NW Hickory, NC 28601 Subject: Incident #: 200502416, Catawba Riparian Buffer APPROVAL of 401 Water Quality Certification and Authorization Certificate per the Catawba River Buffer Protection Rules (15ANCAC 2B .0243) with Additional Conditions Dear Mr. Young: You have our approval, in accordance with the attached conditions and those listed below, to impact approximately 0.17 acre of riparian buffer for the purpose of stabilizing/restoring the buffer along approximately 490 linear feet of shoreline on Lake Hickory, as described in your application' received on January 8 2006. After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3402, which can be viewed. on our web site at http://h2o.enr.state.nc.us/ncwetiands. The General Certification allows you to use Nationwide Permit No. 43 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). This letter also serves as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B.0243. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge; and Water Supply Watershed regulations. The above noted Certification will expire when the associated USACOE's 404 permit expires unless otherwise specified in the General Certification, This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application fora new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. This approval, however, should not be construed as authorization to impact any part of the 50-foot riparian buffer that currently exists on the main stem of the Catawba River under the Catawba River Buffer Protection Rule (15A NCAC 26.0243). If the total wetland fill for this project (now or in the future) exceeds. one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). In addition to the requirements of the certification, you must also comply with the following conditions:` 1. Twenty, two (2) inch caliper trees, 8' in height, shall be randomly planted throughout Zone 1. 2. Six (6) inches of mulch shall be placed in-Zone 1 of the buffer to help reestablish the soil and stabilize the slope. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The project will allow stormwater to run into a ditch and provide a fifteen (15) foot flat area beside the seawall on a 2:1 slope on the steep part of the property: The project appears to be the of installation of seawall, grading and backfilling, and sloping of a private lot on Lake Hickory. 11 We are concerned about possible effects to water quality and aquatic edge habitats.associated with the ditch and the seawall. The provision of sheet flow through an undisturbed forested 'shoreline buffer with deep rooted trees is preferred over yard extension and ditching; however, we will not object to the project if it is in compliance with the Division of Water Quality's Catawba River buffer requirement, US Army Corps of Engineers permit requirements, and Duke Power Company's. Lake Shoreline Management requirements. ` The following general recommendations are provided for your consideration: 1. Fill in the lake should not occur primarily to extend private property. If lot fill is needed to protect lake integrity and water quality, such activities must be approved by regulatory authorities, including authorities under the Federal Energy Regulatory Commission's purview. Minimum` class I (class II preferred) course riprap or rock (not river rock) should be used at the waterside base of the seawall as this size rock improves aquatic habitat. Fabric matting may be used beneath the stone to reduce erosion and turbidity. Rock or stone should be placed just above the high water mark and towards the lake five (5) to six (6) feet when possible to provide continuous aquatic edge habitat. Large boulders should be placed every 30-feet along the property to replace lost aquatic habitats associated with the lot fill. Boulders must be located so as not to create any safety hazards. 3. Any Large Woody Debris (LWD) should be maintained to the maximum extent practicable to provide aquatic habitat. If relocated, the LW17 must be securely anchored so that it will remain where installed. LWD must be located so as not to create any safety hazards. 4. Any buffer violations should be resolved in a manner that restores shoreline habitats-and protects aquatic habitats. 5. Sheet flow through vegetated/forested buffers should be provided to the maximum extent practicable. 6. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. Temporary or permanent herbaceous vegetation should be planted on all bare soil within ten (10) days of ground disturbing activities to provide long-term erosion control. 7. Wide undisturbed shoreline buffers and natural vegetation should be maintained or restored to the extent practicable. To the extent practicable, disturbed buffers should be restored and revegetated with silky dogwood (Cornus amonum), silky willow (Salrx sericea), tag alder (Alnus serrulata), black willow (Salix nigra), and sycamore (Platanus occidentalis) or other autochthonous plants to provide long term bank stability. Note that silky dogwood, silky willow and black willow can, be planted as live stakes collected during the dormant growing season. Cuttings should be randomly planted on four (4) foot centers from the waters edge to the top of the bank. Trees should be planted on ten (10) to twelve (12) foot centers.. . Banks in these areas should also be temporarily seeded with an approved wetland/riparian seed mix or temporary crop of annual wheat or rye. 8. The applicant should contact local planning authorities to determine if local approvals and permits are needed for the project and for any buffer infringements. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography; building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. This project is undertaken to reduce impact to the lake. As a minimum it will -reduce the sediment into the lake. VIII. Mitigation DWQ In accordance with 15A NCAC 2H .0500, mitigation may be required, by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams- Page 9 of 9 USAGE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining' wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same.watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at hLtp://h2o.enr.state.ne.us/nc,%,etiands/stnngide.html. 1.
