The submitted project is being returned because it lacks the necessary elements to process the 401 Application. DWQ has determined that the following information is needed to accept your application for review: 1). The application should be a CAMA Major application. The project application is proposing "development" with the 575' of Outstanding Resource Water (ORW) limits of the Division of Coastal Management (DCM). It is my understanding in talking with Robb Mairs, the DCM field ,,rep for New Hanover County, that the application has already been submitted by SEGI. Incorporate the following requested information into your CAMA application for a complete application 2). The road crossing between lots 3 & 4 and 33 & 34 is a stream channel. The application does not show the width of the existing crossing and the proposed crossing. The impacts for the proposed crossing have not been included in the application. These should include the side slopes necessary to stabilize the road fill. 3). On the proposed impl cts shown as "A", "B", "C" and "D", the cross sections (Plan & Profile) do not indicate piping within the roadside ditches. Are these ditches to be filled?% 4). There are small tributaries within the site these need to be shown on the plats and identified as such. f I 5). The small remaining wetland located on Lot # 27 needs to have some sort of hydrology connection; otherwisq we may have to consider it as impacted. Please show in the profile drawing how the road fill will be stabilized. 9). The existing roadside ditches are not shown on the plan some of these are wetlands, how are they going to be4 impacted? Are they all to be filled? 10). The EEP mitigation is for non-riparian wetlands, with the unnamed tributaries to the ICWW (ORW) would the impacts be considered riparian? You should contact Jennifer Frye for that information. w 11). Please provide a draft copy of the preservation language, restrictive covenants, deed restrictions, deed notifications or preservation language (if required by the Corps) for the remaining wetlands on the property. Please incorporate the requested material into the CAMA major application. This will provide DWQ a complete applicationpackage so that DWQ can adequately review the permit application. A new application fee for a 401 permit will also be required, but for this particular permit it will be included with you CAMA application fee. Ev art, PhD Southern Coas tal Coordinator Habitat Conservation Program Date: January 23, 2006 RE: Colorado Coastal Development, LLC - River Lure, New Hanover Co. 401/404 Application DWQ # 20052196, USACE Action ID # 200401134 I Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject application for impacts'to wildlife and fishery resources. A site visit was conducted on January 23, 2006. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.), and Sections 401 and 404 of the Clean Water Act (as'', amended). j The project is located Off Myrtle Grove Sound Rd., between. Shannon Dr. and Windy Hills Dr., adjacent to Masonboro (a.k.a. Myrtle Grove) Sound. The property consists of approximately 10 acres of high ground and approximately 5 acres of delineated wetlands. An un-named tributary to Masonboro Sound is contained, within the property, but is not designated as a permanent stream on the impact map. Waters in this area are classified SA-Outstanding Resource Waters by the Division of Water Quality (NCDWQ and are designated as a Primary Nursery Area (PNA) by the NC Division of Marine Fisheries (NCDMF). The waters are open to shellfishing. The applicants propose to impact approximately 0.1 acre of wetlands through filling/culverting to construct an access road and provide infrastructure for a 37 home subdivision. A state stormwater permit was applied for on 11/22/05. Preliminary approval to connect to the county sewer system has been granted. A letter of approval from EEP was submitted with the application. We have the following concerns/recommendations: A stream crossing near lots 33 and 34 is not designated as such on the impacts map. We recommend road crossings of streams with bridges, where practicable. If culverts are utilized, they should be imbedded sufficiently to allow for the passage and settlement of aquatic organisms. Utility crossings at streams should be directionally bored or suspended above the stream. • We recommend 100 ft and 50 ft native forested buffers are maintained or created on each side of on-site perennial and intermittent streams, respectively. • The presence of 37 homes adjacent to Topsail Sound with sheet flow of stormwater runoff is likely to have an adverse cumulative impact. The presence of pet wastes and lawn treatment products in this runoff could have an adverse impact on water quality resulting in the closure of shellfishing in this area of Masonboro Sound. We recommend retention of stormwater runoff on-site to allow for filtration through the soil. Additionally, deed restrictions/protective covenants could be used to require proper disposal of pet wastes, but this would require homeowner association enforcement. • The cumulative impacts of future development (home construction) on wetlands have not been addressed. We recommend that all remaining and restored wetlands on-site be preserved through permanent conservation easement to prevent further impacts. This easement should prohibit any cutting, mowing, or disturbance of vegetation; soil disturbance; or construction of any kind (including walkways, piers, platforms, etc.) within the wetlands. The NCWRC has coordinated with the Division of Water Quality with whom we share concerns. We therefore support any recommendations they have for this project. We have no objection to the project provided our recommendations are included as permit conditions. Thank you for the opportunity to review and comment on this application. For Wetlands'', Impact Areas A, B, C, and D. it is unclear if all potential impacts, both permanent fill and temporary construction access, are included. For Wetland Impact Area E, the driveway access and utility line easement, the easement is - noted as 30 feet wide; however, the proposed impacts are for approximately 12 feet wide. Will a fill slope be associated with this crossing? Will the utilities be installed with'the roadbed or adjacent to the road? Please ensure that your application includes all temporary and permanent impacts. 3. In the PCN, you have noted that Wetlands Impact F is a temporary impact associated with the installation of a culvert and energy dissipater. If this is truly a temporary crossing, please explain the purpose and need for this structure and include a detailed restoration plan for its removal. If this is intended to be a permanent culvert and rock apron, please justify the impact and include as permanent impact. r I -2- 4. Please provide additional information that depicts the lot layout, driveway, and limits of construction for each proposed lot that contains jurisdictional waters such that your proposal accounts for all impacts for the entire project. 5. Do future pllans for this subdivision include structures (piers, docks, etc.) for access to the Waterway? In addition, are you required to obtain any authorizations for the North Carolina Division of Coastal Management? 6. Your project plans depict drainage easements through jurisdictional wetlands. Are these proposed drainage swales, culverts, etc? If any mechanized land clearing and,discharge of fill material is a component of the establishment and/or maintenance of these easements, you must obtain DA authorization. 7. Your Performance Plan submitted to the New Hanover County Planning Department,hows areas in the development of "passive" and "active recreation areas" within the jurisdictional wetlands. If development of either of these recreational areas entails permanent or temporary impacts associated with mechanized land clearing and/or the discharge of fill material, Department of Army authorization will be required. Please make certain that you identify all impacts for your project. 8. Under the conditions of the Nationwide Permit, compensatory mitigation is required for your proposed permanent impacts to jurisdictional waters. You have proposed to t ake payment to the N.C. Ecosystem Enhancement Program (EEP) for your requested impacts; however, you must first explore all on-site and local opportunities" for compensatory mitigation (i.e. restoration/creation/enhancement/preservation). Based on the Corps familiarity with this project location and your site plan, we believe that mitigation opportunities are present on site. Impact Justification (Avoidance and Minimization ) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the' project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followe during construction to reduce impacts. Wetland impacts were avoided to the greatest extent possible by planner. Wetland fill is only proposed for portions of roadways where no route through upland is possible. In addition, proposed roadways shall be built not to exceed the minimum DOT standard width. All impacts will be within local setbacks and consistent with zoning regulations. All impacts will VIII. Mitigation DWQ - In accordance with 15A NCAC 2H.0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact acid function and relative value of the impacted aquatic resource will be considered in deternu?ng acceptability of appropriate and practicable mitigation as proposed. Examples of mitigatio that may be appropriate and practicable include, but are not limited to: reducing the size of tlI a project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required, for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to cnsider the application complete for processing. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the FederalIRegister on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal.
