You have our approval, in accordance with the enclosed conditions (WQC # 3400) to conduct the following activity located at the subject property located on the west side of Morehead City (Atlantic Beach Causeway in Bogue Sound), in Atlantic Beach, Carteret County. This approval allows you to: 1. Maintenance dredge 1538 linear feet by 81 feet (2.86 acres) of the AIWW (open water) access channel to a depth of -6 MLW. 2. Place the spoil material in an approved upland disposal area in accordance with the revised Sedimentation and Erosion Control Plan. This approval is only valid for the purpose and design that you described.in your CAMA Major application dated December 15, 2005 and received by the N.C. Division of Water Quality (DWQ) on December 21, 2005 with additional information received on January 27, 2006. After reviewing your application, we have determined that General Water Quality Certification Number 3400 covers this activity. This Certification can also be found on line at: http://h2o.enr.state.nc.us/ncwetlands/certs.html. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations, NPDES and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. Please be aware that if you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new application for a new certification. This approval is for the purpose and design that you described in your application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). WiRO WQC #3400 CAMA PERMIT CERTIFICATION GENERAL CERTIFICATION FOR PROJECTS ELIGIBLE FOR CORPS OF ENGINEERS GENERAL PERMIT NUMBER 198000291 (ISSUED TO THE NORTH CAROLINA DIVISION OF COASTAL MANAGEMENT AND RIPARIAN AREA PROTECTION RULES (BUFFER RULES) This General Certification is issued in conformity with requirement of Section 401, Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality Regulations in 15 NCAC 2H, Section .0500 and 15 NCAC 26 .0200 for the discharge of fill material as described in General Permit 198000291 and for the Riparian Area Protection Rules (Buffer Rules) in 15A NCAC 2B .0200. This Certification replaces Water Quality Certification Number 3025 issued on September 6, 1995, Water Quality Certification Number 3112 issued on February 11, 1997, Water Quality Certification Number 3274 issued June 1, 2000 and Water Quality Certification Number 3371 issued March 18, 2002. This WQC is rescinded when the Corps of Engineers re-authorizes Regional General Permit 0291 or when deemed appropriate by the Director of DWQ. The State of North Carolina certifies that the specified category of activity will not violate applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with conditions hereinafter set forth. Conditions of Certification: 1. Activities authorized by CAMA major permits require written concurrence from the Division of Water Quality as well as compliance with all conditions of this General Certification; 2. Activities authorized by Coastal Area Management Act (CAMA) Minor or General Permits do not require written authorization from the Division of Water Quality as long as they comply with all other conditions of this General Certification; 3. In accordance with North Carolina General Statute Section 143-215.3D(e), any request for written concurrence for a 401 Water Quality Certification must include the appropriate fee. If a project also requires a CAMA Permit, one payment to both agencies shall be submitted and will be the higher of the two fees. The fee shall be collected and distributed between the two agencies in accordance with agreements reached between the Division of Water Quality and the Division of Coastal Management; 4. In accordance with 15A NCAC 2H .0506 (h) compensatory mitigation may be required for impacts to 150 linear feet or more of streams and/or one acre or more of wetlands. In addition, buffer mitigation may be required for any project with Buffer Rules in effect at the time of application for buffer impacts resulting from activities classified as "allowable with mitigation" within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer Rules. A determination of buffer, wetland and stream mitigation requirements shall be made for any Certification for this Nationwide Permit. The most current design and monitoring protocols from DWQ shall be followed and written plans submitted for DWQ approval as required in those protocols. When compensatory mitigation is required for a project, the mitigation plans must be approved by DWQ in writing before the impacts approved by the Certification occur. The mitigation plan must be implemented and/or constructed before any permanent building or structure on site is occupied. In the case of public road projects, the mitigation plan must be implemented before the road is opened to the travelling public; WQC #3400 5. Compensatory stream mitigation shall be required at a 1:1 ratio for not only perennial but also intermittent stream impacts that require application to DWQ in watersheds classified as ORW, HQW, Tr, WS-1 and WS-II unless the project is a linear, publicly- funded transportation project, which has a 150-foot per-stream impact allowance; Impacts to any stream length in the Neuse and Tar-Pamlico River Basins (or any other major river basins with Riparian Area Protection Rules [Buffer Rules] in effect at the time of application) requires written concurrence from DWQ in accordance with 15A NCAC 28.0200. New development activities located in the protected 50-foot vride riparian areas (whether jurisdictional wetlands or not) within the Neuse and Tar- Pamlico River Basins shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B.0200. All new development shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices. Activities listed as "exempt' from these rules do not need to apply for written concurrence under this Certification; 7. All sediment and