This permit, issued on December 20, 2006 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action, or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes only the grading and other land disturbing activities associated with the development of the property, including but not limited to the five 40 ft. x 60 ft. duplexes, the four 45 ft. x 50 ft. duplexes, the gravel parking area, and the 20 ft. x 530 ft. gravel parking road, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 808- 2808 for this determination. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Pertnittee x :.: f Ferdinando Ferrara and Edward Choe Permit # 203-06 Page 2 of 3 ADDITIONAL CONDITIONS Retaining Wall 2) The alignment of the authorized retaining wall shall be staked by the permittee or the permittce's authorized agent and approved by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days shall require the alignment to be restaked by the permittee or the permittee's authorized agent and re-approved by DCM within a maximum of 30 days prior to the new expected start of construction. 3) The alignment of the authorized retaining wall shall adhere to the alignment depicted on the attached workplan drawings. `1) 5) 6) 7) 8) The retaining wall shall be constructed prior to any backfilling activities. The retaining wall shall be structurally tight so as to prevent seepage of backfill materials through the structure. The retaining wall shall be solid and constructed of interlocking concrete stone blocks, treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. All backfill material shall be clean and free of any pollutants except in trace quantities. All backfill material shall be obtained from a high ground source and confined behind the permitted retaining wall. Sedimentation and Erosion Control 9) The N.C. Division of land Quality approved this project under Permit No. Panill-2005-010 on 12/12/05. Any violation of the permit approved by the DLQ shall be considered a violation of this LAMA permit. 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the retaining wall cap immediately following completion of backfilling activities. Stormwater Management 11) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW7051021 on 3/1.1/06. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. I Ferdinando Ferrara and Edward Choe Permit # 204-06 Page 3 of 3 ADDITIONAL CONDITIONS General 12) Unless specifically altered herein, this permit authorizes the removal of the existing dilapidated pier and the two existing head walls, all as expressly and specifically set forth in the attached permit application and workplan drawings. 13) All debris resulting from the removal of the existing pier and head walls shall be transported to an appropriate upland disposal area. 14) No open water areas shall be excavated or filled, even temporarily. 15) No vegetated wetlands shall be excavated or filled outside of the areas indicated on the attached workplan drawings. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the perinittee's property may require a modification of this permit. Contact a representative of the Division of Coastal Management at (252) 808-2808 prior to the commencement of any such activity for this determination. The permlttee is further advised that, in accordance with the rules of the Environmental Management Commission, many non-water dependent activities are not authorized within 50 feet of the normal water level or landward edge of any coastal wetlands, which ever is more restrictive. Division of Water Quality (DWQ) on October 4, 2006. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3490 covers these water impacts. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwatcr routing and treatment shall be on site at all times. 3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the 404/401 Permit Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; 4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project; 5. Protective Fencing - The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15 NCAC 2H, Section .0500; 6. Deed Notifications - Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. Construction Stormwater Permit NCG010000 Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an NPDES General stormwater permit (NCGO10000) administered by DWQ is automatically issued to the project. This General Permit allows stormwater to be discharged during land disturbing construction activities as stipulated by conditions in the permit. If your project is covered by this permit [applicable to construction projects that disturb one (1) or more acres], full compliance with permit conditions including the sedimentation control plan, self-monitoring, record keeping and reporting requirements are required. A copy of this permit and monitoring report forms may be found at http://h2o.enr.state.nc.us/su/Forms Documents.hon.; 8. Diffuse Flow (No Review) All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at non-erosive velocities through the protected stream buffers such that it will not re-concentrate before discharging into a stream as identified within 15A NCAC 213 .0233 (5). If this is not possible, it may be necessary to provide stormwater facilities that are considered to remove nitrogen. This may require additional approval from this Office. Certificate of Comnletion: 9. Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. NARRATIVE DESCRIPTION: Project Setting The site is located at the terminus and western side of SR1121 (Bennett Road) and is near the community of Min.nesott Beach, on the Neuse River, in Pamlico County. The project tract encompasses a total of 4.71 acres. An area of Section 404 Wetlands approximately 30' to 150' wide totaling 1.18 acres defines the northwestern boundary of the lot and is vegetated predominantly with large hardwoods such as tupelo and cypress trees. There is a 20'- 30' wide strip of unvegetated estuarine beach immediately landward of the NWL on the southwest side of the property, which borders the Neuse River. The land quickly rises along an escarpment approximately 20' in elevation along the length of the property behind the beach. The escarpment is covered with riprap, placed there by a previous owner for shoreline protection. The property continues to rise to a maximum of 26' above the NWL on the east side of the property creating two large rolling hills, which slope towards the Section 404 Wetlands. Two block headwalls stabilize the land next to the Section 404 Wetlands adjacent to Oxendine Gut and a dilapidated pier exists on the Neuse River waterfront. The upland area of the lot has been cleared and graded by the applicant and is void of vegetation. There is a single-family dwelling built on each of the properties adjacent to the project site. The Neuse River is classified SB; Sw and NSW by the EMC in the vicinity of the proposed construction. The Neuse River is not classified by the Division of Marine Fisheries as either a primary or secondary nursery and is closed to shell fishing. The Pamlico County Land Use Plan categorizes this area of the county as Town Centers, with all AEC's classified as Conservation. Stormwater Plan #SW7051021 was approved for development of this property on March 14, 2006 and a Sedimentation/Erosion Control Plan Pamli-2006-010 was issued on December 12, 2005. Project Proposal The applicant proposes to construct five 40' X 60' and four 45' x 50' duplexes for a total of 18 units or 3.8 units/acre. The duplexes along the waterfront would have a maximum height of 47.6' NAVD, while the non-waterfront units would rise to a maximum height of 60.7 NAVD. The four duplexes adjacent to the waterfront are to be two story units, while the non- waterfront duplexes are to be three story units. The duplexes are proposed to be setback a minimum of 75' from the normal water level. Parking for the duplexes would be provided in nine gravel parking areas with four parking spaces each for a total of 36 parking spaces. The applicant also proposes to build a gravel road 20' wide and 530' long(total) for access to the duplexes from Bennett Road (SR1121). Approximately 3.0 acres has been cleared and graded for the proposed construction activities, of which 0.23 acres is within the 75' Estuarine Shoreline AEC. The existing dilapidated pier and the two existing block headwalls are to be dismantled and removed from the property. Three retaining walls approximately 850' long total and made of interlocking concrete stone blocks are proposed to approximate the border of the Section 404 Wetlands on the west side of the property. The proposed alignment of the three retaining walls encompasses two areas of Section 404 Wetlands. Wetland impact area 1 is approximately 50' x 59' and is near the terminus of the north fork of the entrance drive. Wetland impact area 2 is approximately 17' x 3 Vand is near the terminus of the south fork of the parking area. A 320' long retaining wall is also proposed on the southeast side of the property and would be utilizing the same type of construction as the other proposed retaining walls. The site will be temporarily stabilized with silt fence and seeding measures to keep sediment out of the adjacent wetland areas while FIELD INVESTIGATION REPORT: FERRARA/CIIOE PAGE 03 permanent seeding takes root. Water would be supplied to the duplexes by a connection to the Pamlico County Public Water System. Nine septic tank systems have been approved for the project, which would include associated piping and drainfield areas. The wastewater systems for the proposed waterfront structures would be located on the southwest side of the entrance road, while the wastewater systems for the non-waterfront units would be located on the northeast side of the entrance road. Anticipated Impacts the project would disturb 128,221 sq. ft. of high ground, of which 10, 019.sq. ft. is within the 75' Estuarine Shoreline AEC. Approximately 45,302 sq. ft. of the project site would be made impervious for the residences, road, parking area, and other infrastructure. All proposed impervious surfaces are outside of the N.C. Division of Coastal Management 75' Estuarine Shoreline AEC. This equates to 0% new impervious surface within DCM's 75' Estuarine Shoreline AEC and a 22.1% impervious surface for the tract. The project would result in the filling of 3,479 square feet of Section 404 Wetlands for parking and lawn area. Sedimentation and stormwater control techniques have been planned for and permitted which should minimize any impact from the development of the site.
