The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NC EEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NC EEP will be approved.
This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
Permit/401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send
copies of the 404/401/CAMA permits to NC EEP. Once NC EEP receives a copy of the 404 Permit and/or the 401
Certification an invoice will be issued and payment must be made.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the
following table.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation for the permitted impacts
up to a 2:1 ratio, (buffers, Zone 1 at a 3:1 ratio and Zone 2 at a 1.5:1 ratio). The type and amount of the compensatory
mitigation will be as specified in the Section 404 Permit and/or 401 Water Quality Certification, and/or CAMA Permit. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of
Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1998.

NORTH CAROLINA 401 WATER QUALITY CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-
500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ)
Regulations in 15 NCAC 2H, Section .0500 to Ms. Lynn Johnson and the Town of Murfreesboro, to fill
1.969 acres of wetland to construct the proposed a 15-acre storage lagoon on the northwest side of the
Meherrin River, on the east side of the North Carolina Highway 258, north of Murfeesboro, in Hertford
County, North Carolina, pursuant to an application filed on the December 28`x' day of December of 2005
(received by DWQ on January 11 2006), and in additional correspondence received September 25, 2006,
and October 25, 2006.
The application and supporting documentation provides adequate assurance that the proposed work will
not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the
State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application, the
supporting documentation, and conditions hereinafter set forth.
This approval is only valid for the purpose and design submitted in the application materials and as
described in the Public Notice. If the project is changed, prior to notification a new application for a new
Certification is required. If the property is sold, the new owner must be given a copy of the Certification
and approval letter and is thereby responsible for complying with all conditions of this Certification. Any
new owner must notify the Division and request the Certification be issued in their name. Should wetland
or stream fill be requested in the future, additional compensatory mitigation may be required as described
in 15A NCAC 2H.0506 (h) (6) and (7). If any plan revisions from the approved site plan result in a
change in stream or wetland impact or an increase in impervious surfaces, the DWQ shall be notified in
writing and a new application for 401 Certification may be required. For this approval to be valid,
compliance with the conditions listed below is required.
Conditions of Certification:
1. Impacts Approved
The following impacts are hereby approved as long as all of the other specific and general
conditions of this Certification (or Isolated Wetland Permit) are met. No other impacts are
approved including incidental impacts:

Sediment and Erosion Control:
2. Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most

recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
c. Sufficient materials required for stabilization and/or repair of erosion control measures and
stormwater routing and treatment shall be on site at all times.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the 404/401 Permit Application. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards,
statutes, or rules occur;
4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored within six months of the date that
the Division of Land Resources has released the project;
5. Protective Fencing - The outside buffer, wetland or water boundary and along the construction
corridor within these boundaries approved under this authorization shall be clearly marked with
orange warning fencing (or similar high visibility material) for the areas that have been approved to
infringe within the buffer, wetland or water prior to any land disturbing activities to ensure
compliance with 15A NCAC 213.0233 and GC 3404;
Continuing Compliance:
6. Ms. Lynn Johnson and the Town of Murfreesboro, shall conduct construction activities in a
manner consistent with State water quality standards (including any requirements resulting from
compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements
of State law and federal law. If the Division determines that such standards or laws are not being
met (including the failure to sustain a designated or achieved use) or that State or federal law is
being violated, or that further conditions are necessary to assure compliance, the Division may
reevaluate and modify this Certification to include conditions appropriate to assure compliance
with such standards and requirements in accordance with 15A NCAC 2H.0507(d). Before
modifying the Certification, the Division shall notify Ms. Lynn Johnson and/or the Town of
Murfreesboro, NC and the US Army Corps of Engineers, provide public notice in accordance
with 15A NCAC 2H.0503 and provide opportunity for public hearing in accordance with 15A
NCAC 2H.0504. Any new or revised conditions shall be provided to Ms. Lynn Johnson and/or
the Town of Murfreesboro, NC in writing, shall be provided to the United States Army Corps of
Engineers for reference in any Permit issued pursuant to Section 404 of the"Clean Water Act, and
shall also become conditions of the 404 Permit for the project;
Mitigation:
7. Compensatory Mitigation Using the Ecosystem Enhancement Program (EEP)
Mitigation must be provided for the proposed impacts as specified in the table below. We
understand that you wish to make a payment to the Wetlands Restoration Fund administered by
the NC Ecosystem Enhancement Program (EEP) to meet this mitigation requirement. This has
been determined by the DWQ to be a suitable method to meet the mitigation requirement. Until
the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement
Program Office), no impacts specified in this Authorization Certificate shall occur. The EEP

