This approval allows you to: 1. Maintenance dredge an 1100 linear feet X 40 feet wide to a depth of -4.0 Mean Low Water (MLW) (44,000 sq ft) (1.01 ac) area adjacent to Big Davis Channel off the AIWW. 2. All dredged material will be placed on the Corps of Engineers (Disposal Area # 284). This approval is only valid for the purpose and design that you described in your CAMA Major application dated December 16, 2005 and received by the N.C. Division of Water Quality (DWQ) on December 16, 2005. After.reviewing your application, we have determined that General Water Quality Certification Number 3400 covers this activity. This Certification can also be found on line at: http://h2o.enr.state.nc.us/ncwetlands/certs.html. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations, NPDES and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. Please be aware that if you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. Excavation 1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal. Management, in consultation with the Division of Marine Fisheries. 2) Excavation shall not exceed -4 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) No excavation shall take place outside the area indicated on the attached workplan drawing labeled 2 of 6 dated revised 8/2/05 (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee West Dolphin Drive HOA ADDITIONAL CONDITIONS Spoil Disposal Permit # 20-06 Page 2 of 3 4) All excavated materials shall be confined above the normal high water line and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 5) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or beyond, he normal low water level to prevent gully erosion and unnecessary siltation: 6) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended sediments. 7) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance with water quality standards: 8) The diked disposal area shall be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters. 9) The pipeline route and terminal end of the pipeline shall be positioned as referenced on the attached workplan drawings labeled 6 of 6 and dated revised 9/20/05. 10) Prior to the commencement of any dredging, the permittee shall stake the alignment of the permitted channel and contact a representative of the Division of Coastal Management to schedule an inspection of the area of excavation and the disposal area. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan may be required for this project. If required, this plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. General 11) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 13) No vegetated wetlands shall be excavated or filled, even temporarily. PROJECT SUMMARY: The applicant proposes to perform maintenance dredging of the West Dolphin Drive Channel located within Big Davis Creek. The proposed dredging would increase the channel depth from an average of 0.5' at Normal Low Water (NLW) to 4.0' at NLW. West Dolphin Drive Channel Page 2 9. SITE DESCRIPTION The West Dolphin Drive Channel is located at the west end of The Town of Oak Island, along the southern shoreline of Big Davis Creek where it runs between 54th Street West and 57th Street West, Brunswick County. From west to east, the West Dolphin Drive Channel area starts in the deep channel area of Big Davis Creek, runs along the east side ofthe Blue Point Marina to the West Dolphin Drive and 57`h St. residential area, turns and runs east running parallel to West Dolphin Drive and then turns north after crossing the 54th St. area where it runs back out into and ends in the deep channel area of Big Davis Creek. Thirteen property owners are involved with the project and each one has a 50 ft. to 75 ft. wide lot bordering the West Dolphin Drive Channel/Big Davis Creek area. Each lot has a residence on it and each lot also has a fixed pier which reaches out to the West Dolphin Drive Channel. The topography of the high ground property located south of, and adjacent to, the West Dolphin Drive Channel/Big Davis Creek area is relatively flat with an approximate elevation of 4.5 feet above Mean High Water (MHW). Numerous types of vegetation such as Live Oaks, Magnolias, Maples and Pines surround the project area as well as landscape shrubs and lawn grasses. There is a section of coastal wetlands, primarily Smooth Cordgrass (Spartina altemiflora), located on the waterward side of the existing bulkheads, which parallel the southern bank of the West Dolphin Drive Channel/Big Davis Creek area. There are some properties along the eastern end of the West Dolphin Drive Channel that are not bulk-headed and contain multiple wetlands species such as: Spike Grass (Distichlis spicata), Black Needle Rush (Juncus roemarianus), Sea Lavender (Limonium, spp.), Glasswort (Salicomia spp.), and Salt Meadow Grass (Spartina patens). The width ofthe West Dolphin Drive Channel/Big Davis Creek area measures approximately 1200 ft. The proposed disposal