PROJECT DESCRIPTION: The applicant's proposed project is located at 105 Trumpet St., adjacent to Becky's Creek and the AIWW, near Surf City, Pender County. The project is located within Surf City's extraterritorial zoning jurisdiction (ETJ). To get to the project site from the intersection of US Hwy 50 and Little Kinston Rd., go south on Little Kinston Rd. and take the first right onto Driftwood Dr. On Driftwood Dr. you go west and take the first left onto Cockle St. On Cockle St. you then go south and take the next left onto Trumpet St. 105 Trumpet St. is the center house located in the Cul-de-sac at the streets end. The project site is owned by Mr. & Mrs. Dan Braswell. Becky's Creek is a tributary to the AIWW and is located adjacent to the project site area. The size of the entire track of land is 2 acres with an approximate elevation of 5 ft. above Mean High Water (MHW). Vegetation associated with the high ground portion consists primarily of lawn grasses. The marsh area measured from high ground to Becky's Creek is approximately 125 ft. in width and is vegetated with Salt Meadow Hay (Spartina patens), Black Needlerush (Juncus roemerianus), Smooth Cordgrass (Spartina alterniflora). An existing 127 ft. long by 4 ft. wide pier extends from the high ground area on the applicants lot, out across the marsh area and 2 ft. into Becky's Creek where it connects to the existing platform, slip/floating dock structure and slip/john boat ramp. The total length of the existing structure is 151 ft. From the waters edge at the project site area, it is approximately 600 ft. to the marsh area located on the far side of Becky's Creek, which is vegetated with Black Needlerush (Juncus roemerianus) and Smooth Cordgrass (Spartina alterniflora). The property has approximately 162 ft. of shoreline. The waters of Becky's Creek and AIWW adjacent to the project site are classified "SA" by the North Carolina Division of Water Quality. Becky's Creek is closed to the Harvest of Shellfish and is designated as a Primary Nursery Area by the NC Division of Marine Fisheries. The AIWW area adjacent to the project site is closed to the Harvest of Shellfish and is not designated as a Primary Nursery Area by the NC Division of Marine Fisheries. 10. PROPOSED PROJECT: The applicant proposes to add a third boat slip/boat lift to their existing pier structure. The existing pier structure contains a 127 ft. long by 4 ft. wide pier, a platform with step-down, a slip/floating dock structure and a slip/john boat ramp. The proposed 10.5 ft x 20 ft. third boat slip/lift would be located on the north west corner of the structure and would extend an additional 8 ft. out into Becky's Creek. The total length of this pier would then measure approximately 159 ft. measured from the high ground area on the applicants lot the end of the structure in Becky's Creek. The portion of the pier that would extend from the marsh area into Becky's Creek is 34 ft. Water depths under the proposed boat slip/lift range from 1.5 ft. below MLW at a point nearest to the shoreline, to a depth of 2 ft. below MLW at a point furthest from the shoreline. This pier would serve a single-family residential lot. The area located both east and west of the proposed project consists of single-family residential properties, some of which also have private piers. 11. ANTICIPATED IMPACTS: The proposed slip/boat lift would incorporate approximately 210 sq. ft. of estuarine waters and public trust area. The project could increase turbidity levels during construction, however, no long-term adverse impacts are anticipated. This project meets the 1/ width rule, and riparian setback requirements. The permittee is not relieved of this requirement if he abandons the permitted. activity without having it transferred to a third party. 4) This permit does not authorize the interference with any existing or proposed Federal project, and the`' permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury' that may be caused from existing or future operations undertaken by the United States in the public r interest. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. . Coast Guard, through regulation or otherwise, on the 'authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather: 6) This permit authorizes a maximum of 3 boat slips, which includes the -2 slips previously authorized. At no time shall more than 3 vessels be moored or docked at the facility without permit modification. The restriction on the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. General 7) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H;0208 of the rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging of any manner, including "kicking" with boat propellers is not. authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure 8)_ No vegetated wetlands or open water- areas. shall be. excavated of filled- 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall, be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required.