erosion control measures placed in wetlands or waters shall be removed and the original grade restored after the Division of Land Resources has released the project; 8. If an environmental document is required, this Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse; 9. That appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" whichever is more appropriate (available from the Division of Land Resources (DLR) in the DENR Regional or Central Offices) shall be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to -assure compliance with the appropriate turbidity water quality standard; 10. Measures shall be taken to prevent live or fresh concrete from coming into contact . with freshwaters of the state until the concrete has hardened; 11. Additional site-specific conditions may be added to projects which have applied for CAMA major permits which are proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 12. When written concurrence is required, the applicant is required to use the most recent version of the Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 13. Concurrence from DWQ that this Certification applies to an individual project shall expire three years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding General Permit 198000291, whichever is sooner. Non-compliance with or violation of the conditions herein set forth by a specific fill project shall result in revocation of this Certification for the project and may result in criminal and/or civil penalties. WQC #3400 The Director of the North Carolina Division of Water Quality may require submission of a formal application for individual certification for any project in this category of activity that requires written concurrence under this certification, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland or downstream waters are precluded. Public hearings may be held for specific applications or group of applications prior to a Certification decision if deemed in the public's best interest by the Director of the North Carolina Division of Water Quality. PROJECT SUMMARY: The Town of Atlantic Beach Proposes to dredge 1538 linear feet of the AIWW access channel on the west side of the Morehead City-Atlantic Beach Causeway. NARRATIVE DESCRIPTION: Project Setting The Town of Atlantic Beach located on Bogue Banks, in Carteret County, has historically maintained recreational boating channels for the purpose of promoting tourism and boating related economic activity in the Town. Numerous permits have been issued over the years to excavate and maintain the many channels and canals within the Town limits. The last permit issued for the maintenance dredging of the AIWW access channel was CAMA Major Permit # 39- 99 issued in April of 1999. The dredging method proposed for this project is to excavate the material with a barge-mounted excavator and place the material in a floating barge. This material would be transferred from the barge to trucks at one of two off- loading sites. The sites for transferring the material are the Moonlight Bay boat ramp on Moonlight Dr., or the old bridge abutment west of the southern end of the existing causeway bridge. The disposal site would be chosen by the contractor, and then approved by the Division of Coastal Management before dredging could begin. Bogue Sound in the project area is classified as SA waters by the Division of Water Quality and is open to shellfishing. There does not appear to be a shellfish resource in the area and no SAVs were noted in the field visit. The Division of Marine Fisheries does not classify the area as a PNA. The Atlantic Beach LUP classifies all AECs as Conservation. Project Description i The Town proposes to dredge by barge-mounted excavator 1,538 linear feet of the AIWW access channel west of the Morehead City-Atlantic Beach Causeway. Approximately 15,300cy of material would be removed. The average top width of the channel would be 81', with an average bottom width of 60' at a depth of -6' at mean low water. The AIWW access channel was surveyed in September 2005. A copy of the survey is on sheets 2 and 3. Dredging will correspond to the naturally occurring channel depths. The size of the disposal area is not known at this time, however if the area is not large enough to accommodate all the spoils, the spoils would have to be dried and trucked offsite before new spoils could be deposited. Dredging would have to stop until either a new site was located or trucking material away from the existing site made room The material is comprised of mainly fine and medium sand with very little mud content (less than 1 %). Due to the method of dredging, necessary spoil dimensions have been calculated based on one cubic yard of depth to be confined onsite by traditional sedimentation and erosion control measures. 10. ANTICIPATED IMPACTS: Approximately 124,578sf of Public Trust and estuarine bottom would be dredged, and approximately 15,300cy of material would be removed from the estuarine system as a result of the dredging project.. Since there appears that there are limited shellfish resources in the area, any impact to such would be negligible. The most significant affect of the project should be positive and should benefit the boating community as a result of the improved navigational waterways. A permit is requested that will permit dredging of the channel immediately and also periodic maintenance dredging for 5 years or over the life of the permit. Dredging is currently required to alleviate shoaling in the AIWW access channel which runs nearly parallel to and due west of the Morehead City, Atlantic Beach Causeway Bridge. Dredging is required over approximately 1538 feet of channel with an average top width of 81 feet, an average bottom width of 60 feet, and at a depth of 6 feet MLW. The dredged material