This one is so weird that I really need your help. Should have scheduled with you 8,000 tons of rock

I scored an 18 not wanting it to be a stream. Mike H got a 19.5 so I requested second op. Amy nearly
got considerably more. Still a stream none the less.

Dear Mr. Sink:
On February 27, 2006, at the request of Steve Mitchell, your consultant, Ian McMillan and Amy Chapman of the
Division of Water Quality conducted an on-site determination to review one stream feature located on the subject
property for applicability to the Neuse Buffer Rules (15A NCAC 213.0233). The stream feature is labeled as "A" on
the attached map initialed by Ian McMillan on February 27, 2006. Division of Water Quality (DWQ) Staff from the
Raleigh Regional Office (RRO) had previously conducted an on-site determination of the stream feature. In your
letter to the Director dated February 06, 2006, you fequested an appeal of their determination as provided within
15A NCAC 02B.0233(3)(a).
At your request, Ian McMillan and Amy Chapman conducted an appeal of their determination as stated above.
During our review we evaluated the stream using the DWQ Stream Classification Form. We evaluated the stream
reach at a point we flagged and labeled in the field as "A", and calculated the score to be 25.5 points. The form
states that if the score is "greater than or equal to 19 points the stream is at least intermittent".
The DWQ has determined that the stream labeled as "A" on the attached map is at least "intermittent" and is
subject to the Neuse Buffer Rule. This determination shall replace the determination originally performed by the
Regional Office. This stream and its associated buffers should be identified on any future plans for this property.
The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future
correspondences concerning this property.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers.
Nor does this letter approve any activity within Waters of the United States or Waters of the State. If you have any
additional questions or require additional information please call Cyndi Karoly at [phone]. This
determination is subject to review as provided in Articles 3 & 4 of G.S. 150B.

This letter is being directed to you in an attempt to resolve the dispute of an on-site
determination made by Mr. Mike Horan of the Raleigh Regional Office (RRO). The
Regional Office reference number is 05-0342.
The property in question is, and has been owned by Mr. Henry Sink, Jr. prior to the
legislation protecting riparian buffers adjacent to stream within the Neuse River Basin.
(July 22, 1997). Mr. Sink's property, Lot 299A Country Club Hills, is located at the
intersection of Alamance Drive with Yadkin Drive off Glenwood Avenue
This second opinion determination is being requested as provided for in Article 3 and 4
of General Statute 150B. This states that surface waters that appear on the maps (USGS
and County Soils) shall not be subject to this Rule if an on-site determination shows they
fall into one of the following categories:
(i) Ditches and man made conveyances
(ii) Manmade ponds
(iii) Ephemeral streams
It is our contention that this feature is an ephemeral stream that conveys water only in
response to a rain event. Please advise me as to your earliest availability to conduct an
onsite evaluation of this drainage feature. I can be reached at either [phone] or

it is subject to the buffer rule may request a determination by the Director. A request jor a determination by the

act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day watutory
appeal time does not strut iwtil the affected party (including downstream and adjacent landowners) is notified of
this decision. DiVQ recommends that the applicant conduct this notification in order to be certain that third
party appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Ilearim s, 6714.1lail
