SUBJECT: NOTICE OF VIOLATION

Dear Permittee:
The North Carolina Division of Water Resources Asheville Regional Office staff conducted an inspection of the Town
of Marshall Pretreatment Program on September 20, 2018. The purpose of the inspection is to determine the
effectiveness of the pretreatment program by an in-depth review of the files, including industrial monitoring data,
appropriate data management and adherence to the Enforcement Response Plan.
The results of the inspection indicate that the Town has failed to meet the minimum requirements of 15A NCAC 2H
.0900, 40 CFR 403.8 and Part IV, D of the NPDES permit NC0021733.
The following violation(s) were noted during the inspection:

Pretreatment Failure to take proper enforcement against a Significant Industrial User (SIU) for Significant
Noncompliance (SNC).
Failure to perform annual inspection at SIU _________________________________________________________________________________________________________________________________________________________________________
To prevent further enforcement action, perform the following actions by the indicated due date.
1.Complete the attached compliance judgement worksheet for each parameter for which violations occurred.

2. Take appropriate enforcement action (e.g. NOV, penalty assessment) for any violations as per the Town’s
approved enforcement response plan (ERP). Make note if any of the violations reach the level of significant
non-compliance (SNC) and inform the industry that they will be included in the required annual publication of
SIUs in SNC.
3. Submit the compliance judgment worksheets and copies of any enforcement documents to Dan Boss, Asheville
Regional Office no later than November 9, 2018.
A summary of the findings and comments noted during the inspection are provided in the enclosed copy of the
inspection report.
