Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as
defined by the Coastal Area Management Act with Additional Conditions
Dear Mrs. Wright:
You have our approval, in accordance with the conditions listed below, to impact approximately 1354 square
feet (ft) of Zone I and 1380 square feet of impact to Zone II of the protected riparian buffers for the purpose
of constructing a dwelling on the subject property as described within your application dated November 18,
2005, and received in full on February 21, 2006. This letter shall act as your approval for the use of the
"General" Major Variance; From the Neuse River Riparian Buffer Rules for the Construction of Structures on
Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL
CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management
Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local
permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and
CAMA permits. This approval shall expire in five years from the date of this letter.
This approval is for the purpose and design that you described in your variance request. If you change your
project, you must notify us and you may be required to send us a new request for approval. If the property is
sold, the new owner must be given a copy of this approval and plat thereby assuming responsible for
complying with all conditions. This approval requires you to follow the conditions listed below.

The Additional Conditions of the Certification arc:
1. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant is required to return the attached certificate of
completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 943 Washington
Square Mall, Washington, NC 27889.
2. Diffuse Flow
All new stormwater drainage shall be directed to vegetated areas as diffuse flow at non-erosive
velocities prior to entering the protected riparian buffers as identified within 15A NCAC 2B .0233(5).
No new ditching or piping of stormwater through the protected buffers is allowed
3. Buffer Mitigation (EEP/Restoration)
You are required to mitigate for Zone I impacts to the protected riparian buffers. The required area of
mitigation to compensate for impacts to the protected riparian buffers is 1354 square feet as required
under this variance approval and 15A NCAC 2B .0233.You may make a payment into the Riparian
Buffer Restoration Fund administered by the NC Ecosystem Enhancement Program (EEP) to meet this
mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the
mitigation requirement. In accordance with 15A NCAC 2B .0233, this contribution will satisfy our
compensatory mitigation requirements under 15A NCAC 2B .0233(9)(C). Until the EEP receives and
clears your check (made payable to: DENR -Ecosystem Enhancement Program Office), no impacts
specified in this variance approval shall occur. The EEP should be contacted at (919) 715-0476 if you
have any questions concerning payment into the EEP. For accounting purposes, this variance
approval authorizes payment into the Riparian Buffer Restoration Fund to compensate for 1354
ft of required riparian buffer mitigation for impacts to 1354 ft2 of protected riparian buffers; 03-
04-10, 27-108 river and subbasin."
The DWQ will accept an alternative method of mitigation (including but not limited to Buffer
Restoration or Enhancement) pursuant to the Buffer Mitigation Rule (15A NCAC 02B .0233) to satisfy
this mitigation requirement. If you choose to pursue this option, then you are required to submit in
writing a mitigation plan to the DWQ Wetlands/401 Unit/ Washington Regional Office for review and
approval. This plan should include a proposal to plant native species of hardwood trees with in the
riparian buffer area. For more information, please contact this office. No impacts shall occur to the
protected buffers until the mitigation plan is approved by the DWQ.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings to:
6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding
unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer
Protection Rules (15A NCAC 213.0233 (9)(c)). Please contact Kyle Barnes at 252-948-3917 if you have any

KNOW ALL MEN BY THESE PRESENTS, that JAMES ARLEN HORTON
and Wife, FRANCES W. HORTON, of Clarkson, Pennsylvania,
hereinafter called "Declarants", do hereby covenant and agree to
and with all other persons,'firms.or corporations now owning or
hereafter acquiring as owners any lot or parcel of land in the
area designated or located in or near the Town of Oriental,
Pamlico County, North Carolina, known as Lots 1 through 15, as
shown on the map entitled PLAN OF FAIRWINDS SUBDIVISION, dated
July 13, 1987, and recorded in Plat Cabinet A, Slide 104-2 , of
the Pamlico County Registry; said lots are hereby subject to the
following covenants and restrictions and to the use thereof,
running with the land by whomsoever owned: ,
1. These covenants are to run with the land and shall
be binding on all parties and persons claiming under them until
January 1, 2007, at which time said covenants shall be
automAtically extended for successive periods of tan years unless
by vote of a majority of the then owners of the lots, it is
agreed to change said covenants in whole or in part.
2. If the parties hereto or any of them or their
heirs, successors, or assigns, shall violate or attempt to
violate any of the covenants heroin, it shall be lawful for any
other person or persons owning any real property situated in said
development or subdivision to prosecute any proceeding at law or
in equity against the person or persons violating or attempting
to violate any such covenants and either to prevent him or them
from so doing or to recover damages or other dues for such
violation except the party of the first part is specifically
excluded from any liability for damages.
3. Invalidation of any one of these covenants by
judgment or court order shall in no way affect any other of the
provisions which shall remain in full force and effect.
4. No residential structures shall be erected, placed
or permitted to remain on any residential lot other than one
detached single family dwelling and other outbuildings incidental
to the residential or personal boating use of the plot
(including, but not limited to, boathouse, pier or dock). Said
residential structure shall have a minimum floor area of 1,500
square feet of which 150 feet may be a porch or deck. No
residence shall be started on any of the above-described lots
until the plans of such structure and the plot plan showing the
location of such structure has been approved by Declarants, their

