After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). PROJECT SUMMARY: The Town of Kitty Hawk would like to create a day use recreational area that will include a main kayak staging area and launch, a small fishing dock, a boardwalk with six pedestrian footbridges connecting a pedestrian trail and two small gazebos with kayak and canoe tie-up areas, a half court basketball court, several picnic tables with grills, a central gazebo with a picnic area, pier and a parking lot. PROJECT SET I ING The property in question was purchased by the Town of Kitty Hawk in 1999 and consists of 16.15 acres of high ground, water and wetlands, and is commonly referred to as the "John Harris Tract." There is a 15' wide paved entrance into the project site that is located approximately 850'northwest of the intersection of The Woods Road (SR 1206) and Kitty Hawk Road, in the Town of Kitty Hawk, Dare County. Located north of the Town's property is a mini-storage facility owned by Happy Boxes Three, to the south is open water and Snake Run Ditch, to the east is a large vacant tract (also belonging to the Town of Kitty Hawk), and to the west is a retail gardening center. Approximately 219' of the property, fronts directly onto The Woods Road. Along the western section of the property where the paved entrance is located, there is an existing 23,187 square feet asphalt access and parking lot between 15' and 30' from normal water level. There are no other man-made structures on the property. The property has a ridge and swale topography originally formed by Aeolian Transport that was subsequently reshaped by sand mining operations in the 1980's. Upland areas form maritime ridges that are anywhere from 3' to 10' above normal water level. The upland maritime ridges transition to 404 wetland swales and water that are oriented in a north to south direction. Between the ridges there are several open water areas that interconnect, leading to Sandy Run, Duck Pond Run, Kitty Hawk Bay, and finally the Albemarle Sound. These open water areas are labeled on the plans and are a product of the mining operations undertaken at this site by Outer Banks Contractors. Of the 16.15 acres, .012 acres are Coastal Wetlands, 8.65 acres are 404 Wetlands, 25.06 acres are open water, and 2.32 acres are high ground. Vegetation on the site along the high ground ridges is dominated by live oak, American holly, flowering dogwood, poison ivy, catbrier and giant cane. Freshwater wetland vegetation include, but is not limited to red cedar, wax myrtle, royal fern, cinnamon fern, red bay, and common reed. The Coastal Wetlands are dominated by black needle rush, bulrush, cattail, giant cord grass, salt marsh cord grass, and saw grass. _q Town of Kitty Hawk December 1, 2005 Page 3 The waters surrounding the property are tributaries of Sandy Run and Duck Pond Run, which are classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for the Albemarle Sound is SC (fish propagation). Review indicates that there are no identified archeological sites on the applicant's property. PROJECT DESCRIPTION The Town of Kitty Hawk proposes to construct a day use recreational area that will include a main staging area, a kayak and canoe launch, a small fishing dock, boardwalks with six pedestrian footbridges connecting two small gazebos with kayak and canoe tie-up areas, a half court basketball court, a concrete shuffle board court, horseshoe pits, several picnic tables with grills, a water fountain, a central gazebo, and a parking lot. There are no bathroom facilities associated with this project. For the purpose of this report the proposed work is broken down into three major headings; 1) Main Recreation Area and Parking Lot Fronting on The Woods Road, 2) Proposed Bridges, Walking Trail and Gazebos, and 3) Proposed Dredging. (1) Main Recreation Area and Parking Lot Fronting on The Woods Road A. Impervious Lot Cover The applicant proposes to remove a 23,187sf asphalt drive and parking lot and redevelop the site to accommodate three picnic tables and grills, a water fountain, a 585sf open gazebo, a shuffle board court, a basketball court, a horse shoe pit, associated walkways, a 20 car parking lot, and expanded paved access from The Woods Road. The redevelopment will result in the loss of 9,677sf of the existing asphalt cover (7,529sf within the 75' AEC and 2,148sf outside of the 75' AEC) from the property. However, the Town proposes to increase the width of the existing drive, accessing the site, from a width of 15' to 24' to accommodate two-way traffic. This expansion will result in the placement of approximately 720sf of new asphalt within the 75' AEC (outside of footprint of the existing access). The widening of the drive will also result in the placement of approximately 25sf of impervious surface within the 30' buffer. The total area of impervious surface on the property, within the 75' AEC, will be less than 4%. Land disturbance outside of existing impervious areas in conjunction with the redevelopment of the site fronting on The Woods Road. The provide a safe pedestrian access to the water.adjacent to the main gazebo, within the 30 buffer, the shoreline will be graded and backfilled with sand leading to a step down system to the water for launching kayaks and canoes. The Town proposes to extend the steps for the kayak and canoe launch below NWL, which will require a small area of excavation below NWL. Dredge totals for the kayak and canoe launch are addressed in section 3 on page seven, under Dredging. Proposed Pier/Dock On the east side of the main gazebo, adjacent to the