will be removed by barge mounted excavator or dragline and placed in a floating barge then transferred from the barge to truck by excavator or backhoe. At one of the proposed offloading sites (See Sheet 1) trucks will move the material to a site chosen by dredge contractor and approved by DCM. The applicant has conducted maintenance dredging of the access channel and other channels west of the causeway bridge under previously issued CAMA permits. PROJECT DESCRIPTION The project consists of the following elements: • Removal by dragline or barge mounted excavator dredging of approximately 15,300 cubic yards of material from the AIWW access channel. • Off load dredged material at Moonlight Bay boat ramp and/or old bridge abutment west of the southern end of the existing causeway bridge. • Disposal at DCM approved upland disposal site chosen by the dredging contractor. 4 Maintenance Dredging, AIWW Access Channel Rev. The results of that survey are provided on sheets 2 and 3. Generally, the material to be dredged is fine and medium sand with negligible mud content (less than 1 percent). The channel is maintained naturally at a depth of between 2 and 3.5 feet, but the channel location meanders unpredictably requiring frequent location of channel markers for safe passage. i The dredging will take advantage of the naturally occurring channel depths. Dredging to a maximum depth of 6 feet (MLW) will cause the channel location to stabilize for an extended period making the channel safer for boaters. The proposal disposal site will be an upland area chosen by the dredging contractor and approved by DCM. The town proposes to store the sand at the approved upland site and use the material for miscellaneous uses under the direction of the Public Works Department. STORMWATER MANAGEMENT No upland improvements, pavements, walkways or other impervious surfaces will be constructed as part of the project. No stormwater management or additional stormwater measures will be required for this project. DREDGE MATERIAL CHARACTERISTICS Seven surficial samples were collected from the channel area to be dredged. The samples were analyzed using methods employed to test compatibility of sand for beach disposal including analysis for mud content and percent shell. Grain size information of size distribution plots for each of the seven samples collected are available upon request. Generally the dredge material is fine to medium sand with less than 1 percent mud. Shell (calcium carbonate) content ranges from 2 to 15 percent. The analysis indicates that, because mud content is low, turbidity associated with the dredging will be limited and short lived. Material in the overwash will settle quickly in the I water column and should not create a turbidity plume extending beyond the immediate area of the excavation activity. The material will be moved by barge to a landside location, Moonlight Bay boat ramp and/or bridge abutment, offloaded to dump trucks and hauled to an upland disposal site chosen by contractor and approved by DCM. If the contractor's site exceeds one acre, he will be required to obtain or have in place an erosion and sediment control plan and permit approved by the Division of Land Resources, Land Quality Section. PROJECT SCHEDULE Dredging of the access channel will be initiated as soon as the CAMA permit is issued. COMPLIANCE WITH COUNTY OF CARTERET ZONING AND CAMA LAND USE PLAN There are no Land Use issues associated with this project. Signature of Permittee Town of Atlantic Beach ADDITIONAL CONDITIONS Spoil Disposal Permit #8-06 Page 2 of 3 5) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal iManagement prior to the commencement of any dredging activities. 6) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 7) No spoil material shall be placed within 30 feet of the normal high water line. 8) This permit does not authorize the placement of any excavated materials upon any ocean beach. Any future request to place this excavated material on any beach shall require a modification of this permit, as well as sand compatibility tests to ensure the material is suitable for beach placement. Maintenance Clause 9) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any future maintenance activities authorized by this permit. This notification shall include: A. The number of the original permit B. A statement that no dimensional changes are proposed C. A copy of the original permit plan(s) with cross-hatching indicating the area to be maintained and the area to be used for dredge spoil, and the estimated amount of material to be removed. D. The date of plan revision and the permittee's signature shown anew on the original plan. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan may be required for this project. If required, this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 10) Appropriate sedimentation and erosion control devices, measures -or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Sianature of Permittee Town of Atlantic Beach ADDITIONAL CONDITIONS Permit # 8-06 Page 2 of 2 4) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended sediments. 5) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance with water quality standards. 6) The diked disposal area shall be constructed a sufficient distance from the mean high water level or any marsh to elimmate'the possibility of dike erosion into surrounding wetlands or waters k . 7) The dike area shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. 8) This minor modification shall be attached to the original of Permit No. 8-06, which was issued on 1/9/06, and copies of both documents shall be readily available on site when Division personnel inspect the project for compliance. 9) All conditions and stipulations of the active permit remain in force under this renewal.