successors, heirs, assigns or designees. Such approval must be
in writing. Declarants shall alsgoot?ave t% light to approve any

5. No building shall be located on any residential
building plot nearer than ten (10) feet from the adjacent lot
line and no building shall be located on any plot nearer than
thirty (30) feet from any adjoining street right-of-way.
6. None of the platted lots shall be reduced in size
by a subsequent purchaser in any manner except where they are
incorporated into other lots which would constitute an increase
in the overall size of the lot rather than a decrease in such
size.
7. Drainage and utility easements are reserved along
all lot lines ten (10) feet on each side where required by
Declarants. Drainage must be installed in a manner so as not to
unnecessarily detract from value and appearance of the property.
8. A homeowner's association shall be formed by the
lot owners in the subdivision. It may be a corporated or a non-
incorporated association, whichever is determined by a majority
vote of the members. It is intended that there be one veto per
lot regardless of the number of persons owning a particular lot.
A Board of Directors shall be elected by said association
consisting of five members. If at any time the association
becomes dissatisfied with such Board, then it may call for a vote
and elect a new Board to serve for a period of three years until
their successors are elected. The Board of Directors shall have
the following duties and powers:
(a) Approve boathouse, dock and pier plans and their
location.
(b) Approve any new boat slips.
(c) Cut weeds, remove rubbish, trash, debris or other
undesirable matter in order to protect the safety and health of
adjoining property owners, after notice to lot owner and charge
the cost thereof to such lot owner.
(d) To control and regulate boat speeds and type of
operation.
(e) To approve or disapprove any camping trailers
located on said property on a temporary basis.
(d) To control and enforce said control on minibikes,
motorcycles and other motorized vehicles that in their discretion
become a public nuisance.
9. All individual purchasers from and after this date
shall be required to keep their respective lots free and clear of
weeds, rubbish, trash, debris, and other matter. Thin in not to
prevent any lot owner from leaving his lot in which is known an .
"natural habitat". The Board of Directors shall have.tho right
to allow or disallow plans for "natural habitat" planning.

10. No noxious or offensive trade or activity shall be
carried on upon any lot nor shall anything be done thereon which
may be or become an annoyance or nuisance to the neighborhood.
11. No trailer, tent, shack, garage, barn or other
outbuilding erected on a Lot shall at any time be used as a
residence temporarily or permanently nor shall any structure of a
temporary character be used as a residence except as enumerated
in Paragraph 8; the Hoard of Directors does have authority to
approve camping trailers on a temporary basis.
12. No signs, fences, or any structures which would
detract or lessen the aesthetic view of any lot owner shall be
erected without the approval of the Board of Directors.
13. All dwellings, garages and incidental outbuildings
erected or placed on any lot of the subdivision shall be
constructed of material of good grade, quality and appearance and
all construction shall be performed in a good and workmanlike
manner.
14. No mobile home, trailer, camper, tent, or
temporary house, temporary garage or other temporary outbuilding
shall be placed or erected other than temporary structures for
storage of materials during construction. No such.temporary
structure shall be used at any time as a residence.
15. Any dwelling or improvement which is destroyed in
whole or in part by fire or other casualty must be rebuilt or all
debris removed and the lot restored to a sightly condition with
reasonable promptness. In no event shall such debris remain
longer than three (3) months.
16. No stripped, partially wrecked or junked motor
vehicle, or part thereof, shall be permitted.
17. All fuel storage tanks, outdoor receptacles for
lashes, trash, rubbish or garbage, shall be screened or so placed
and kept so as not to be visible from any road, creek or
adjoining property.
18. All.outdoor clothes lines and similar equipment
shall be screened or so placed as not to be visible from any road
or waterway.
19. No sign, billboard or other advertising structure
may be erected other than construction identification signs
during the period of any construction, and a single "For Sale"
sign not to exdeed thirty-six (36) inches in any dimension...
20. No livestock or poultry of any kind shall be
raised, bred or kept, except that dogs, cats or other household
pets in a reasonable number may be kept provided that they are
not kept, bred or maintained for any commercial purpose.
21. No noxious, offensive or illegal trade or activity
shall be carried on upon this land.

