Dear Mr. and Mrs. Sharer:
You have our approval, in accordance with 15A NCAC 02B .0233 and any conditions listed below, to
impact approximately 371$2 of Zone 2 of the protected riparian buffers for the purpose of constructing
the home at the subject property as described within your application dated January 27, 2006, which was
received by the N.C. Division of Water Quality on February 9, 2006, and additional information received
on February 23, 2006. In addition, you should obtain or otherwise comply with any other required
federal, state or local permits before you go ahead with your project including (but not limited to) Erosion
and Sediment Control, Non-discharge regulations. .
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this authorization and approval letter and is thereby responsible
for complying with all conditions. This approval requires you to follow the conditions listed below.
The Additional Conditions of the Certification are:

The following impacts are hereby approved as long as all of the other specific and general
conditions of this Certification (or Isolated Wetland Permit) are met. No other impacts are
approved including incidental impacts:

3. Certificate of Completion
Upon completion of all work approved within this authorization, and any subsequent
modifications, the applicant is required to return the attached certificate of completion to the 401
Oversight/Express Review Permitting Unit, North Carolina Division of Water Quality, 1650 Mail
Service Center, Raleigh, NC, 27699-1650.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B. This Authorization Certificate shall
expire five (5) years from the date of this letter.
This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 2B
.0233. If you have any questions or would like a copy of the buffer rules, please call Amy Chapman at
(919) 733-1786. This letter does not authorize any impacts to either Waters of the United States or
Waters of the State. Please contact the US Army Corps of Engineers (USACE) or NC Division of Water
Quality (DWQ) if any impacts are proposed to either of these waters.

Dear Sir or Madam:
On February 2, 2006, the Division of Water Quality (DWQ) received your application dated January 27,
2006, requesting a Minor Variance from the Neuse River Basin Riparian Buffer Rule for to impact
approximately 375 square feet of Zone 2 of the protected riparian buffer to construct the proposed
residence. The DWQ has determined that your application was incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore, unless we
receive five copies of the additional information requested below, we will have to move toward denial of
your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete
until we receive this additional information. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. Please provide a location map for the project.
2. Please indicate all buffer impacts on the site plan. Please note that the deck is also considered an
impervious surface in the buffer zone. Please be certain that all impacts to Zone 2 are accounted
for.
3. Please indicated the location of the protected buffers as overlays on the site plan.
Please contact the DWQ within three weeks of the date of this letter to verify that you have received this
letter and that you remain interested in continuing to pursue permitting of your project and will be
providing the DWQ the requested information at a later date. Please contact me in writing and Eric Kulz.

be modified, reissued, or revoked prior to March 18, 2007. It is incumbent upon you to remain informed of changes to
the NWPs. We will issue a public notice when the NWPs are reissued. Furthermore, if you commence or are under
contract to commence this activity before the date that the relevant nationwide permit is modified or revoked, you will
have twelve (12) months from the date of the modification or revocation of the NWP to complete the activity under the
present terms and conditions of this nationwide permit. If, prior to the expiration date identified below, the nationwide
permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified
below, provided it complies with all new and/or modified terms and conditions. The District Engineer may, at any time,
exercise his discretionary authority to modify, suspend, or revoke a case specific activity's authorization under any
NWP.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality
Certification. You should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section
401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management
Act (CAMA), prior to beginning work you must contact the N.C. Division of Coastal Management.
