I'd say they presented fair reasons to consider before enforcing for this deficiency (I lean towards not doing so). I did notice that at the first opportunity, their consultant MACTEC "did not have personnel available to mobilize to the site in time." I'd advise the company that if that is a repeating problem (not rain events between 10 PM and 5 AM), it may want to reconsider whom it contracts to do the sampling. I also usually make the recommendation to try and get a make-up sample if possible. Technically, they still violate the permit if they do not get the sample for the period. Whether DWQ pursues enforcement action is based on the reasons behind it. I hope that helps! MRO reserves the right to practice discretion as you all deem appropriate.