22. Television antennas shall be constructed to a
maximum height of tan feet above the roof's highest poin?..
Satellite dishes are allowed provided they are constructed of
black mesh and located in the rear of the lot= rear being that
portion opposite the street.
23. Responsibility for maintaining streets, d?ainage
culverts, ditches, and the subdivision sign, shall be thgl joint
obligation of all owners of lots. Such responsibility shall be
shared proportionately with the owners of lots shown on the map
which is horoinabove referred to.. In addition, all lot owners
agree that their proportional share of the said maintenance costs
shall constitute an assessment against said owner's lot 1r lots
and if unpaid for a period of over thirty (30) days, she 1
constitute a lien on said lot or lots enforceable when f led with
the Clerk of Superior Court, Chapter 44 of the Horth Carolina
General Statutes as amended. The 1Ara for unpaid assessments
shall also secure reasonable attorney's fees incurred by those
enforcing said lien. This lien shall be subordinate to any deed
of trust which shall bea line on said lot or lots.
24. The Declarant or any property owner or any party
to whose benefit these Restrictions inure may proceed at law or
in equity to prevent the occurrence, continuation or violation of
any of these Restrictions and the Court in any such action may
award the successful party reasonable expenses in prosecuting
such action, including attorney's fees.
The remedies hereby specified arc cumulative, and
this specification.of them shall not be taken to prealudo an
aggrieved party's resort to any other remedy at law, in 'equity,
or under any statute. Ho delay or failure on the part of
Declarants or any property owner or an aggrieved
y party to invokes
an available remedy in respect of a violation of any of the
Restrictions shall be held to be a waiver by that party of (or an
estoppel of that party to assert) any right available to him upon
the recurrence or continuation of said violation or the
occurrence of a different violation.
25. The grantee of any lot subject to the coverago of
this Declaration, by acceptance of a dead conveying title
thereto, or the execution of a contract for the purchas9 thereof,
whether from Declarants or a subsequent owner of such lot, shall
accept such deed of contract upon and subject to each and all of
these Restrictions and the agreements heroin contained, and also
the jurisdiction, rights and powers of Declarants, and by such
acceptance shall for himself, his heirs, personal ropreaon-
tatives, successors and assigns, covenant, consent and agree to
and with Declarants, and to and with the grantees and subsequent
owners of each of the lots within the Subdivision to keep,
obsorvo, comply with and perform said Restrictions and ugracment.

26. Every one of the Restrictions is hereby declared
to be independent of, and severable from, the rest of the
Restrictions and of and from every combination of the
Restrictions. Therefore, if any of the Restrictions.shall be
held to be invalid or to be unenforceable or to lack the quality
of running with the land, that holding shall be without effect
upon the validity, unenforceability, or "running" quality of any
other one of the Restrictions.

This' correspondence is in response to your letter of September 9, 1997, requesting a
clarification of CAMA setback requirements, in Pairwinds Subdivision, near Oriental, ill Pamlico
County. It also serves as a follow up to our later telephone conversation.
As you are aware, the Pamlico County 1992 Land Use-Plat1 as amended establishes a
permanent conservation zone within seventy-five (75) feet of the natural mean high water level for
all shorelines bordering estuarine waters and public trust waters. This policy does,nQ,t apply to
land approved by the Pamlico County Board of Conurdssioncrs for subdivision before January 26,
1990, regardless of use. And as I stated during our telephone conversation, I shared the
information that you provided to me with Ms. Mary Dec Carraway, our representative in the
Attorney General's office. It is our understanding that the subdivision received preliminary
approval from the Pamlico County Planning Board on September 28, 1987, and final approval oil
July 14, 1997, but under the 1987 ordinance. Therefore it is our opinion that the subdivision not
be subject to the 75' permanent conservation zone established for "new" subdivisions.
