Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 2) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Scott Marshall ADDITIONAL CONDITIONS Permit #133-06 Page 2 of 3 3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, or deep water, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 4) The pier shall not exceed the established Wrightsville Beach pier-head line. 5) To ensure compliance with Conditions 3 and 4 of this permit, an as-built survey that depicts the authorized pier, adjacent riparian corridors and the Wrightsville Beach pier-head line, shall be performed on the docking facility, and a copy of the survey provided to the Division of Coastal _ Management, within 60 days of completion of construction of these portions of the project. NOTE: Failure to provide the survey referenced in Condition No. 5 may result in a violation of this permit. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather-.- 10) This permit authorizes a maximum of two (2) new boat slips resulting in a total of four (4) slips on-site, all as referenced in the attached workplan drawing labeled 1 of 2 dated 3/23/06. General 11) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. NOTE: Future development of the permittee's property may require a modification of this permit. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. PROJECT DESCRIPTION: The applicant has requested that the subject CAMA Major Permit Application be processed under the Express Review Permitting Program. The project site is located at 702 Causeway Drive (Lot #15), adjacent to Banks Channel, in Wrightsville Beach, New Hanover County. The lot is approximately 0.46 acres with 50.5 'of shoreline frontage. The lot averages 3'-5'above mean sea level and the shoreline is stabilized by a bulkhead. The property is currently undeveloped and no vegetation exists on the site. All structures on the property (including the former LaQue Center) were recently demolished under CAMA Minor Permit #WB05-70, which was issued by the Town of Wrightsville Beach, on 12/02/05. The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Banks Channel, which are included in the Wrightsville Recreational Area, are classified as SB# by the N.C. Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to construct a pier, covered gazebo and floating dock adjacent to the property. The pier (6' x 57') would extend from the center of Lot #15, adjacent to the bulkhead, and span in an easterly direction. A 14' x 14' covered gazebo would be located at the terminal end of the pier, and would provide access to the 6' x 60' section of floating dock. The proposed dock would be in alignment with the pier and would also extend in an easterly direction. The proposed docking system would provide dockage/storage space for up to four (4) vessels. Water depths in the vicinity of the floating dock range from -9.0' to -18.0' relative to Mean Low Water (MLW) According to the work plat drawings provided by the applicant's agent, the proposed structure would be located within the established area of riparian access, and would not extend beyond the established pier head line. 10. ANTICIPATED IMPACTS The proposed pier, gazebo and floating dock would incorporate an additional 910 square feet of estuarine waters and public trust area. The proposed structure would be consistent with the Town of Wrightsville Beach Pier Head Line and could be built with in the applicant's area of riparian access.
