Any violation of these terms may be subject to fines, imprisonment.or civil action; or may cause the permit to be null and void. Shoreline Stabilization 1) The alignment of the bulkhead shall be staked by a representative of the -Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate . construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The bulkhead shall be constructed prior to any backfilling activities. 3) The bulkhead shall be strucfurally tight so as to prevent seepage of backfill materials through the structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Tim Newsome Permit. #83-06 Page 2 of 4 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which shall be required for the construction of the bulkhead wall, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 5) The fill material shall be clean and free of any pollutants except in trace quantities. 6). All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 7) No backfill material shall be placed within 30 feet of the normal water line, except that which shall be used to backfill the area behind the permitted bulkhead-, 8) -A silt fence shall be properly installed immediately landward of the bulkhead. cap immediately following completion of backfilling activities, and shall remain until the disturbed areas are vegetated and stabilized. Docking Facility 9) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking.facility shall.be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 10) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent. part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized* work. 12) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 13) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 14) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. General 21) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 22) No vegetated wetlands shall be excavated or filled, even temporarily. PROJECT SUMMARY: Applicant proposes to construct a bulkhead, pier, platform, finger piers, 2-stall boathouse, wet slip, jet ski lift, fill in an existing sand pit, and grade the entire lot. Tim Newsome Winton Hertford County Project setting The project site is on the West Side of the Chowan River located off SR 1175 (Parkers Ferry Road) on West River Watch Trail near the Town of Winton in Hertford County, North Carolina. The project site is a -4.3 acre tract. The project area is bordered on the upstream (north) end by a developed lot, which includes a single-family residence with a natural shoreline. The downstream side (south) of the project area is an undeveloped/unimproved lot. Both the adjacent properties are vegetated with mixed hardwoods, pines and yard grasses. The property appears to be an old borrow site buffered from the River by a -20' high berm vegetated with mixed hardwoods and pines on the north side (upstream) of the property. The berm is -50' wide and runs parallel to the shoreline for a distance of -200' for approximately half the length of the subject project shoreline. The elevation of the berm appears to be representative ofthe natural elevation of the tract due to similarities with the upstream property. The -20' high berm transitions down to an elevation of approximately 4' above the Normal IA'ater Level (l w) on the downstream end of the property. Located + 150'landward of the WT is a man-made pond which is approximately .10 an acre in size. A man-made ditch is located on the east side of this pond, which flows toward the Chowan River. Juncus Effusus is located throughout and adjacent to this ditch. The Division of Cultural Resources has identified site Hf14 on or near the subject property. The Chowan River is classified as B NSW waters by the Environmental Management Commission at the project site. The Chowan River is Joint Waters and is not open to shell fishing. Project description The applicant proposes to construct -420 linear feet of bulkhead an average' of 2' (with a maximum of 5') waterward of the NWL. The -20' high berm will be graded to an elevation similar to that of the downstream end of the property (-4' above NWL). The man-made pond will be filled with material that has been cut from the existing onsite berm. These proposed grading activities will result in the entire -4.3 acre tract being disturbed. A Sedimentation and Erosion Control plan will be required from the Division of Land Resources. The applicant also proposes to construct a -6' by -35' pier with a -20' by =20' L-head platform at the terminal end of the pier. Additionally, a -5' by -45' dock is proposed at the landward end of the pier adjacent to the proposed bulkhead. This dock will have three - -3' by -30' finger piers extending watenvard which vaill create 3 fixed slips. The two downstream slips are proposed to be covered with a -35' by -37(dripline) boathouse. The remaining slip will be left uncovered Also, a single pile supported jet ski lift will be located on the proposed pier. The total number of slips proposed is four. The total proposed platform square footage is 895 ft2 out of--1,680 ft2 total allowed at 4ft2 by 420 linear feet of shoreline. Tim Newsome - Hertford County Paae 2 The applicant also proposes a 16' wide wooden walkway that transitions into a cement walkway of the same width 30' landward of the bulkhead. A single-family residence, barn and associated driveways will also be located on the lot outside of the 76' Estuarine Shoreline. Anticipated impacts The project as proposed will result in a total upland disturbance of approximately-187,308 ft2 (14.3acres). The construction of the bulkhead and installation of backfill as proposed will result in the filling of approximately 840 ft2 of river bottom. The construction of the pier, platform, dock, and boathouse will result in the shading of 11,826 ft2 of river bottom. Localized turbidity will be present as a result of the construction of the bulkhead and pier structures. In addition to the home, a storage building, a boat house with 2 boat lifts, 1 jet-ski lift, a swim platform, bulkhead, and pier v ill be constructed. We are proposing a 33' X 35' boat house. We have a two 25' boats and need a finger pier in the center and one on each side for access, the pu?rpose cf the 'MIncove:es slip is ro accommodate guest to moor their vessel. This property was once a sand pit; therefore there are acres to be graded. Noted on the enclose map, these is a hill that is 260' long, 60' wide, and 18' tall, that will be graded throughout the 4.3 acres.