area, (Corps of Engineers Disposal Area 284), is located on the north side of Big Davis Creek, approximately 2,500 ft. east of the West Dolphin Drive Channel area. This disposal area is approximately 25 acres in size. Big Davis Creek is located on the south side of the proposed disposal area and the AIWW is located on the north side of the proposed disposal area. Coastal Wetlands exist on the north side of Big Davis Creek between the proposed dredge site area and the proposed disposal area which contain multiple wetland species such as: Smooth Cordgrass (Spartina altemiflora), Spike Grass (Distichlis spicata), Black Needle Rush (Juncus roemarianus), Sea Lavender (Limonium, spp.), Glasswort (Salicomia spp.), and Salt Meadow Grass (S artina patens) An inspection of the Corps of Engineers Disposal Area 284 reviled that dredge material already existing on the west end of the site is higher than both the north and south retaining walls with the largest area of unused volume available in the center and the east side of the disposal area. The existing outfall structure is also located at the north east side of the disposal area so that water overflow would empty into the AIWW. In the project area, the waters of West Dolphin Drive Channel/Big Davis Creek, and the AIWW area are classified as SA by the NC Division of Water Quality, and they are Closed to the harvest of shellfish. These waters are designated as Permanent Secondary Nursery Area, by the NC Division of Marine Fisheries. PROJECT DESCRIPTION The applicant proposes to perform maintenance dredging of the West Dolphin Drive Channel. The area proposed to be dredged measures 40 ft. wide by 1100 ft. long.. Existing, pre-construction water depth measurements indicate a variation of water depths which range from 0.0' to -4.0' relative to Mean Low Water (MLW) with an average water depth of-0.5 ft. at MLW. The proposed dredging would increase the average depth from -0.5 ft. at MLW to a depth of -4.0 ft. at MLW. Spoil resulting from the hydraulic dredging project would be pumped through an 8 inch PVC pipe a distance of approximately 2,500 feet onto the Corps of Engineers AIWW Disposal Area No. 284. The pipe leaving the dredging area would be weighted and submerged running northward under the Big Davis Creek to shallow waters along the Coastal Wetlands located on the north side of Big Davis Creek. The pipe would then be extended eastward along the waters edge for approximately 1,800 ft. to a point opposite the dike wall of Corps of Engineers Disposal Area No. 284. The pipe would then be turned north crossing approximately 300 ft. of Coastal Wetlands before entering the upland disposal area. No pipe joints would be located within the Coastal Wetlands area. In order to minimize possible damage to the different wetland species within this Coastal Wetlands area, the pipe that would be used to cross these Coastal Wetlands will be sealed at both ends to allow it to float and would then be pulled by rope across the wetlands at West Dolphin Drive Channel Page Three high tide. The end of the discharge pipe would then be located in the center of the north and south dike walls, and east of the large deposit of existing dredge materials located on the west end of the disposal area. The end of the discharge pipe would be located in this area so that all dredge materials will be contained within the existing unused volume available in the center of the disposal site. Excessive water would also then be allowed to flow to the existing outfall structure. The amount of material removed would total approximately 6,500 cubic yards of silt and fine sand. CAMA Major Permit No. 250-84 was originally issued to Mr. I. M. Bigggs on November 21, 1984 for maintenance dredging of an existing channel off of West Dolphin Drive. The permit authorized the removal of material from a 560'x 60' section of the channel, to a depth of -4' below MLW. In addition to the CAMA permit, Mr. Biggs received a dredging permit from the U.S. Corp of Engineers which date back to the 1970's. Information provided within the Corps and CAMA permits indicate that the entire stretch of the West Dolphin Drive Channel has historically been dredged and maintained for navigational purposes. 10. ANTICIPATED IMPACTS The proposed dredging of the West Dolphin Drive channel would result in the excavation of approximately 44;000 sq. ft. of previously dredged shallow bottom area. Spoil resulting from the hydraulic dredging project would be pumped through an 8 inch PVC pipe a distance of approximately 2,500 feet onto the Corps of Engineers AIW W Disposal area No. 284 which is approximately 25 acres in size. The amount of material removed would total approximately 6,500 cubic yards of silt and fine sand. The amount of high ground disturbance will total approximately 900,000 sq. ft. It is anticipated that short term turbidity impacts will arise from the maintenance dredging activity.
