Division of Water Quality (DWQ) on March 30, 2006, with additional information received by the DWQ on April 20, 2006. After reviewing your application, we have decided to authorize the impacts to the protected riparian buffers. This letter shall act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0259. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, and Non-discharge regulations. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). Impacts Approved The following impacts are hereby approved as long as all of the other specific and general conditions of this Authorization are met. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. 3. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 4. Protective Fencing - The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15 NCAC 2H, Section.0500. 5. Diffuse Flow (DWQ Reviewed Plans) All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0259(5) In an effort to comply with the diffuse flow provision of the Buffer Rule (15A NCAC 02B .025 9(5)), you have provided the DWQ with pre-formed scour hole/level spreader designs dated April 20, 2006. The DWQ believes that if implemented, as per these plans, diffuse flow will be achieved. However, if diffuse flow as per 15A NCAC 02B .0259(5) is not achieved, then the DWQ shall be notified and Greenville Commercial Site, Greenville, NC Page 3 of 3 April 21, 2006 corrective actions to restore diffuse flow shall be taken if necessary to impede the formation of erosion gullies. At no time shall stormwater from the proposed development be piped directly through the buffer without prior DWQ written authorization. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. Stormwater easements shall be recorded for a distance of at least 10 feet on each side of all stormwater conveyances containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners. Upon completion of the project, the Applicant shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in this Riparian Buffer Authorization has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. Please send photographs upstream and downstream of each culvert site to document correct installation along with the Certificate of Completion form. 7. Per the requirements of the Express Review Program, the applicant and/or authorized agent shall contact the DWQ Express Review Program in writing at the letterhead address within ten (10) days of the commencement of construction Violations of any condition herein set forth may result in revocation of this Buffer Authorization and may result in criminal and/or civil penalties. If you do not accept any of the conditions of this Authorization Certificate (associated with the approved buffer impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This authorization and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Riparian Area Protection Rules. This flow is only triggered above the I" storm event. Storms below the I" storm event flows into a pre formed scour hole / level spreader on the eastern side of the pond The discharge at outlet "A "flows at a rate of 9.3 ft/sec. during the 10 year storm event, then diffuses across a dissipater pad Outlet B: Outlet "B" is the discharge for the 1 " storm event. It flows into a pre formed scour hole and is then level spread into the buffer per DWQ level spreader design options memo dated October 10, 2001. It is designed for the 1 " storm event, it has a slow draw down of 2-5 days and flows out between 0.25 cfs - 0.76 cfs. Attached is an example picture and DWQ design standards to which it will be designed. Also enclosed is the original and two copies of the Operation and Maintenance Agreement for this Pre-Formed Scour Hole /Level Spreader. Outlet C. Outlet "C" is a dissipater pad that is a discharge for the center of the site. The outlet velocity is 6.4 ft/sec. during the 10 year storm and has an outflow of 3.6 cfs during the ]-year storm. Outlet "C" discharges into an existing ditch, that runs parallel to the property boundary, and eventually into the stream. A jurisdictional determination was conducted by Ms. Tracy Wheeler of the USACE and Mr. Kyle Barnes of NC DWQ that this feature is non jurisdictional, as evidenced in the initial application package. The flow will carry through the ditch for approximately 50' before it reaches the buffer in the bottom of the ditch. Outlet "C" will not produce any new disturbance to the riparian buffer due to the fact that it ties into the ditch which is an existing conveyance that runs through buffer, before it reaches the stream. Outlet D: Outlet "D" is the discharge for the eastern portion of the site and will tie into an existing storm drainage system, that has additional capacity. Maintenance activities shall be performed as follows: 1. After construction and until vegetation has been established, level spreaders(s) shall be inspected after every rainfall. Thereafter, level spreader(s) shall be inspected at least every month and more frequently during the fall season and after heavy rainfall events: a. Accumulated sediment, leaves, and trash shall be removed, and repairs made if required. b. Inspect level spreader(s) for evidence of scour, undercutting, settlement of the structure, and concentrated flows downhill from the level spreader(s). c. A level elevation shall be maintained across the entire flow-spreading structure at all times. Repair or replace the level spreader if it is damaged. d. Mow vegetative cover to a height of six (6) inches and prune plants if they cover over half of the level spreader surface. e. Repair eroded areas and replace/replant dead or damaged vegetation. 2. The contractor should avoid the placement of any material on and prevent construction traffic across the structure. If the measure is damaged by construction traffic, it shall be repaired immediately. 