Sullins, Director Division of Water Quality AQUIFER PROTECTION SECTION May 21, 2008 RE: Notice of Regulatory Requirements Galvan Industries 7320 Millbrook Rd., Harrisburg Cabarrus County, N.C. Based on information provided to this office by Mecklenburg County Land Use and Environmental Services Agency (LUESA) and the Surface Water Protection Section of the Mooresville Regional Office, the Division of Water Quality (DWQ) has reason to believe that your facility may be responsible for violations of the 15A NCAC 2B .0211 North Carolina Classifications and Water Quality Surface Standards Applicable to Surface Water and Wetlands. Specifically, on April 21, 2008 this office received the following sampling data: Sample Date Analyte Concentration 2B Std Location Agency 11/14/07 zinc 310 ug/l__ 50 ug/1 Back Creek at Caldwell Rd LUESA 413/08 zinc 6,700 ugh 50 u !I UT to Back Creek below outfall 1 DWQ/SWPS 413/08 zinc 180,000 u /l 50 u /l UT to Back Creek below outfall 2 DWQ/SWPS The above information suggests that the violations are associated with the zinc groundwater contamination plume that was identified on the Galvan site in 1992. In reviewing the file, it was noted that a groundwater remediation system was in operation under an interim corrective action plan (ICRP) until 2002. At that time, Galvan received permission to de -activate the system but continue groundwater monitoring. In 2004, the DWQ requested that Gaivan update the comprehensive site assessment (CSA) and amend the ICAP. This office received a report on February 12, 2006 that included an updated well survey but a work plan for the CSA was never received. A departmental reorganization in 2007 resulted in the transfer of the oversight of this incident to the Inactive Hazardous Sites Branch of the Division of Waste Management. It has been determined, however, that regulatory authority for this site should remain with the DWQ since the groundwater contamination occurred as a result of activities related to a DWQ permit (NC0005576). In order to meet the regulatory requirements, you must submit an updated site assessment report to the Aquifer Protection Section of the Mooresville Regional Office within 90 days of receipt of this Notice. This report must include an evaluation and discussion of the cited surface water impacts.
