construct six buildings providing 12 residential units, swimming pools, utilities and privacy berm. DBII, LLC Page Two 9. PROJECT DESCRIPTION Charles Riggs, PLS, on behalf of DBII, LLC, has requested that the attached application be processed under the Express Permit Review Program. The applicant's project is located along New River Inlet Road, adjacent to the Atlantic Ocean, in North Topsail Beach, Onslow County. To find the property, take Highway 17 North from Wilmington and turn right on N.C. Highway 50 (approximately 30 miles from Wilmington). Head east on N.C. Highway 50 and turn left onto N.C. Highway 210 at the intersection of N.C Highway 210 and N.C Highway 50. Continue on N.C. Highway 210 approximately 8.0 miles and turn right onto New River Inlet Road (NCSR 1568). The property is located on the eastern side of New River Inlet Road, approximately 1.7 mile from the intersection of N.C. Highway 210 and New River Inlet Road. The proposed project site is approximately 3.4 acres and consists of all high ground, with the exception of a small area of Section "404 type" wetlands, located in the far northeast corner of the property. Currently, there are six individual buildings (providing 12 residential units) located on the property with associated drives and utilities. The site ranges in elevation from 5' to 8'above Mean Low Water (MLW). The site is mostly cleared with little to no vegetation, except for lawn grasses and ground brush. As previously mentioned, there is a small pocket of Section "404 type" wetlands located in the northeast corner of the subject property. The wetland area is located along the fringe of the upper most limit of a small tributary that is connected to Stump Sound. The "404 type" wetlands pocket is located beneath the bridge section, on the eastern side of NCSR 1568. The area contains several coastal wetland species including: Cattails (Typha sp.) and Salt Meadow Grass (Spartina patens). The project site is located within the Ocean Erodible Area of Environmental Concern (AEC), and is also within the High Hazard Flood AEC. Existing development on the site consists of six buildings, that provides 12 residential units, utilities, drives, a swimming pool, individual dune crossover for each building and an access road. A CAMA Major permit (#4-95) was issued to Island Development Group, Inc. for construction of the Wyndy Dunes Subdivision, on January 18, 1995. The CAMA Major Pen-nit authorized the construction of an access walk, three private entrance/exit roads, and utilities for the proposed 17-lot residential subdivision. Working under the active CAMA Major Permit, the pennittee installed the entrance/exit drive as well as the utilities and access walk. Subsequent to the issuance, and ultimate expiration of the CAMA Major Pennit, a CAMA Minor Permit (NTB 3-81) was issued for development of the six individual buildings, located along the eastern side of the property. The applicant is currently applying for a CAMA Major Permit because the project site is located within the Ocean Erodible AEC, and because cumulative development impacts from this project, coupled with the existing phased development on the property, disturbed more than an acre of land, thus requiring Sedimentation and Erosion Control approval from the Division of Land Resources, Land Quality Section, as well as a State Stormwater Permit from the Division of Water Quality The Atlantic Ocean, which is immediately adjacent to the project site, is classified as SB by the North Carolina Division of Water Quality. The area is not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. The subject property is located within the High Hazard Flood Area, as indicated by Zone VE (elevation 14) on the Flood Insurance Rate Map. The High Hazard Flood Area (VE Zone) associated with the subject property is contiguous to the Atlantic Ocean. PROPOSED PROJECT The applicant proposes to develop the remaining portion of the property by constructing six individual buildings, providing 12 residential units (considered as duplexes), as well as swimming pools, utility connections, driveways and a sand berm. Development would include grading approximately 1.43 acres of the site for lot preparation, construction of the buildings and driveways and berm construction. According to the application, the parcel would include the construction of six individual three-story units (40' x 44') giving a density of 8.39 units/acre. The existing entrance/exit drive would continue to provide access to the individual units. Uncovered wooden decks (measuring 42' x 26') would be constructed on the New River Inlet Road side of each unit and a total of 11 swimming pools (12' x 27') would be installed in the center of each deck area. Each individual unit would have it's own swimming pool with the exception of the two units located on Lot 7. These two units would share a pool. • DBII, LLC Page Three A vegetated sand berm would be constructed on the western side of the property between Lots 8-12. The berm, once constructed, would have an elevation of approximately 9.5' above Mean Sea Level (MSL) and would be used primarily as a privacy barrier. The berm would be constructed from sands located onsite. An Express High Density Stormwater Permit (SW8040341) was issued by the Division of Water Quality on 01/04/05. Additionally, a Sedimentation and Erosion Control Plan (permit #-Onslo2004-209) was approved on 03/24/05, for land disturbance activities. Municipal water and sewer would be provided by the Town of North Topsail and Onslow County. 10. ANTICIPATED IMPACTS: The initial grading of the property would result in the disturbance of approximately 1.43 acre of high ground. The proposed dwellings, drives, decks and pools would result in the creation of approximately 35,698 square feet of impervious surface.