3. Inspect and repair the collection system (e.g., catch basins, pipes, swales, riprap) four (4) times a year to maintain proper functioning. The entire site was designed to minimize impacts to aquatic resources, while utilizing the remaining parcel. Please reference the meeting held with Ms. Cynthia Van Der Wiele-DWQ, Brandon Finch - JRM, and myself, on January 18, 2006. There are a total of 18,258 square feet (sf) (0.42 acre) of buffer impacts for the site, in which the uses are deemed allowable in the table of uses for the Tar-Pamlico River Basin. ROAD WAYIMPACTS (see inset sheet 1): There is 862 sf (0.02) acre of unavoidable impacts associated with the roadway entrance off of Greenville Blvd. Alternatives to the proposed layout have been investigated, but each one had significant design flaws which would prohibit their approval for construction by either the City of Greenville or NCDOT. NCDOT limited the access points for the property along Greenville Blvd to the point directly across from Mall Drive, due to safety concerns associated with multiple outlets. The eastern bound lane of Greenville Blvd was limited to this one ingress point directly across from the existing Mall Drive to the south, which will require a signal light. The other two outlets on the site will be for ingress and egress for the western bound lanes of Greenville Blvd, and safe circulation of traffic. Due to the proximity of the stream, there are proposed buffer impacts of 0.02 acre for the roadway, which is allowable in the table of uses, as discussed in our meeting January 18, 2006. GRADING (see inset sheets: 1-6): Grading is a majority of the buffer impacts for the site at 17,162 (0.39 acre). Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. STREAM BUFFER: (see attached attached Stream Buffer Impacts Map). The entire site was designed to minimize impacts to aquatic resources, while utilizing the remaining parcel. Please reference the meeting held with Ms. Cynthia Van Der Wiele- DWQ, Brandon Finch - JRM, and myself, on January 18, 2006. There are a total of 18,258 square feet (sfl (0.42 acre) of buffer impacts for the site, in which the uses are deemed allowable in the table of uses for the Tar-Pamlico River Basin. ROADWAY IMPACTS (see inset sheet 0: There is 862 sf (0.02) acre of unavoidable impacts associated with the roadway entrance off of Greenville Blvd. Alternatives to the proposed layout have been investigated, but each one had significant design flaws which would prohibit their approval for construction by either the City of Greenville or NCDOT. NCDOT limited the access points for the property along Greenville Blvd to the point directly across from Mall Drive, due to safety concerns associated with multiple outlets. The eastern bound lane of Greenville Blvd was limited to this one ingress point directly across from the existing Mall Drive to the south, which will require a signal light. The other two outlets on the site will be for in-gress and egress for the western Page 9 of 13 bound lanes of Greenville Blvd, and safe circulation of traffic. Due to the proximity of the stream, there are proposed buffer impacts of 0.02 acre for the roadway, which is allowable in the table of uses, as discussed in our meeting anuM 18, 2006. GRADING (see inset sheets: 1-6): Grading is a majority of the buffer impacts for the site at 17,162 (0.39 acre). A majority of these impacts are associated with temporary construction impacts for access and the temporary placement of silt fence site stabilization, as illustrated on sheets 2-6. Inset sheets 3-5 do have grading impacts associated with the formation of the berm for the stormwater management facility, which is an allowable use, as discussed in our meeting January 18, 2006. OVERFLOW DISCHARGE PIPE (see inset sheet 4): Since our January 18, 2006, meeting the overflow discharge pipe has been re-located to reduce impacts to Zone 1. The original location impacted approximately 300 sf of Zone 1, the current location only impacts 19 sf of Zone 1 and 2.34 sf of Zone 2 with pervious rip-rap material. This design was approved in our January 18, 2006 meeting, as an allowable use. This outlet will only be utilized during storm events and the 1-year storm will be level spread on the eastern side of the berm, well outside of the buffer. During times of discharge the stream elevation is expected to be close to the elevation of the overflow discharge, therefore diffusing the flow even further. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stn,ngide.html. 1. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. STREAM BUFFER: (see attached attached Stream Buffer Impacts Map). The entire site was designed to minimize impacts to aquatic resources, while utilizing the remaining parcel. Please reference the meeting held with Ms. Cynthia Van Der Wiele- DWO, Brandon Finch - JRM, and myself, on January 18, 2006. There are a total of 18,258 square feet (sf) (0.42 acre) of buffer impacts for the site, in which the uses are deemed allowable in the table of uses for the Tar-Pamlico River Basin. ROADWAY IMPACTS (see inset sheet 1): There is 862 sf (0.02) acre of unavoidable impacts associated with the roadway entrance off of Greenville Blvd. Alternatives to the proposed layout have been investigated, but each one had significant design flaws which would prohibit their approval for construction by either the City of Greenville or NCDOT. NCDOT limited the access points for the property along Greenville Blvd to the point directly across from Mall Drive, due to safety concerns associated with multiple outlets. The eastern bound lane of Greenville Blvd was limited to this one ingress point directly across from the existing Mall Drive to the south, which will require a signal light. The other two outlets on the site will be for ingress and egress for the western Page 9 of 13 bound lanes of Greenville Blvd, and safe circulation of traffic. Due to the proximity of the stream, there are proposed buffer impacts of 0.02 acre for the roadway, which is allowable in the table of uses, as discussed in our meeting anuM 18, 2006. GRADING (see inset sheets: 1-6): Grading is a majority o the buffer impacts for the site at 17,162 (0.39 acre). A majority of these impacts are associated with temporary construction impacts for access and the temporary _placement of silt fence site stabilization, as illustrated on sheets 2-6. Inset sheets 3-5 do have grading impacts associated with the formation of the berm for the stormwater management facility, which is an allowable use, as discussed in our meeting January 18, 2006. OVERFLOW DISCHARGE PIPE (see inset sheet 4): Since our January 18, 2006, meeting the overflow discharge pipe has been re-located to reduce impacts to Zone 1. The original location impacted approximately 300 sf of Zone 1, the current location only impacts 19 sf of Zone 1 and 234 sf of Zone 2 with pervious rip-rap material. This design was approved in our January 18, 2006 meeting, as an allowable use. This outlet will only be utilized during storm events, and the 1-year storm will be level spread on the eastern side of the berm, well outside of the buffer. During times of discharge the stream elevation is expected to be close to the elevation of the overflow discharge therefore diffusing the flow even further. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/stnngide.html. 1. Provide a brief description of the proposed mitigation plan.
