After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). NARRATIVE DESCRIPTION: Project Setting The site is a 7.3 acre lot located at 511 Neuse Village Road adjacent to the Neuse River near Arapahoe, Pamlico County, North Carolina. The project tract was previously multiple lots that have been recombined to form on large lot. The lot is sloped from approximately 8' above the NWL on the east side of the lot to approximately 3' above the NWL on the west side of the lot where there is an area of Section 404 Wetlands delineated and approved by the USACE. There is an existing gravel road on the property that is used to access the neighboring properties. Eight single-family cottages are in various stages of construction on the lot. The electric, phone, and water utility lines have been installed and the applicant has installed two septic tanks along with an accompanying septic field. The majority of the upland area on the lot is cleared with the remaining area vegetated with pine trees. The lot has 335' of shoreline, of which 215' is hardened with marl rip rap landward of a 20'- 30' wide estuarine beach and the NWL. The remaining shoreline is unprotected and is experiencing shoreline erosion as evidenced by a 2' -3' erosion escarpment on the landward side of the estuarine beach. There is also an old rock jetty on the property, which ranges from 10' to 25' in width and projects out approximately 60' into the Neuse River. There is a single-family residence and dock on the adjoining property to the southwest, while the property to the northeast is undeveloped. The Neuse River is classified SA; HQW and NSW by the EMC in the vicinity of the proposed construction. The Neuse River is not classified by the Division of Marine Fisheries as either a primary or secondary nursery area but is open to shell fishing. The Pamlico County Land Use Plan categorizes this area of the county as Rural, with all AEC's classified as Conservation. The Division of Water Quality approved Stormwater Management Permit #SW7050713 for a low-density residential development on this property. A Sedimentation and Erosion Control Plan has been issued by the Division of Land Resources for the project. Project Proposal The applicant proposes to complete construction of eight two-story 25' X 60' single-family cottages with a maximum height of approximately 33'above the existing grade. The cottages are proposed to be setback a minimum of 77' and a maximum of 180' from the normal water level. Parking for the cottages would be provided in four parking areas with four parking spaces each for a total of 16 parking spaces. A 32' x 50' swimming pool(including pool deck) is proposed for use by cottage residents. The applicant also proposes to relocate an existing gravel road that currently divides the property. The existing road is 535' long and 30' wide. The proposed road will be rerouted around the main project area and would be approximately 500 long within a 30' wide right- of-way, including the road shoulders, and a 12' gravel travel way. Three additional septic tank systems are proposed for the project, which would include associated piping and drainfield areas. The applicant has requested to add 120' of marl rip rap to complete the stabilization of the remaining shoreline. The applicant also requests to construct a pier 5' w'de and 165' long to a "T" platform that would be 9' long by 30' wide with no permanent boat slips proposed. The pier and platform would extend out into the Neuse River a total of 138', as 36' of the pier would be over high ground. The Neuse River is greater than five miles wide in the project area and the water is approximately 3' deep at the end of the pier. The pier would be 52' from the adjacent riparian area to the northeast, 150' from the adjacent riparian area to the southwest, and as proposed, is similar in length to existing piers along this same shoreline. To provide fire protection for the cottages, a dry hydrant is proposed. A 6" diameter intake line would extend from the dry hydrant out into the Neuse River 100' beyond the NWL and would be below the mud substrate with the exception of the screened intake end. The intake line is proposed to run 15' from and parallel with the southwestern riparian line. Anticipated Impacts The project would disturb 100,815 sq. ft. of high ground, of which 22,159 sq. ft. would be impervious surface for the residences, road, parking area, pool, and other infrastructure. All proposed impervious surfaces are outside of the N.C. Division of Coastal Management 75' Estuarine Shoreline AEC. This equates to Ora impervious surface within DCM's 75' Estuarine Shoreline AEC and a 6.9Cc impervious surface for the entire tract. All proposed development is located outside of any Coastal or Section 404 Wetlands. The pier and rip rap are proposed within the N.C. Division of Water Quality's Neuse River Basin Riparian Buffer Zone, however, both are water dependant activities and are classified as allowable under current regulations. Sedimentation and stormwater control techniques have been planned for which should minimize any impact from the development of the site. The pier would usurp and shade 960 square feet of estuarine waters, public trust area, and shallow water habitat. The pier has been proposed to primarily provide a viewing platform for the residents of the cottages. There are no permanent slips proposed in association with the dock. The pier and dry hydrant intake line would not extend beyond the existing piers along the shoreline. A localized and temporary increase in turbidity can be expected during the in-water portions of the construction of the pier and dry hydrant intake line.