kayak launch, the Town proposes to construct a small dock (20'x 6') paralleling the shoreline. The dock will be accessible by a walkway leading from the main gazebo and by stairs adjacent to the kayak launch. Proposed Pedestrian Bridges There are a total of six proposed pedestrian water crossings on the property to connect the proposed recreational trail and to access the two gazebos. Bridge #1 Bridge will cross 27' of open water, bridging from high ground to high ground. Water depths at the center of the water crossing are approximately two feet below NWL. The bridge will be a pre-fabricated single span structure 6' x 35'. Proposed Walking Trail The proposed trail will be six feet wide and approximately 3,213' long. It will consist of both elevated wooden walkways and gravel paths along high ground areas. Elevated walkways will be constructed over all delineated coastal and freshwater wetlands. Gravel will be used to create 340' walking path along the west side of the property along a high ground ridge. Approximately 10sf of that graveled path will fall within the 75' AEC. The remaining trail (not including any water crossings) will consist of Town of Kitty Hawk December 1, 2005 Page 6 elevated walkways over wetlands and intermittent high ground areas and will vary in height from 18" to 36" (36" over all Coastal Wetlands). Elevated walks are to be constructed at a width of six feet and will total approximately 2,708' in length, with 511' crossing high ground and 2,197' crossing vegetated wetlands (approximately 147' crossing Coastal Wetlands). Small Gazebos Two 166sf gazebos are proposed along the walking trail to provide resting areas, viewing stations and kayak tip-up facilities. There will be four-foot wide walks around each gazebo that will ramp down to a small 4' landing at water level. Each gazebo will be elevated approximately two feet above NWL. 1) The proposed location of the first gazebo is between bridges No. 1 and No. 5. The gazebo will include a 166sf-roofed area with approximately 8sf extending over the water. Approximately 130sf will be over vegetated wetlands and 62sf over water. The average water depth at this site, at the waterward edge of the structure is approximately 4' below NWL. The gazebo will be constructed over water and will be accessed by a 6'x 15' elevated walkway (pier). The gazebo will include a 166sf-roofed area with a four-foot wide walkway/ramp to tie off kayaks. The average water depth at this site, on the waterward edge of the walk is approximately 3' below NWL. 130sf li Town of Kitty Hawk December 1, 2005 Page 7 Pier over water Total Area of Shaded Shallow- 3) Proposed Dredging 90sf later: 282sf There are three sites where dredging is being proposed. The first site is at the proposed kayak and canoe launching area at the main recreation site. The launch area will provide a step down into the water and necessitate the excavation of a small area at the shoreline. The area to be excavated will be approximately 20'x 6'x 1' below NWL to facilitate the installation of the step system to the water. It is estimated that the total amount of material to be removed will be 4.3 cubic yards. The two remaining sites are in areas leading to the large remnant barrow pit on the northwest side of the property as shown on the plans. In order to facilitate complete access around all open water areas, within the boundaries of the Town's property, the Town of Kitty Hawk proposes to dredge the two areas currently impassable by boat. Existing depths within each area vary from l'-0" along the outside edge of the proposed excavation area to as little as two inches, based on an on site review. Excavation will be 8'x 30'x 1' at both sites according to the application and excavation will be carried out with hand tools and hauled by small motorized equipment able to operate within the path of the proposed walkways. It is estimated that approximately 10" of material will be excavated at each site for a total of approximately 7.5 cubic yards per site. Site #1: Area to be excavated: 20'x 6' 120sf Site #2: Area to be excavated: 30'x 8' 240sf Site #3: Area to be excavated: 30'x 8' 240sf Total Area of Shallow. Bottom/Estuarine Water to be dredged 600sf A sparse amount of submerged aquatic vegetation (water milfoil) was found at the northern most dredge site entering the northwest pond. No other vegetation was found within the areas where dredging is proposed. ANTICIPATED IMPACTS All impacts will be within a tract that was previously a commercial sand mining operation. All areas within the project site are considered previously disturbed, but have naturalized through several years inactivity. The project being proposed will have a number of impacts to high ground, water and wetlands if approved, and are as follows: Town of Kitty Hawk December 1, 2005 Page 8 • Area high ground that would be cut, graded and filled in association with the redevelopment of the main access area along The Woods Road totals 23,907sf. • Area high ground that would be cut, graded and filled in association with the kayak/canoe launch and the waking trail 2,319sf. • The total area of impervious lot cover on the property would not exceed 4%, and the total area of impervious lot cover would be significantly reduced within the 75' AEC and the 30' buffer. • The total area of Shallow Bottom and Estuarine Water dredged in conjunction with the kayak trail would be approximately 600sf. • The total area of Shallow Bottom and Estuarine Water that shaded by bridges, dock and gazebos would be 1,292sf. • The total area of shaded vegetated wetlands