should be contacted at (919) 733-5205 if you have any questions concerning payment into a
restoration fund. You have one month from the date of this approval to make this payment. For
accounting purposes, this Authorization Certificate authorizes payment into the Wetlands
Restoration Fund to meet the following compensatory mitigation requirement:

Deed Notifications:
Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional
wetlands and waters or areas within 50 feet of all streams and ponds. These mechanisms shall be
put in place within 30 days of the date of issuance of the 401 Certification letter or the issuance of
the 404 Permit (whichever is later). A sample deed notification format can be downloaded from
the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands. DWQ shall be sent
copies of all deed restrictions applied to these lots;
9. Construction Stormwater Permit NCG010000
Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land
Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an
NPDES General stormwater permit (NCGO10000) administered by DWQ is automatically issued
to the project. This General Permit allows stormwater to be discharged during land disturbing
construction activities as stipulated by conditions in the permit. If your project is covered by this
permit [applicable to construction projects that disturb one (1) or more acres], full compliance
with permit conditions including the sedimentation control plan, self-monitoring, record keeping
and reporting requirements are required. A copy of this permit and monitoring report forms may
be found at ham://h2o.enr.state.nc.us/su/Forms_Documents.htni.;
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as
depicted in your application shall expire upon expiration of the 404 or CAMA Permit.

If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written
request within sixty (60) days following receipt of this Certification. This request must be in the form of a
written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. If
modifications are made to an original Certification, you have the right to an adjudicatory hearing on the
modifications upon written request within sixty (60) days following receipt of the Certification. Unless
such demands are made, this Certification shall be final and binding.

determined that your response to our previous request of March 9, 2006 was inadequate as
discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands on the subject property. Therefore, unless we receive
five copies of the additional information requested below, we will have to move toward denial of
your application as required by 15A NCAC 2H.0506 and will place this project on hold as
incomplete until we receive this additional information. Please provide the following
information so that we may continue to review your project.
Additional Information Requested:
1. Wetland Mitigation - Please note that your wetland mitigation plan must include a
minimum of a 1:1 restoration and/or creation component for 1.969 acres of impacts in
accordance with 15A NCAC 2H .0506(h)(6). If you decide to propose use of the North
Carolina Ecosystem Enhancement Program in lieu of developing your own wetland
mitigation plan, you will need to acquire written confirmation from the EEP that they will
accept the project. You should note that mitigation requirements proposed to be
mitigated through the EEP must be rounded to the nearest quarter acre increment

Dear Ms. Wheeler:
Following discussions with your office, the Town of Murfreesboro is proposing to utilize the
Corps' model restrictive covenants to place perpetual protection on an area encompassing 20.0 acres of
forested wetlands adjacent to the Meherrin River on the Wastewater Treatment Plant site. This area has
been shown on the latest survey plat submitted to you by our consultant, Environmental Professionals,
Inc. of Kill Devil Hills, NC. This area is offered for perpetual protection as mitigation for the filling of
1.969 acres of existing wetlands where a new wastewater storage lagoon is proposed.
The Town of Murfreesboro is requesting that the Corps utilize the previously submitted map
and the enclosed additional information for purposes of continuing its permitting review of the project.
We have enclosed a copy of the proposed deed that would be recorded to protect the 20-acre area in
perpetuity.
The Town of Murfreesboro considered alternatives for the location of the storage lagoon before
applying to use the area that includes the 1.969 acres of wetlands. The Town already owns the area
proposed for the location of the storage lagoon. The storage lagoon is proposed to be constructed in an
area approximately 1200 feet by 750 feet or about 21 acres. There is not another 21 acre area on the
lands owned by the Town that is not be utilized for other parts of the treatment facilities (irrigation
areas) or does not also impact wetlands. Purchasing another site for the lagoon would require between
30 and 70 acres of land due to the buffers from property lines and houses required by the NC Division
of Water Quality. At $2000 per acre, this cost would be $60,000 to $140,000 for the additional land
only. Construction of the storage lagoon on another site would require a pump station to pump the
wastewater to that site and a second pump station to pump it back to the existing irrigation pump
station or a second irrigation pump station. Piping to and from the second site would also be required.
At $50,000 each for the pump stations and $20 per foot for 10,000 feet of pipe (5000 feet each way),
the added cost for pumping and piping is $300,000. The total added cost for locating the lagoon on a
second site would be $360,000 to $440,000. This amount is saved by the proposed project.

