Dear Mr. Furness:
This correspondence confirms my receipt of your letter with attached documents hand delivered
on December 21, 2016 concerning the PCS Phosphate's Upper Back Creek mitigation site. Your
letter requests written approval of the successful completion of the restoration activity and
mitigation credit calculations for the Upper Back Creek site. The site is located at the end of
Ormond Road, adjacent to Back Creek, in Bath, Beaufort County, North Carolina. Work within
Department of the Army (DA) jurisdictional areas associated with this project was previously
authorized by Nationwide Permit 27 (ORM ID: SAW -2008-02428)
The US Army Corps of Engineers (Corps) has reviewed your request and the attachments
included therein. The attachments detail the determination of wetland and stream mitigation
credits for the site based on the 5 year monitoring program and mitigation ratios specified in the
Corps 404 permit.
Included in the attachments is the mitigation ledger for the end of 2016, as required by Condition
N of the Corps 404 mine continuation permit issued to PCS on June 10, 2009 (ORM ID: SAW -
2001 -10096), incorporating the Upper Back Creek mitigation credits as shown in the document
referenced above.
The Corps has determined the Upper Back Creek mitigation site as successful and no further
monitoring is required. The site has met the terms and conditions of the associated permit and is
officially closed out. The Corps agrees with the calculation of the wetland mitigation credits
(68.2) and stream mitigation credits (6,207) generated by the Upper Back Creek site. Inclusion of
the Upper Back Creek credits in the mitigation ledger is appropriate and is found compliant with
Condition N of the 404 permit as of December 21, 2016.
