Dear Mr. Furness:
This correspondence confirms my receipt of your letter with attached documents hand delivered
on August 25, 2017 concerning the PCS Phosphate's Bay City Farm wetland and stream
restoration site. Your letter requests written approval of the successful completion of the
restoration activity and mitigation credit calculations for the Bay City Farm site. The site is
located off the west side of Bay City Road, adjacent to South Creek, south of the community of
Royal, in Beaufort County, North Carolina. Work within Department of the Army (DA)
jurisdictional areas associated with this project was previously authorized by Nationwide Permit
27 (ORM ID: SAW -2007-01848)
The US Army Corps of Engineers (Corps) has reviewed your request and the attachments
included therein. The attachments detail the determination of wetland and stream mitigation
credits for the site based on the 5 year monitoring program and mitigation ratios specified in the
Corps 404 permit.
Included in the attachments is the updated mitigation ledger, as of August 24, 2017, required by
Condition N of the Corps 404 mine continuation permit issued to PCS on June 10, 2009 (ORM
ID: SAW -2001-10096), incorporating the Bay City Farm mitigation credits as shown in the
document referenced above.
The Corps has determined the Bay City Farm mitigation site as successful and no further
monitoring is required. The site has met the terms and conditions of the associated permit and is
officially closed out. The Corps agrees with the calculation of the wetland mitigation credits
(284.47) and stream mitigation credits (4,601) generated by the Bay City Farm. Inclusion of the
Bay City Farm credits in the mitigation ledger is appropriate and is found compliant with
Condition N of the Corps 404 permit as of August 24, 2017.
