Please read over it and let me know if you need any further information or have any comments. "Mr. Walter, I have just been in touch with the property owner and he says that the maximum number he can pasture is 25 but he normally over-winters no more than 18. The cattle are over-wintered in the same fields they use in the summer which is the area above and below the new structure. If he is not allowed to use this as a crossing, he would have to make the cattle cross the road in a blind curve in order to graze the upstream side of the pasture. This would create a traffic hazard and liability issue for him if someone had a wreck due to him crossing his cattle in the curve. Again, since the cattle have unrestricted access to the creek above and below the existing and new structure, I don't see that us prohibiting crossing underneath the structure will have any significant affect on water quality. If we do prohibit the crossing, he will not agree to settle with us and we will have to condemn the property. If this then were to go to a jury trial, I feel that we would not prevail without having to pay out heavy damages. I will need to know a final decision on this issue in further handling of the property claims. Thanks, Harold.
