This letter is to make you aware that the home's wastewater system is a discharging system, which, after treatment, discharges its wastewater to waters of the state known as South Fork Muddy Creek, which is currently classified as class C waters in the Yadkin-Pee Dee River Basin. This is extremely important for you to know because in the state of North Carolina, a permit issued by the state's Division of Water Resources (DWR or the Division), is required for any discharge to waters of the state. This is a lawful requirement that can be reviewed in NC General Statute (NCGS) 143-215.1, Control of Sources of Water Pollution; Permits Required. This permit, which we have attached a copy of, contains all your legal obligations, as homeowner and permittee, for system operation and maintenance, testing, and documentation. Please be aware that failure to comply with all requirements of the NCG550000 general permit subjects the homeowner(s) to civil penalties of not more than $25,000 per day, per violation, as outlined in NCGS 143-215.6A, Enforcement Procedures; Civil Penalties, which can also be reviewed at the website listed above. Ron Boone, of the Winston-Salem Regional Office (WSRO) of the NC DWR, attempted to contact you at the home on September 19, 2018, to conduct an inspection of the system, but, apparently you were not there at the time.
