Include the area of buffer impact in ftz.: Per attached survey, the proposed house would be 2,600 sq. ft. including Decks, porches and steps. As you can see from the survey, the only uplands on the lot is where the septic is approved, leaving most of the house in zone 2-1,850 sq. ft. and 600 sq. ft. in zone 1. .2. State reasons why this plan for the proposed activity cannot be practically accomplished, reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers: "General" Variance Application Form, page 2 Version 1: May 2001 Approximately 4% of this lot is not in zone 1 and zone 2 and that 4% is the permitted septic area, leaving the only building envelope mostly in zone 2 but a little bit in zone 1. The minimum square footage for the subdivision covenants has to be adhered to. 2. Description of any best management practices to be used to control impacts associated with the proposed activity (i.e., control of runoff from impervious surfaces to provide diffuse flow, re-planting vegetation or enhancement of existing vegetation, etc.): Controlling runoff from impervious surfaces will be managed planting new vegetation around the perimeter of the house, i.e., Wax Myrtle, Bayberry, Rhododendror Buckeye and moisture absorbing trees such as: Pond Pines, Long Leaf Pine, Loblolly Bay Tree, Sycamore, Red Bay Tree, if existing vegetation was disturbed. If additional diffusion is required, a French Drain System (see attached diagram) can be installed. Please provide an explanation of the following: (1) The practical difficulties or hardships that would result from the strict application of this Rule. This subdivision was platted in 1975 and the owner bought this lot in 1998, prior to any existing buffer rules. The purpose of the purchase of this property was to build a waterfront home for a permanent residence. Due to erosion and the extensive nature of coastal vegetation, there is no suitable alternative to relocate the house. (2) How these difficulties or hardships result from conditions that are unique to the property involved. The unique properties of this lot are due to the fact that approximately 95% of this property is in Zone 1 and Zone 2, see attached survey. There is no other possibility for the building envelope since the septic system is occupying the only area not in the buffer area. (3) If economic hardship is the major consideration, then include a specific explanation of the economic hardships and the proportion of the hardship to the entire value of the project. Considerable economic hardship includes the fact that this property was purchased in good faith to build a retirement home in a beautiful location. The lot presently has a market value of $185,000.00, as a buildable lot, but would have no market value as an unbuildable lot Part 3: Deed Restrictions By your signature in Part 5 of this application, you certify that all structural stormwater best management practices required by this variance shall be located in recorded stormwater easements, that the easements will run with the land, that the easements cannot be changed or deleted without concurrence from the State, and that the easements will be recorded prior to the sale of any lot. Part 4: Agent Authorization If you wish to designate submittal authority to another individual or firm so that they may provide information on your behalf, please complete this section: Designated agent (individual or firm): Deborah Bryant Mailing address: PO Box 864 City, State, Zip :Oriental, NC 28571 Telephone: 252-249-1000 "General" Variance Application Form, page 3 Version 1: May 2001 Fax: Email: Part 5: Applicant's Certification I, -Peter and Maureen Digilio (print or type name of person listed in Part I, Item 2), certify that the information included on this permit application form is correct, that the project will be constructed in conformance with the approved plans and that the deed restrictions in accordance with rt this form will be reco d with all required permit conditions. Materials, -o--ii Coarse aggregate, filter fabric, optional blasting explosives to fracture quarry rock. Equipment *-'? Backhoe or excavator, hand shovel, labour. & Costs $ Low. Plans & • Flatter areas are preferable. ' Because there is no outlet for water, French drains should be located where Specs stormwater will naturally accumulate. • Ditches and grading can also be used to direct stormwater runoff to the French drains. • French drains should not be used where oil and grease are present to contaminate the ground water. Installation - Excavate a hole or trench to the maximum reach of the equipment used: the deeper the better.