Since April of 2003, the Town has been under a moratorium imposed by the NC Division of
Water Quality prohibiting any additional connections to the Town sewer system until the wastewater
treatment facilities are expanded to accommodate additional flow. The Town has put two previously
permitted subdivisions on hold and has others who want to connect new development to the system.
Any growth in the Town has been stopped until the sewer moratorium is lifted. We feel that the
approval of our plan to construct the storage lagoon is crucial to our wastewater treatment facilities
improvements. The Town has signed a Special Order by Consent (SOC) with the Division of Water
Quality allowing us time to make the improvements before additional fines are levied. A fine of $4000
was paid when the SOC was signed. It is imperative that we move forward with our project as soon as
possible.
We appreciate the Corps' willingness to consider this request. Please contact me if you wish to
discuss the project further or meet with you on site to verify the additional wetlands delineation.

The Wilmington District, Corps of Engineers (Corps) has received an application from
Town of Murfreesboro seeking Department of the Army authorization to impact 1.969
acres of jurisdictional wetlands adjacent to the Meherrin River associated with
improvements to the existing wastewater treatment plant in Murfreesboro, Hertford

Authority
The Corps will evaluate this application and a decide whether to issue, conditionally
issue, or deny the proposed work pursuant to applicable procedures pursuant to Section
404 of the Clean Water Act (33 U.S.C. 1344).
Location
The project area is a 1.74 acre portion of a 291 acre tract located on the northwest side of
the Meherrin River on the east side of North Carolina Highway 258 north of
Murfreesboro in Hertford County, North Carolina (36.451375 -77.077341)
Existing Site Conditions
The property is the site of the existing wastewater treatment plant for the Town of
Murfreesboro. It currently houses two treatment lagoons, spray fields and a small
mechanical building.
Applicant's Stated Purpose
The purpose of the project is to provide wastewater treatment capacity to meet
requirements and regulations of the North Carolina Division of Water Quality. The
existing facility is permitted as a nondischarge facility and existing storage lagoons and
irrigation fields are not adequate to process the Town's wastewater.
Project Description
The applicant proposes to place fill in 1.969 acres of U.S. Army Corps of Engineers
jurisdictional wetlands to construct an additional 15 acre storage lagoon.
Other Required Authorizations
This notice and all applicable application materials are being forwarded to the appropriate
State agencies for review. The Corps will generally not make a final permit decision
until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives
State certification required by Section 401 of the Clean Water Act (PL 92-500). The
receipt of the application and this public notice in the NCDWQ Central Office in Raleigh
serves as application to the NCDWQ for certification. A waiver will be deemed to occur
if the NCDWQ fails to act on this request for certification within sixty days of the date of
the receipt of this notice in the NCDWQ Central Office. Additional information
regarding the Clean Water Act certification may be reviewed at the NCDWQ Central
Office, 401 Oversight and Express Permits Unit (for NCDOT projects, the Transportation
Permitting Unit), 2321 Crabtree Boulevard, Raleigh, North Carolina 27604-2260. All
persons desiring to make comments regarding the application for certification under
Section 401 of the Clean Water Act should do so in writing delivered to the North
Carolina Division of Water Quality (NCDWQ), 1650 Mail Service Center, Raleigh,
North Carolina 27699-1650 Attention: Mr. John Hennessy (NC Department of
Transportation projects) or Ms Cyndi Karoly (all other projects) by February 23, 2006.
The applicant has not provided to the Corps, a certification statement that his/her
proposed activity complies with and will be conducted in a manner that is consistent with
the approved North Carolina Coastal Zone Management Program. Pursuant to 33 CFR
