Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as
defined by the Coastal Area Management Act with Additional Conditions
Dear Mr. Digilio:
You have our approval, in accordance with the conditions listed below, to impact approximately 2220 square
feet (ft) of Zone I and 1850 square feet of impact to Zone II of the protected riparian buffers for the purpose
of constructing a dwelling on the subject property as described within your application dated November 18,
2005, and received in full on February 21, 2006. This letter shall act as your approval for the use of the
"General" Major Variance; From the Neuse River Riparian Buffer Rules for the Construction of Structures Oil
Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL
CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management
Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local
permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and
CAMA permits. This approval shall expire in five years from the date of this letter.
This approval is for the purpose and design that you described in your variance request. If you change your
project, you must notify us and you may be required to send us a new request for approval. If the property is
sold, the new owner must be given a copy of this approval and plat thereby assuming responsible for
complying with all conditions. This approval requires you to follow the conditions listed below.

The Additional Conditions of the Certification are:
1. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant is required to return the attached certificate of
completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 943 Washington
Square Mall, Washington, NC 27889.
2. Diffuse Flow
All new stormwater drainage shall be directed to vegetated areas as diffuse flow at non-erosive
velocities prior to entering the protected riparian buffers as identified within 15A NCAC 213 .0233(5).
No new ditching or piping of stormwater through the protected buffers is allowed
3. Buffer Mitigation (EEP/Restoration)
You are required to mitigate for Zone I impacts to the protected riparian buffers. The required area of
mitigation to compensate for impacts to the protected riparian buffers is 2220 square feet as required
under this variance approval and 15A NCAC 2B .0233.You may make a payment into the Riparian
Buffer Restoration Fund administered by the NC Ecosystem Enhancement Program (EEP) to meet this
mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the
mitigation requirement. In accordance with 15A NCAC 2B .0233, this contribution will satisfy our
compensatory mitigation requirements under 15A NCAC 2B.0233(9)(C). Until the EEP receives and
clears your check (made payable to: DENR -Ecosystem Enhancement Program Office), no impacts
specified in this variance approval shall occur. The EEP should be contacted at (919) 715-0476 if you
have any questions concerning payment into the EEP. For accounting purposes, this variance
aproval authorizes payment into the Riparian Buffer Restoration Fund to compensate for 2220
ft of required riparian buffer mitigation for impacts to 2220 ft2 of protected riparian buffers; 03-
04-10, 27-129 (1) river and subbasin."
The DWQ will accept an alternative method of mitigation (including but not limited to Buffer
Restoration or Enhancement) pursuant to the Buffer Mitigation Rule (15A NCAC 02B .0233) to satisfy
this mitigation requirement. If you choose to pursue this option, then you are required to submit in
writing a mitigation plan to the DWQ Wetlands/401 Unit/ Washington Regional Office for review and
approval. This plan should include a proposal to plant native species of hardwood trees with in the
riparian buffer area. For more information, please contact this office. No impacts shall occur to the
protected buffers until the mitigation plan is approved by the DWQ.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings to:
6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding
unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer
Protection Rules (15A NCAC 213.0233 (9)(c)). Please contact Kyle Barnes at 252-948-3917 if you have any

On December 9, 2005 the Division of Water Quality (DWQ) Washington Regional Office received your
application in the form of a "General" Major Variance to impact 600 square feet of Zone 1 and 1850 square feet
of Zone 2 of the Neuse Riparian Buffer. The. DWQ has determined that your application was incomplete and/or
provided inaccurate information as discussed below. The DWQ will require additional information in order to
process your application to impact the protected riparian buffer on the subject property. Therefore, unless we
receive the additional information requested below, we will have to move toward denial of your application as
required by 15A NCAC 2B .0233 and will place this project on hold as incomplete until we receive this
additional information. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
Zone 1 impacts
Within the variance application it is stated that you are only requesting 600 square feet of impacts to
Zone 1 of the riparian buffer. Through our calculations there are greater than 1600 square feet of
impacts. Please submit the total square footage of impacts to Zone 1 including, dwelling, driveway, and
any impervious surface within this area on an updated plat. The approval letter will reference the plat
and an accurate version is required.
2. Deed
A legible copy of the deed is needed for accurate review, the copy supplied with the variance request
not legible.

Per your request for additional information on the above variance, I am enclosing the
Deed and the revised survey that gives the square footage for the driveway. The impact
into Zone 1 is calculated at 2,192 Sq. Ft. including: dwelling, driveway and any
impervious surface within this area on the updated plat. The surveyor listed the driveway
as 1620 Sq. Ft., but 28 Sq. Ft. of that is in Zone 2.

1. Description of proposed activity [Also, please attach a map of sufficient detail (such as a plat
map or site plan) to accurately delineate the boundaries of the land to be utilized in carrying
out the activity, the location and dimension of any disturbance in the riparian buffers
associated with the activity, and the extent of riparian buffers on the land. Include the area
of buffer impact in ftz.:
Per attached survey, the proposed house would be 2,600 sq. ft. including Decks, porches
and steps. As you can see from the survey, the only uplands on the lot is where the septic
is approved, leaving most of the house in zone 2-1,850 sq. ft. and 600 sq. ft. in zone 1.
.2. State reasons why this plan for the proposed activity cannot be practically accomplished,
reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers:

Approximately 4% of this lot is not in zone 1 and zone 2 and that 4% is the permitted
septic area, leaving the only building envelope mostly in zone 2 but a little bit in zone
1. The minimum square footage for the subdivision covenants has to be adhered to.
2. Description of any best management practices to be used to control impacts associated with the proposed
activity (i.e., control of runoff from impervious surfaces to provide diffuse flow, re-planting vegetation or
enhancement of existing vegetation, etc.): Controlling runoff from impervious surfaces will be managed
planting new vegetation around the perimeter of the house, i.e., Wax Myrtle, Bayberry, Rhododendror
Buckeye and moisture absorbing trees such as: Pond Pines, Long Leaf Pine, Loblolly Bay Tree,
Sycamore, Red Bay Tree, if existing vegetation was disturbed. If additional diffusion is required, a
French Drain System (see attached diagram) can be installed.
Please provide an explanation of the following:
(1) The practical difficulties or hardships that would result from the strict application of this
Rule. This subdivision was platted in 1975 and the owner bought this lot in 1998, prior to
any existing buffer rules. The purpose of the purchase of this property was to build a
waterfront home for a permanent residence. Due to erosion and the extensive nature of
coastal vegetation, there is no suitable alternative to relocate the house.
(2) How these difficulties or hardships result from conditions that are unique to the property
involved. The unique properties of this lot are due to the fact that approximately 95% of
this property is in Zone 1 and Zone 2, see attached survey. There is no other possibility
for the building envelope since the septic system is occupying the only area not in the
buffer area.
(3) If economic hardship is the major consideration, then include a specific explanation of the
economic hardships and the proportion of the hardship to the entire value of the project.
Considerable economic hardship includes the fact that this property was purchased in
good faith to build a retirement home in a beautiful location. The lot presently has a
market value of $185,000.00, as a buildable lot, but would have no market value as an
unbuildable lot

By your signature in Part 5 of this application, you certify that all structural stormwater best
management practices required by this variance shall be located in recorded stormwater
easements, that the easements will run with the land, that the easements cannot be changed or
deleted without concurrence from the State, and that the easements will be recorded prior to the
