Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The project limits consist of 1,265 linear feet of roadway and rights-of-way along Sugar Creek Road. The project area is composed of high-density urban development including transportation, commercial, and industrial land-uses. The area of potential effect (APE) is a single stream crossing on Little Sugar Creek. Little Sugar Creek is a named perennial stream. An existing 124 linear foot dual 12' x 8' elliptical corrugated metal arch pipe (CMAP) conveys stream flow at the road crossing. The existing CMAP is estimated by the project engineers to be more than 40-years in age. Mapped FEMA floodway and 100-year floodplain exist within the APE. 3b. Explain the purpose of the proposed project: The Sugar Creek Road Improvement Project proposes to provide improved pedestrian and bicycle connectivity along Sugar Creek Road in support of the LYNX Blue Line Sugar Creek Station and the NCDOT Bridge Project. Describe the overall project in detail, including the type of equipment to be used: The Sugar Creek Road Improvement Project will result in unavoidable impacts to waters of the U.S. Impacts to Little Sugar Creek will occur because of removing the existing corrugated metal pipe and replacing it with a reinforced concrete box culvert (Attachment C— Sheet 5 of 9). Temporary stream impacts will result during flow diversion, so work can be completed in the dry. Additional temporary stream impacts will occur during the pipe removal process. Permanent stream impacts will result with installation of the new reinforced concrete box culvert. Additional permanent stream impacts will result from channel improvements to be completed at the inlet and outlet ends of the new box culvert. Permanent impacts will result in a loss of waters only with the new box culvert additional length. No loss of waters for the in-kind pipe replacement, as well as, the stream channel improvements. This proposed pipe replacement is necessary to support widening of Sugar Creek Road and to improve storm water flow and reduce the risk of flooding during storm events within the North Davidson neighborhood of Charlotte. Replacement of the existing corrugated metal arch pipe will also support public safety, as the existing pipe is over 40-years in age. To replace the existing corrugated metal pipes, currently supporting the Sugar Creek Road crossing over Little Sugar Creek, a pump around system, or a similar flow diversion technique, will be utilized to ensure work is performed in the dry. A total of 20-linear feet of temporary stream impacts will result from the flow diversion measures (S1). Once stream flow is diverted around the area of work, the existing corrugated metal arch pipes will be removed, resulting in 124-linear feet of temporary stream impacts (S2). Once the pipes are removed from the stream channel, excavation within the channel will be completed in preparation for the installation of the new 138-linear foot double 13' x 9', concrete box culvert. Excavation of the channel will ensure the new box culvert is installed below stream bed elevation (counter- sinking), and excavated materials will be set aside and used to line the low flow culvert barrel. Riprap may be used to supplement the native material to line the high flow barrel. If riprap is used to line the high flow culvert barrel, native material will be placed on top to fill voids. Concrete sills on the interior of the box culvert will be used to key in material used to line the culvert barrels. Pipe replacement will result in a 14-linear foot loss of jurisdictional waters (S3). Construction of two floodplain benches will be completed on the inlet and outlet ends of the high flow barrel to match the top sill elevation within the high flow barrel, 2' above the bottom of culvert, and create a stream channel improvement. The floodplain benches will act to stabilize the channel and deflect normal flows to the low-flow barrel and the natural stream channel (Attachment D— Culvert Design plan sheet). The floodplain benches will be constructed within the culvert headwall footprint. Class 1 riprap will be used to stabilize the 2:1 slope above the bench tied to the stream channel banks. Riprap will also be used to stabilize the inner berm along the toe of the bench. Filter fabric will be used in the stabilization. The placement of riprap is necessary to prevent erosional forces from undermining the stream banks and culvert inlet and outlet, as well as maintain the integrity of the road crossing. Additionally, riprap currently keyed-in to the bank has deteriorated resulting in incision of the streambed and bank erosion (Attachment H, Photographs 5 and 6). Coir fiber matting will be used to stabilize the top of the bench. Permanent stream impacts will occur because of the stream channel improvements, but no permanent loss of waters will occur. Stream impacts S4 and S5 account for these permanent stream impacts, 60-linear feet and 50-linear feet, respectively. Once the culvert replacement and in-channel stream improvements are complete, temporary fills will be removed from the channel and the work area will be stabilized. Temporary erosion control seed mix, coir matting, and/or straw will be used in site stabilization. Typical construction equipment such as track hoe, dump truck, and skid steer will be used in completing the pipe replacement. Page 4 of 12 PCN Form — Version 1.4 January 2009 4. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. To avoid and minimize impacts to the jurisdictional waters of the U.S., the Sugar Creek Road Improvement Project site was delineated prior to developing the site plan and the proposed site plan was designed around the delineation results. Sugar Creek Road has an existing crossing on Little Sugar Creek. The culvert replacement will occur at the existing crossing as a matter of necessity. The existing pipe is more than 40-years in age and is likely to begin failing. The existing pipe does not meet or exceed flood capacities, and it was likely sized based on watershed conditions 40-years prior. By replacing the existing pipe within the pipe footprint, this will limit impacts to Waters of the U.S. The replacement box culvert has been modeled for flood capacities by the engineer to properly size it and accommodate future anticipated changes in the watershed. The box culvert is in mapped FEMA floodway. The engineer has acquired a no-rise certificate demonstrating that the new culvert will not alter downstream flooding characteristics or flood elevations. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Proper sediment and erosion control measures will be used to minimize disturbances to downstream waters. Construction activities and impacts to on-site jurisdictional waters of the U.S. will comply with all conditions of Nationwide Permit No 14 and Water Quality Certificate No. 4135. The proposed stream impacts will be completed during low flows, or pump around or similar water diversion techniques will be utilized to construct in dry. All temporary structures will be removed from the channel after the work is complete. Disturbed stream banks will be restored to pre-construction grade and elevation, and any disturbed stream banks will be stabilized with seeding and matting. The proposed culvert will be buried a minimum of one foot below the channel bed to allow passage of aquatic life and maintain low flows. Headwalls at the inlet and outlet of the culvert will be utilized to minimize channel impacts to the maximum extent practicable. Stream channel improvements will ensure low to normal flows are maintained in the natural channel, and that flow is maintained through the box culvert. Sills in the high flow barrel of the culvert will ensure low and normal flows will be maintained in the natural stream channel and low flow barrel. Natural stream bed material excavated during new box culvert installation will be used to line the inside of the culverts to help preserve aquatic life passage and maintain natural bedload. 2. There are no records of federally protected species within the project limits. The results of the NCNHP review are attached (Attachment E).
