PROJECT SUMMARY: The applicant proposes to construct seven buildings providing 14-townhome units, sidewalk, driveways, access road and utilities. The Palms at Boca Bay, LLC Page Two 9. PROJECT DESCRIPTION Charles F. Riggs and Associates, Inc., on behalf of The Palms at Boca Bay, LLC, has requested that the attached application be processed under the Express Permit Review Program. The applicant's project is located at the end of Pender Avenue, adjacent to Topsail Sound, in Surf City, Pender County. To find the property, take Highway 17 North from Wilmington and turn right on N.C. Highway 50 (approximately 30 miles from Wilmington). Head east on N.C. Highway 50 and turn left onto N.C. Highway 210. Turn left onto Pender Avenue (approximately 3.5 miles from the intersection ofN.C. Highway 50 and N.C. Highway 210) and the property will be located at the far end, on the right hand side of the street. The property is located on the tip of a peninsula and is surrounded by wetlands. The Palms at Boca Bay is a 4.13 acre tract that is dominated by both coastal wetlands and Section "404" type wetlands. The high ground portion of the tract is primarily cleared of vegetation and is relatively flat with an elevation of 5.0' above Normal Low Water (NLW). Several small stands of Live Oak (Quercus laurifolia), Southern Wax Myrtle (Merica cerifera), Yaupon (Ilex vomitoria), and Red Cedar (Juniperus virginiana) exist on the waterward side of the site, bordering the Topsail Sound. There is an existing paved road (Pender Avenue) located on the southeastern side of the tract that enters the property from the east. The tract has approximately 1,138 linear feet of shoreline along Topsail Sound. The high ground vegetation is bordered by transitional species including Sea Oxeye (Borrichiafrutescens) and Grounsel-bush (Baccharus halimifolia). High coastal marsh vegetation, including, Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp.), and Salt Meadow Grass (Spartina patens) complete the transition to the waters edge where Smooth Cordgrass Marsh (Spartina alterniflora) is the predominant species. The shoreline in this area is not bulk-headed. The waterward edge of the proposed structures averages approximately 50 feet landward of normal high water (NHW). The waters of Topsail Sound, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. According to maps provided by the Department of Environmental Health, Shellfish Sanitation Section, the area is OPEN to the harvesting of shellfish. According to the application package, the subject property is located outside of the Ocean Hazard Area of Environmental Concern (AEC). However, a portion of high ground located within the right-of-way of Pender Avenue, adjacent to subject property is located within the High Hazard Flood Area, as indicated by Zone VE (elevation 12) on the Flood Insurance Rate Map. The applicant proposes to disturb a portion of the high ground within this area for utilities installation. The High Hazard Flood Area (VE Zone) associated with the disturbed area along Pender Avenue is contiguous to the Atlantic Ocean. CAMA Minor permit #04-50 was issued to the applicant (LMY-LLC C/o Mark Yow), on 12/15/03 for the construction of a duplex on the subject property. The existing duplex is located on one of the 8-lots within the subdivision and is part of the overall project, however, no subsequent work on this parcel is being proposed as part of this permit application. PROPOSED PROJECT The applicant proposes to develop the property by constructing seven buildings (providing 14 single-family townhome units), access road (N. Boca Bay Lane), sidewalks, driveways, decking, and utilities. Development would include grading and filling approximately 2.1 acres of the property for road construction and lot preparation. The applicant proposes to construct seven buildings on the remaining seven lots within the subdivision (please refer to sheet 1 of 3, dated 11/10/04 for a detailed description of the residential structures). Individual lots sizes would range from 9,900 square feet to 58,000 square feet, giving a density of 3.868 units/acre. Access to the lots would be provided by the construction of a single road (N. Boca Bay Lane). The road would provide the subdivision with one entrance and exit from Pender Avenue. The asphalt road would terminate in a turn around cul-de-sac at the northern end of the property. N. Boca Bay Lane would consist of a 25-foot right-of-way and a 20-foot paved asphalt surface with an ABC stone sub-base. The road would be constructed with curb and gutter, utilizing curb breaks and vegetated swales to control stormwater. The Palms at Boca Bay, LLC Page Three Utilities installation would include upgrading the existing water line, which is located on the southern side of Pender Avenue and within the 30-foot Coastal Shoreline buffer. A four-inch water line currently exists and the applicant is proposing to replace the smaller private line, with a larger eight-inch public line. The utilities would run along the entire length of Pender Avenue from the intersection of N.C. Highway 50 to N. Boca Bay Lane. The applicant has indicated that they will be submitting an Express Low Density Stormwater Permit to the North Carolina Division of Water Quality for the proposed project, in the near future. The applicant has an approved Sedimentation and Erosion Control Plan (No.Pende2005-212), which was approved by the Division of Land Quality on 6/01/05. Municipal water would be provided to the subdivision by the Town of Surf City. As proposed, no portion of the subdivision, including but not limited to the dwellings, eaves, access roads, driveways, streets and/or sidewalks will impact any portion of coastal wetlands or "404" type wetlands. Additionally, all development would be located outside of the 30-foot Coastal Shoreline buffer, with the exception of the utilities, which will run within the right-of-way along Pender Avenue. 10. ANTICIPATED IMPACTS: The initial grading of the property would result in the disturbance of approximately 2.1 acres of high ground. The proposed dwellings, street and drives would result in the creation of approximately 35,021 square feet of impervious surface area. Total impervious surface coverage within the 75' Estuarine Shoreline AEC would be 5,488 square feet. High ground disturbance within the High Hazard AEC would be limited to a small area on both sides of Pender Avenue. The disturbance associated with the utilities installation would be located well outside of the 255 feet Ocean Hazard AEC, but within the High Hazard Flood Area.