325.2(b)(2), the Corps can not issue a permit for the proposed work until the applicant
submits such a certification to the Corps and the North Carolina Division of Coastal
Management (NCDCM), and the NCDCM notifies the Corps that it concurs with the
applicant's consistency certification.
Essential Fish Habitat
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the
Magnuson-Stevens Fishery Conservation and Management Act. The Corps' initial
determination is that the proposed project will not adversely impact EFH or associated
fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils
or the National Marine Fisheries Service.
Cultural Resources
The Corps has consulted the latest published version of the National Register of Historic
Places and is not aware that any registered properties, or properties listed as being
eligible for inclusion therein are located within the project area or will be affected by the
proposed work. Presently, unknown archeological, scientific, prehistoric, or historical
data may be located within the project area and/or could be affected by the proposed
work.
Endangered Species
The Corps has reviewed the project area, examined all information provided by the
applicant and consulted the latest North Carolina Natural Heritage Database. Based on
available information, the Corps has determined pursuant to the Endangered Species Act
of 1973, that the proposed project will have no effect on federally listed endangered or
threatened species or their formally designated critical habitat.
Evaluation
The decision whether to issue a permit will be based on an evaluation of the probable
impacts, including cumulative impacts, of the proposed activity on the public interest.
That decision will reflect the national concern for both protection and utilization of
important resources. The benefit which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. All factors
which may be relevant to the proposal will be considered including the cumulative effects
thereof; among those are conservation, economics, aesthetics, general environmental
concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain
values (in accordance with Executive Order 11988), land use, navigation, shoreline
erosion and accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of property
ownership, and, in general, the needs and welfare of the people. For activities involving
the discharge of dredged or fill materials in waters of the United States, the evaluation of
the impact of the activity on the public interest will include application of the
Environmental Protection Agency's 404(b)(1) guidelines.
Commenting Information
The Corps of Engineers is soliciting comments from the public; Federal, State and local
agencies and officials, including any consolidate State Viewpoint or written position of
the Governor; Indian Tribes and other interested parties in order to consider and evaluate
the impacts of this proposed activity. Any comments received will be considered by the
Corps of Engineers to determine whether to issue, modify, condition or deny a permit for
this proposal. To make this decision, comments are used to assess impacts on endangered
species, historic properties, water quality, general environmental effects and the other
public interest factors listed above. Comments are used in the preparation of an
Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS)
pursuant to the National Environmental Policy Act (NEPA). Comments are also used to
determine the need for a public hearing and to determine the overall public interest of the
proposed activity.
Any person may request, in writing, within the comment period specified in this notice,
that a public hearing be held to consider the application. Requests for public hearings
shall state, with particularity, the reasons for holding a public hearing. Requests for a
public hearing shall be granted, unless the District Engineer determines that the issues
raised are insubstantial or there is otherwise no valid interest to be served by a hearing.
Written comments pertinent to the proposed work, as outlined above, will be received
by the Corps of Engineers, Wilmington District, until 5pm, February 23, 2006.

