Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) In accordance with commitments made by the permittee, the permitted docking facility, including the 46' X 12' platform, shall be constructed no farther than 182' waterward of the existing bulkhead. 2) No portion of any structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. 3) An as-built survey shall be performed showing the dimensions of the docking facility and the location of the docking facility in relation to the channel, and copies of the survey provided to the Army Corps of Engineers and Division of Coastal Management, within 60 days of completion of construction of these portions of the project. NOTE: Failure to provide the survey referenced in Condition No. 3 may result in a violation of this permit. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Richard and Jenni Oliphant Permit #18-06 Page 2 of 3 ADDITIONAL CONDITIONS 4) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. 5) All material resulting from the removal of the remnant piers shall be placed on an approved upland disposal site. 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the, docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforded throughout' the entire existence of the permitted structure. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 12) This permit authorizes a maximum of ten boat slips NOTE: Any proposal to add one or more additional boat slips to the authorized 10-slip facility will require that the docking facility be classified as a marina, and will therefore require a review under the N.C. Environmental Policy Act (NCEPA). NOTE: Due to the proximity of the AIWW, boats utilizing the docking facility will be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. I Richard and Jenni Oliphant Permit #18-06 Page 3 of 3 ADDITIONAL CONDITIONS General 13) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United 'States of the state of North Carolina on account of any such removal or, alteration. 14) The West Indian Manatee (Trichecus manaties), which is listed as a federally endangered species, has been reported in North Carolina waters. In order to protect the West Indian manatee all work should be done during the period from November 1 to May 31. If-work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which may Be Used by the West Indian Manatee in North Carolina" shall be followed. 15) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit modification. 16) This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to the local zoning ordinance for the Town of Swansboro. Failure to do this may result in the issuance of a Notice of Violation. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. PROJECT SUVLNIARY: The applicant is proposing to build a 219' dock with a 46'X12' platform. The dock would have ten boat slips to provide private docking to existing inland lots. Field Investigation Report: Richard Oliphant Page 02 9. Narrative Description: The Richard Oliphant project is located at 217 Deer Island Rd.(SR 1513) in Swansboro, Onslow County. Deer Island Rd. is on the western side of Swansboro and is connected to Hwy. 24 by Old Hammock Rd. The Atlantic Intracoastal Waterway borders the site to the South. Richard Oliphant's property at 217 Deer Island Rd. is 1.26 acres in its entirety and varies from 0' to 4' in elevation above NHW. The high ground portion of the site is landscaped and vegetated with grass. The entire site is bulk headed and the only other structures existing on the property are the remnants of old docks to be removed. There are no Coastal or Section 404 wetlands on the site. This property has approximately 340' of shoreline. The substrate in this area is mostly sand with chunks of concrete. The shoreline to the east of the property has rip rap and the shoreline to the west of the property has a two slip private dock. The Division of Water Quality classifies this area as SA waters. This area is not a Primary Nursery Area and is closed to the taking of shellfish. Swansboro's Land Use Plan dated January 29, 1999 classifies this area as Commercial and Conservation. There are no shellfish leases in this area. In this area, the AIWW has an 80' setback. 10. Project Description: In an effort to provide docking to existing inland lots, Richard Oliphant proposes to construct a 219' dock. The proposed dock would have ten slips with 4 finger piers. A 46'X12' platform would also be built on the dock. Mr. Oliphant currentyly has three tracks and does not plant to provide lot improvements or infrastructure. Extending from high the ground the 6' wide dock would be 219' long. A 46'X12' platform would be placed at the end of the proposed dock. Two 4'X20' finger piers would be placed on either side of the pier. Twenty mooring pilings would be placed around the finger piers to create a total of ten slips. The docking facility would extend a total of 231' waterward of bulkhead. This would leave a distance of 160' to the AIWW. The structure would be approximately 80' from the nearest riparian corridor. The water at the end of the proposed dock is -8' deep at normal low water. 11. Anticipated Impacts: The proposed dock would result in a total of ten boatslips. Increased turbidity would occur during the setting of the pilings. The proposed pier would shade 2,186 ft2 of open water. There would be 5,786 ft2 of public trust area incorporated. The location of the project in question is located at the terminus of NCSR 1513 (Deer Island Road) in Swansboro, North Carolina. The site was previously used as a Clam House and Dockage. All landward structures have been removed and the shoreline has received a new bulkhead (see General Permit 940730C). Some remnants of the old dockage for the Clam House operation still exist and should be removed in the execution of the improvements proposed herein. Mr. Oliphant has purchased 3 additional tracts of land in the vicinity of this parcel and wishes to subdivide his holdings on Deer Island Road into a division of 10 Residential Lots. In conjunction with this application each lot would be deeded one boat slip pursuant to this application. This is not a commercial facility application. No commercial facilities are included as a part of this application. There is approximately 236' across the riparian corridor fronting this property. The application includes a 6' wide dock extending 218.53' from the high water line at the bulkhead, a platform at the end with dimensions of 12' X 46', and 4 finger piers which are 20'X4'. The dock and platform are proposed to be elevated 5' above High Water level and the finger piers are proposed to be elevated 3' above high water.