would include 12,588sf of delineated 404 wetlands and 882sf of Coastal Wetlands. • The total area of high ground shaded by elevated walkways would be 3,134sf. Mathis Date: December 1, 2005 Town Of Kitty Hawk Harris Tract Recreational Park Introduction The Town of Kitty Hawk proposes to develop a tract of land for recreational use located on The Woods Road, Kitty Hawk, Dare County, North Carolina. Figure 1 shows the location of the subject tract of land and surrounding properties. For GIS database reference, the entry to the subject tract off The Woods Road is located at approximately 82°37'52"W, 34°24'59"N (NAD83 NC Stateplane Meters: X: 275861.722476454 Y: 80015.4748760983, Stateplane Feet: X: 905056.334491499 Y: 262517.437155999, Lat/Long Decimal Degrees: X: -82.6311872931139 Y: 34.4162646485413, UTM 18 436445E 3991345N). This document provides general information about the subject tract of land, and surrounding lands, for the purpose of environmental permitting decision making. Proposed Activity The Town of Kitty Hawk proposes to use the subject tract of land for a public access passive recreation park, with the primary activities to be related to the water features of the land; canoeing / kayaking; fishing; and hiking and nature observation along the on- site streams and wetlands. These activities are to be supported by a canoe / kayak staging and launch facility and an adjacent fishing pier, two fishing and canoe/kayak tie-up facilities,. and a boardwalk connecting these facilities. As secondary activates, a half court basketball court, horseshoe pits, a lawn bowling area, and several picnic tables and grills will be provided in a grassed area adjacent to the parking area. All facilities will be ADA compliant. Topographical Setting The subject parcel of land is located within a large inland region of the northern North Carolina Outer Banks barrier island system. This area containing Kitty Hawk Woods typifies ridge and swale landscape character of the mid-Atlantic, developed upon marine and estuarine deposited unconsolidated sands. The surifical character of these sediments represent aeolian transport, deposition, and biological processes. A profile of this landscape includes upland "maritime" ridges located 3 to 10 feet above wetland swales. The wetland areas are interconnected to Kitty Hawk Bay through Sandy Run Ditch which passes under Kitty Hawk Road. The ridge and swale topography is oriented northwest to southeast and is a product of barrier island formation processes, including ocean wave energy and dominant winds. The site contains open-waters within the interior and southern boundary. The origin of the interior open-water system is not entirely known, however is likely relic borrow pit. Snake Run Ditch is oriented northeast/southwest along the tracts southern boundary and is manmade. An open water "canal" is located in the western region of the southern parcel. This "canal" is overgrown and roughly connected to the large (main) open water area. This "canal" varies from inches to several feet deep. Miscellaneous metal and wood debris is located in this ditch. PAENVIRONMENTAUKitty Hawk -Hams Tract\Rpts\appnar.doc Wetlands are located throughout the site as depicted on the permitting platwork. These wetlands can be generally characterized as "Coastal" or those under jurisdiction of the North Carolina Division of Coastal Management, and "404" those under jurisdiction of the U.S. Army Corps of Engineers. Upland areas of the subject tract include: naturally occurring maritime ridges (eastern area of tract), spoil disposal material (northern and northwestern areas of tract) and developed lands (northwestern, western and southwestern areas). Some upland areas of the tract that have been anthropogenically modified have a varied and typically undocumented history. Vegetation The vegetative composition of the upland ridge maritime forests are dominated by Ouercus virginiana (live oak), Ilex opaca (American holly), Cornus jlorida (flowering Jogwood), Arundinaria gigantean (Giant Cane). "404" wetland areas typically consist of Juniperus Virginiana (Red Cedar), Myrica ceri era (Wax Myrtle), Osmunda regalis (Royal Fern), Osmunda cinnamomea (Cinimon Fern), and Persea borbonia (Red Bay). "Coastal wetlands" upon the tract contain: Spartina alterniora: (Salt Marsh Cord Grass) Juncus roemerianus: (Black Needlerush), Scirpus spp.: (Bulrush), Cladium jamaicense: (Saw Grass), Typha spp. (Cattail), Spartina cynosuroides: (Salt Reed or Giant Cord Grass). Baccharis halmifolia (Groundsel Bush), Smilax spp. (Greenbrier), Toxicodendron radicans (Poison Ivy), Vaccinium Spp.(Highbush Blueberry), Vitis Spp. (Grape) Woodwardia Spp. (Virginia Chain Fern), exist within the ecotone between upland and wetland areas. Construction Description Construction of parking and basketball areas will be accomplished using typical earth moving and paving equipment. Pile supported walkway will be constructed over wetlands by working from installed section and continuing or progressing through wetland area. Material to be excavated during the project shall be disposed off site. A 8,400 square foot disposal site has been reserved at the Kitty Hawk Fire Department at 965 Kitty Hawk Road. Mitigative Measures The proposed activities have several "built-in" mitigative components. Removal of Impervious Surface. The proposed parking area of the site is currently asphalt covered. The origin of the asphalt is unknown. The proposed project design will result in removal of 10,165 (.233ac) square feet of asphalt. Orientation of Boardwalk Wetlands were delineated in the field and the boardwalk was designed to utilize upland areas where possible. The area of the six-sided covered Canoe/Kayak Staging and Observation Deck is indicated in Note 6 on Sheet 2 of the Environmental Permitting Plan as 585 square feet, of which 222 square feet is within the 36 foot coastal shoreline area. The entire area is presently paved with asphalt. 