SUPPLEMENT TO PERMIT APPLICATION
BLOCK 18. Nature of Activity
The activity proposed by the Town of Murfreesboro is to expand their wastewater
treatment facilities. The improvements include a 15 acre storage lagoon and some 56
acres of additional irrigation fields. The storage lagoon will be constructed adjacent to the
existing treatment lagoons, which were constructed in 1962. Construction of the new
storage lagoon will require the discharge of fill material into 85,767 square feet (1.969
acres) of jurisdictional channels and wetlands. The new irrigation areas will be
constructed with no impacts to wetlands.
BLOCKI9. Project Purpose
The purpose of the project is to provide additional wastewater treatment capacity-
for the Town in order to meet the requirements and regulations of the N.C. Division of
Water Quality. The Town's existing wastewater treatment facility is permitted by the
Division of Water Quality as a non-discharge facility. The existing irrigation fields no
longer have the capacity to process the wastewater load from the Town, and the Town
has been fined and ordered to upgrade their facilities to accommodate the increased
flows.
BLOCK 20. Reason(s) for discharge
The purpose of the fill material to be placed in wetlands is for the construction of
the new wastewater storage lagoon. The lagoon is being located as it is in order to
minimize the cost of construction and to allow it to operate with the existing facilities
efficiently. One side of the new lagoon will be a common dike with the second treatment
lagoon, saving the cost of some 500 linear feet of lagoon dike. The new lagoon will be
deeper than the existing lagoons, requiring a pump station to pump the stored wastewater
back into the existing second lagoon prior to irrigation through the existing irrigation
pump station. Without the new pump station, the bottom elevation would have had to be
raised to elevation 12.0 to match the existing lagoons. This would have required 5 more
feet of fill over the entire 13 acre bottom area of new lagoon. Constructed this way, the
new lagoon would have been much larger and required even more wetland fill area.
Relocation of the lagoon would have been more costly. A common dike would
not have been available on any other side, so more fill would have been required. It
would have had to be located away from the existing lagoons, so pumping and piping
costs would have been higher as well. All costs associated with the project will be borne
by the users of the Murfreesboro sewer system through user charges.

BLOCK 22. Surface Area in Acres of Wetlands or Other Waters Filled
Impact Area 1- Wetland "D" -1.467 acres - This area is all of wetland "D" as
shown on the attached maps. This area is entirely within the perimeter of the new
proposed storage lagoon and is surrounded by upland areas. It is hydrologically
connected to wetland "B" (Impact Area 3) by an existing dug channel (Impact Area 2).
The organic soil within the wetland will be excavated and stockpiled on an upland area of
the site and dried for use in the final layer of fill for the lagoon dikes. Silt fence will be
used to contain the material within the stockpile area. Fill material from upland areas will
be hauled to the excavated area and pushed into the excavation with bulldozers and/or
motor graders. Material will be added to raise the entire area to elevation 7.0, the bottom
elevation of the proposed storage lagoon.
Impact Area 2 - Channel "D-E" - 0.028 acres (top of bank to top of bank - This
channel is 111 linear feet and is entirely within the perimeter of the new proposed storage
lagoon. It is entirely surrounded by upland areas. It is the hydrologic connection between
wetlands "D" and "E". The organic soil within the channel will be excavated and
stockpiled on an upland area of the site and dried for use in the final layer of fill for the
lagoon dikes. Silt fence will be used to contain the material within the stockpile area. Fill
material from upland areas will be hauled to the excavated area and pushed into the
excavation with bulldozers and/or motor graders. Material will be added to raise the
entire area to elevation 7.0, the bottom elevation of the proposed storage lagoon.
Impact Area 3 - Wetland "B" - 0.474 acres - This area is the western portion of
wetland "E" as shown on the attached maps. This area is partly within the perimeter of
the new proposed storage lagoon, partly under the dike and the remainder is outside the
dike perimeter. The filled area outside the dike is necessary for the construction of an
access driveway to the south side of the lagoon and to insure a stable base for the lagoon
dike. It is hydrologically connected to wetland "F" along the Meherrin River by an
existing dug channel to the east. The organic soil within the wetland will be excavated
and stockpiled on an upland area of the site and dried for use in the final layer of fill for
the lagoon dikes. Silt fence will be used to contain the material within the stockpile area.
Fill material from upland areas will be hauled to the excavated area and pushed into the
excavation with bulldozers and/or motor graders. Material will be added to raise the
entire area to elevation 7.0, the bottom elevation of the proposed storage lagoon. In the
area where the new dike will be constructed, additional fill material will be added to
construct the dike up to elevation 20.0.

