Send all suspicious email as an attachment to — Katie - To assist in your review of the final Mitigation Plan for the Burnetts Chapel Phase II Mitigation Site, below is a summary of your comments and how they were addressed in the final Plan: Site photos provided in Appendix are from August 2017 and there not as recent as recommended. Please describe any changes in site conditions or landuses since the time of the stream determination and site viability assessment in March 2018. Photos in the appendix were updated (9/26/2018) to document that the site conditions/landuse have not changed since the prior assessments. • Table 8 of Section 5.0 - changes are needed for DWR to confirm Eph and Pres credits meet the rule o Show the acreage of mitigation generated on the ephemeral channels, b4 and b5, as separate areas from the overall restoration acreage. It is recommended that a row be added to this table to accommodate for this. Table 8 now includes separate rows for Ephemeral Channels. They make up 23% of the creditable area and are therefore in compliance with 15 NCAC 02B .0295(0)(7) o Add a column to the right of the "Creditable Area" and title this column "Eligible Credit Area". T his is where to enter the maximum amount of credits allowed by the applicable rule reference at the bottom of the table. The column was added to Table 8. o Add another * to the bottom of the table referencing 0295(0)(7). Reference was added to the bottom of Table 8 o If minimum buffer widths begin at 50' throughout this Phase change the buffer width column from 30- 100' to 50'-100' to prevent confusion. There is a very small section on B3 that includes the area from TOB to 30 feet (based on the angle of the easement), so we left that on the restoration row. All the preservation has a minimum of 50' though, so that was updated. • The Conservation Easement has references to DENR and DWQ instead of DEQ and DWR. Please use an updated template prior to recordation. The correct easement template has been submitted to State Property Office and DMS for review before recording. • The mitigation plan is mostly complete and the proposed mitigation activities comply with 15A NCAC 02B .0295 NA Let me know if you need anything else.
