Approval of 401 Water Quality Certification and Authorization Certificate per the Catawba River Buffer
Protection Rules (15A NCAC 2B .0243) with Additional Conditions
Dear Mr. O'Connor:
You have our approval, in accordance with the attached conditions and those listed below, to place fill in
or to otherwise impact approximately 0.02 acre of waters and 0.02 acre of riparian buffer for the purpose of
stabilizing approximately 275 linear feet of shoreline on Lake Norman, as described in your application
received on January 3, 2006. After reviewing your application, we have determined that this project is covered
by Water Quality General Certification Number 3492, which can be viewed on our web site at
http://h2o.enr.state.nc.us/ncwetlands. The General Certification allows you to use Regional Permit No.
198200030 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). This letter also serves
as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B
.0243. Please note that you should get any other federal, state or local permits before proceeding with your
project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and
Water Supply Watershed regulations.
The above noted Certification will expire when the associated USACOE's 404 permit expires unless
otherwise specified in the General Certification. This approval is only valid for the purpose and design that you
described in your application. If you change your project, you must notify this office in writing, and you may be
required to submit a new application for a new certification. If the property is sold, the new owner must be
given a copy of the Certification and approval letter; and is thereby responsible for complying with all
conditions. This approval, however, should not be construed as authorization to impact any part of the 50-foot
riparian buffer that currently exists on the main stem of the Catawba River under the Catawba River Buffer
Protection Rule (15A NCAC 2B .0243). If the total wetland fill for this project (now or in the future) exceeds
one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h).
In addition to the requirements of the certification, you must also comply with the following condition:
1. No impacts shall occur in the buffer, including the removal of trees, except along the immediate shoreline.
2. Upon completion of the project, the applicant/responsible party shall complete and return the enclosed
"Certificate of Completion" form to the Division of Water Quality's 401/Wetlahds Unit.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition (that
conforms to Chapter 150B of the North Carolina General Statutes) to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless

The applicant is requesting <a letter of concurrence from the North Carolina Wildlife Resources
Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers and/or a
401 Certification from the NC Division of Water Quality. The NCWRC has reviewed
information provided by the applicant, and field biologists on our staff are familiar with habitat
values of the project area. These comments are provided in 'accordance with provisions of the
Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48
Stat. 401, as amended; 16 U.S.C. 661-667d).
The applicant proposes to install 275' of river rock stabilization on the shore of Lake Norman.;
Due to time constraints-we-did not visit the site.--However, based on the information provided by
the applicants and our knowledge of the general project area, we will not object to the project
provided that the following conditions are followed to the extent practicable:
1. The stabilization projects should be done with minimum class I (class II
preferred) riprap or rock. This size rock improves aquatic habitat structure. We
do not Mort the use of river rock as mining river rock causes impacts to aquatic
environments and destabilizes riparian ecosystems. Additionally, river rock does
not tend to 'remain in place or enhance aquatic habitat (void spaces) as does larger
sized quarry stone. Fabric matting may be used beneath the stone to reduce
erosion and turbidity. To the extent practicable, rock or stone should be placed

just above the high water mark and towards the lake five (5) to six (6) feet or
further to provide continuous aquatic edge habitat as lake levels rise and fall.
2, Stabilization activities should be done from the water (by boat or barge) instead of
the shore to minimize buffer impacts. Stabilization materials should be pressed
into the existing buffer edge to shore, up existing vegetation along the shoreline.
Existing wooded buffers should be preserved. Any Large Woody Debris (LWD)
should be maintained to the maximum extent practicable to provide aquatic
habitat. If relocated, the LWD must be securely anchored so that it will remain
where installed.
3. Stringent erosion control measures should be installed where soil is disturbed and
maintained until project completion. Temporary or permanent herbaceous
vegetation should be planted on all bare soil within ten (10) days of ground
disturbing activities to provide long-term erosion control.
4. Where possible; rock- -should be-- placed .at the edge- of the eroding bank in a
manner to "shore up" existing buffer and edge vegetation. Disturbed banks may
be revegetated with silky dogwood (Corpus amonum), silky willow (Salix
sericea), tag alder (Alnus serrulata), black willow (Salix nigra), and sycamore
(Flatanus occidentalis) or other native plants to provide long term bank stability

should be randomly planted and done on four (4) foot centers from the waters
edge to the top of the bank. Trees should be planted on ten (10) to twelve (12)
foot centers. Disturbed banks in these areas should also be seeded with an
approved native wetland seed mix or temporary crop of wheat or rye.
5. As appropriate, naturally vegetated Catawba buffers should be protected and
preserved permanently. Wide undisturbed shoreline buffers and natural
vegetation should be maintained to the extent practicable.
6. The applicant should contact local planning authorities to determine if local
permits are needed for the project or for any buffer infringements or impacts.

reviewer" as the triage process in Central had previously provided. Also, if you think of ways to
improve this process, especially so that we can plan for the electronic applications, let me know.