SUPPLEMENT TO PERMIT APPLICATION
BLOCK 18. Nature of Activity
The activity proposed by the Town of Murfreesboro is to expand their wastewater
treatment facilities. The improvements include a 15 acre storage lagoon and some 56
acres of additional irrigation fields. The storage lagoon will be constructed adjacent to the
existing treatment lagoons, which were constructed in 1962. Construction of the new
storage lagoon will require the discharge of fill material into 85,767 square feet (1.969
acres) of jurisdictional channels and wetlands. The new irrigation areas will be
constructed with no impacts to wetlands.
BLOCKI9. Project Purpose
The purpose of the project is to provide additional wastewater treatment capacity
for the Town in order to meet the requirements and regulations of the N.C. Division of
Water Quality. The Town's existing wastewater treatment facility is permitted by the
Division of Water Quality as a non-discharge facility. The existing irrigation fields no
longer have the capacity to process the wastewater load from the Town, and the Town
has been fined and ordered to upgrade their facilities to accommodate the increased
flows.
BLOCK 20. Reason(s) for discharge
The purpose of the fill material to be placed in wetlands is for the construction of
the new wastewater storage lagoon. The lagoon is being located as it is in order to
minimize the cost of construction and to allow it to operate with the existing facilities
efficiently. One side of the new lagoon will be a common dike with the second treatment
lagoon, saving the cost of some 500 linear feet of lagoon dike. The new lagoon will be
deeper than the existing lagoons, requiring a pump station to pump the stored wastewater
back into the existing second lagoon prior to irrigation through the existing irrigation
pump station. Without the new pump station, the bottom elevation would have had to be
raised to elevation 12.0 to match the existing lagoons. This would have required 5 more
feet of fill over the entire 13 acre bottom area of new lagoon. Constructed this way, the
new lagoon would have been much larger and required even more wetland fill area.
Relocation of the lagoon would have been more costly. A common dike would
not have been available on any other side, so more fill would have been required. It
would have had to be located away from the existing lagoons, so pumping and piping
costs would have been higher as well. All costs associated with the project will be borne
by the users of the Murfreesboro sewer system through user charges.
BLOCK 22. Surface Area in Acres of Wetlands or Other Waters Filled
Impact Area 1 - Wetland "D" -1.467 acres - This area is all of wetland "D" as
shown on the attached maps. This area is entirely within the perimeter of the new
proposed storage lagoon and is surrounded by upland areas. It is hydrologically
connected to wetland "E" (Impact Area 3) by an existing dug channel (Impact Area 2).
The organic soil within the wetland will be excavated and stockpiled on an upland area of
the site and dried for use in the final layer of fill for the lagoon dikes. Silt fence will be
used to contain the material within the stockpile area. Fill material from upland areas will
be hauled to the excavated area and pushed into the excavation with bulldozers and/or
motor graders. Material will be added to raise the entire area to elevation 7.0, the bottom
elevation of the proposed storage lagoon.
Impact Area 2 - Channel "D-E" - 0.028 acres (top of bank to top of bank - This
channel is 111 linear feet and is entirely within the perimeter of the new proposed storage
lagoon. It is entirely surrounded by upland areas. It is the hydrologic connection between
wetlands "D" and "E". The organic soil within the channel will be excavated and
stockpiled on an upland area of the site and dried for use in the final layer of fill for the
lagoon dikes. Silt fence will b6 used to contain the material within the stockpile area. Fill
material from upland areas will be hauled to the excavated area and pushed into the
excavation with bulldozers and/or motor graders. Material will be added to raise the
entire area to elevation 7.0, the bottom elevation of the proposed storage lagoon.
Impact Area 3 - Wetland "E" - 0.474 acres - This area is the western portion of
wetland "E" as shown on the attached maps. This area is partly within the perimeter of
the new proposed storage lagoon, partly under the dike and the remainder is outside the
dike perimeter. The filled area outside the dike is necessary for the construction of an
access driveway to the south side of the lagoon and to insure a stable base for the lagoon
dike. It is hydrologically connected to wetland "F" along the Meherrin River by an
existing dug channel to the east. The organic soil within the wetland will be excavated
and stockpiled on an upland area of the site and dried for use in the final layer of fill for
the lagoon dikes. Silt fence will be used to contain the material within the stockpile area.
Fill material from upland areas will be hauled to the excavated area and pushed into the
excavation with bulldozers and/or motor graders. Material will be added to raise the
entire area to elevation 7.0, the bottom elevation of the proposed storage lagoon. In the
area where the new dike will be constructed, additional fill material will be added to
construct the dike up to elevation 20.0.