2) The plans state the sf of asphalt in the 30' buffer and the 75' AEC, but what is the total area on the prop'' The total existing asphalt area on the project site is 23,187 square feet, with 15,850 square feet within the 75 foot AEC. 3) Please confirm the dredge totals. In the application it states that the total to be dredged is 19.3 cubic yards. If the area to be dredged is 30'x 8'x 8" that total is almost twice to dredge total. Which is correct? Although the dredge areas at the ponds are indicated on the plans as nominal rectangular areas, the volume of material to be removed was calculated to include 2:1 sloping sides, since actual vertical side walls would be impossible to maintain. Also, a small wedge of material at the face of the Kayak Launching Facility - where the top of the first "step" of that structure would be below the existing ditch/creek bottom - was included in the calculation. The 98 cy of high ground excavation is within the 75' AEC in the vicinity of the parking lot. Most of this volume is in the sloping ramp from the parking lot to the canoe launch area - the area that looks like a boat ramp. The volume of asphalt being removed was not counted as excavation where finish grade is higher than the existing asphalt, since the area where the asphalt will be removed will then be filled with either stone and new asphalt (in the new paved areas), or with structural and/or topsoil fill material in the areas being converted from imperious to pervious. 5) Where is the dredge spoil being taken. The property where it is being hauled to has a large area of wetlands. How far from the wetland area will be placed? Per the Excavation and Fill permit application, spoil material will be disposed on land owned by the Town of Kitty Hawk at 983 Kitty Hawk Road. Material will not be placed within any wetlands area or within an AEC on that property. 6) Usually the narrative brings all this information together, but it actually says very little about the specifics of the project. While excavation is mention, there is no information on how the site will be accessed to accomplish the dredging, the method of dredging, how the material will transported to a truck to be removed. The dredge site where the foot bridge will be located is not easy to get to by foot, how will you get equipment there? How will this be accomplished? I understand that there was a lot of talk about snagging out the canals/ditches. How will this be accomplished? By hand? If by equipment, how will they get it back to the site. I see a possible disaster here if these issues are not seriously addressed. The narrative should clearly state everything being proposed and clearly state all wetland, water, and high ground impacts. a.) Dredging access, method, material transportation. One of the dredging areas is located along the footprint of the proposed boardwalk, and another (at the outlet of the large pond) is located within 50' of the boardwalk. Project specifications will restrict any disturbance within the wetland areas to a 10' wide path along the walkway alignment, and will allow clearance of an access path of that width along the most direct route from the path of the boardwalk to the dredging area at the outlet of the large pond. Most of the dredging necessary at these locations can be accomplished with hand carried tools and equipment, however use of motorized equipment - for excavation or hauling - will be allowed but restricted to only small, low ground-contact pressure equipment that can be operated within the walkway cleared area without damage to the substrate. The small amount of excavation necessary at the Kayak Launch Facility can be reached by conventional excavation equipment from disturbed areas that will be re-graded at the parking lot area. b.) Snagging canals/ditches. Snagging of the ditch that is located to the east of the parking area and extending upstream to the outlet from the large pond, will be done with hand held tools and equipment, from boats or other floating platforms. Other wetland water. and high ground impacts. As indicated above, disturbances along the proposed walkway, within either wetland or upland areas, will be restricted to a 10' pathway, and to low impact equipment. These restrictions will also apply to construction of the compacted stone surface walkway on the upland area on the east side of the project area, which can be accessed along uplands from the adjacent communications tower site. At the parking lot area, most of the existing area is presently covered with asphalt paving, nearly all of which will be removed to allow construction of a smaller parking area, and the other improvements shown on the Environmental Permitting Plan. Most of the present tree covered strip along the creekiditch will not be disturbed, except where impacted by the walkway and the covered Canoe/Kayak Staging and Observation Deck. Also, most of the present tree covered berm adjacent to The Woods Road, will not be disturbed, except at the south end where necessary to widen the existing access road. All other area in this area will be disturbed for construction of the new parking lot and re-grading of the areas where existing asphalt will be removed.