SUPPLEMENT TO PERMIT APPLICATION
BLOCK 18. Nature of Activity
The activity proposed by the Town of Murfreesboro is to expand their wastewater
treatment facilities. The improvements include a 15 acre storage lagoon and some 56
acres of additional irrigation fields. The storage lagoon will be constructed adjacent to the
existing treatment lagoons, which were constructed in 1962. Construction of the new
storage lagoon will require the discharge of fill material into 85,767 square feet (1.969
acres) of jurisdictional channels and wetlands. The new irrigation areas will be
constructed with no impacts to wetlands.
BLOCKI9. Project Purpose
The purpose of the project is to provide additional wastewater treatment capacity
for the Town in order to meet the requirements and regulations of the N.C. Division of
Water Quality. The Town's existing wastewater treatment facility is permitted by the
Division of Water Quality as a non-discharge facility. The existing irrigation fields no
longer have the capacity to process the wastewater load from the Town, and the Town
has been fined and ordered to upgrade their facilities to accommodate the increased
flows.
BLOCK 20. Reason(s) for discharge
The purpose of the fill material to be placed in wetlands is for the construction of
the new wastewater storage lagoon. The lagoon is being located as it is in order to
minimize the cost of construction and to allow it to operate with the existing facilities
efficiently. One side of the new lagoon will be a common dike with the second treatment
lagoon, saving the cost of some 500 linear feet of lagoon dike. The new lagoon will be
deeper than the existing lagoons, requiring a pump station to pump the stored wastewater
back into the existing second lagoon prior to irrigation through the existing irrigation
pump station. Without the new pump station, the bottom elevation would have had to be
raised to elevation 12.0 to match the existing lagoons. This would have required 5 more
feet of fill over the entire 13 acre bottom area of new lagoon. Constructed this way, the
new lagoon would have been much larger and required even more wetland fill area.
Relocation of the lagoon would have been more costly. A common dike would
not have been available on any other side, so more fill would have been required. It
would have had to be located away from the existing lagoons, so pumping and piping
costs would have been higher as well. All costs associated with the project will be borne
by the users of the Murfreesboro sewer system through user charges.

BLOCK 22. Surface Area in Acres of Wetlands or Other Waters Filled
Impact Area 1 - Wetland "D" -1.467 acres - This area is all of wetland "D" as
shown on the attached maps. This area is entirely within the perimeter of the new
proposed storage lagoon and is surrounded by upland areas. It is hydrologically
connected to wetland "E" (Impact Area 3) by an existing dug channel (Impact Area 2).
The organic soil within the wetland will be excavated and stockpiled on an upland area of
the site and dried for use in the final layer of fill for the lagoon dikes. Silt fence will be
used to contain the material within the stockpile area. Fill material from upland areas will
be hauled to the excavated area and pushed into the excavation with bulldozers and/or
motor graders. Material will be added to raise the entire area to elevation 7.0, the bottom
elevation of the proposed storage lagoon. _
Impact Area 2 - Channel "D-E" - 0.028 acres (top of bank to top of bank - This
channel is 111 linear feet and is entirely within the perimeter of the new proposed storage
lagoon. It is entirely surrounded by upland areas. It is the hydrologic connection between
wetlands "D" and "E". The organic soil within the channel will be excavated and
stockpiled on an upland area of the site and dried for use in the final layer of fill for the
lagoon dikes. Silt fence will be used to contain the material within the stockpile area. Fill
material from upland areas will be hauled to the excavated area and pushed into the
excavation with bulldozers and/or motor graders. Material will be added to raise the
entire area to elevation 7.0, the bottom elevation of the proposed storage lagoon.
Impact Area 3 - Wetland "E" - 0.474 acres - This area is the western portion of
wetland "E" as shown on the attached maps. This area is partly within the perimeter of
the new proposed storage lagoon, partly under the dike and the remainder is outside the
dike perimeter. The filled area outside the dike is necessary for the construction of an
access driveway to the south side of the lagoon and to insure a stable base for the lagoon
dike. It is hydrologically connected to wetland "F" along the Meherrin River by an
existing dug channel to the east. The organic soil within the wetland will be excavated
and stockpiled on an upland area of the site and dried for use in the final layer of fill for
the lagoon dikes. Silt fence will be used to contain the material within the stockpile area.
Fill material from upland areas will be hauled to the excavated area and pushed into the
excavation with bulldozers and/or motor graders. Material will be added to raise the
entire area to elevation 7.0, the bottom elevation of the proposed storage lagoon. In the
area where the new dike will be constructed, additional fill material will be added to
construct the dike up to elevation 20.0.

Item 1. Mitigation - A copy of a letter to Tracey L. Wheeler of the Corps of Engineers is
enclosed, outlining our mitigation plan.
Item 2. Groundwater - The new storage pond is designed with a 60 mil thick HDPE plastic
liner. This liner is approved by the Division of Water Quality for lining wastewater treatment
and storage lagoons. We will also be replacing the existing clay liners in the two existing
lagoons with 60 mil HDPE liners to solve leakage problems in those lagoons.
If additional information is needed prior to your issuance of 401 Certification, please let me
know.

THIS DECLARATION OF DEDICATION AND STATEMENT OF SPECIAL
COVENANTS, LIMITATIONS AND RESTRICTIONS, made and entered into this the 2151 day of
September, 2006, by the TOWN OF MURFREESBORO, a North Carolina municipal corporation:
WITNESSETH:
WHEREAS, the Town of Murfreesboro, hereafter referred to as "Town" desires to expand
its wastewater treatment facilities; and
WHEREAS, the Town of Murfreesboro desires to mitigate the filling of two (2) acres of
wetlands by executing and recording this document with restrictive covenants whereby twenty (20)
acres of wetlands shall be maintained in perpetuity in their natural condition;
NOW, THEREFORE, in consideration of the premises the Town hereby dedicates,
encumbers and declares, and by these presents does hereby dedicate, encumber and declare the
following property to be fully subject to the following special covenants, limitations and restrictions.

1. Property. The declaration to which these special covenants, limitations, and
restrictions apply is that property described as follows:
That certain tract or parcel of land lying and being in Maney's Neck
Township, Hertford County, North Carolina, located near the southern
edge of U.S. Highway 258 (the road from Murfreesboro, North
Carolina, to Como, North Carolina) and being bound by other lands of
the Town of Murfreesboro. Containing acres according to a
survey plat recorded in PC Slide Hertford County
Registry.
And being further described as a portion of the lands conveyed to the
Town of Murfreesboro by deed recorded in Book , Page ,
Hertford County Registry. Reference to the aforesaid plat and deed is
hereby made for further describing said premises.
2. Restrictive Covenants. The Town declares the following:
The areas shown on the plat recorded in PC Slide ,
Hertford County Registry, as conservation areas shall be maintained in
perpetuity in their natural or mitigated condition. No person or entity
shall perform any of the following activities on such conservation area:
a. Fill, grade, excavate or perform any other land disturbing
activities.
b. Cut, mow, burn, remove or harm any vegetation.
C. Construct or place any roads, trails, walkways, buildings,
mobile homes, signs, utility poles or towers, or any other
permanent or temporary structures
d. Drain or otherwise disrupt or alter the hydrology or drainage
ways of the conservation area
e. Dump or store soil, trash, or other waste
f. Graze or water animals, or use for any agricultural or
horticultural purpose
These covenants are intended to ensure continued compliance with the
mitigation condition of a Clean Water Act authorization issued by the
United States of America, U.S. Army Corps of Engineers, Wilmington
District, Action ID , and therefore may be enforced by the
United States of America. This covenant is to run with the land, and
shall be binding on the Town, and all parties claiming under it.

3. Survivability. The Town acknowledges that the foregoing special covenants,
limitations and restrictions are appurtenant to and run with the land hereinabove described and are
binding upon the Town and the Town's successors and assigns.
