In accordance with 33 CFR 325.1(d)(2), all activities which the applicant plans to undertake which are reasonably related to the same project for which a DA permit would be required should be included in the same permit application. District engineers should reject, as incomplete, any permit application which fails to comply with this requirement. For example, a permit application for a marina will include dredging required for access as well as any fill associated with construction of the marina. It is appears from the plans submitted with the application that Horton Road would be improved to provide adequate access to the project site. If this is the case, please revise the delineation of waters and plans as appropriate to include this area. Additionally, a map showing the sewer alignment was included with the permit application. However, it is unclear from the application why impacts associated with this line were not included in this permit application. Please provide a delineation of the sewer line alignment and revise the project plans and impact amounts to include all impacts to waters of the U.S. associated with this line. Alternatively, please provide a detailed rationale of why the sewer line should be considered separately from this project. This rationale should discuss the funding source of the sewer line, who would build the line, what other project would use the line (if any), when the other projects would be built, and the status of other the state/local authorization required to build the other projects." The aquatic resource table has been included as well but it did not change. The maps have been revised to include the road widening improvements along Horton Road. There are no streams, wetlands, open water, or isolated waters along Horton Road within the road widening improvement corridor. Please see the enclosed photographs that represent the existing conditions along both sides of Horton Road and the intersection with Garrison Road. The aquatic resource maps have also been revised to include the sewer line project that will be constructed by The Silverman Group to tie into the new Charlotte Water public sewer line project. The Silverman Group's section of the sewer line (shown in orange on the enclosed Charlotte Water Public Sewer Extension — Parcel Map) may always solely serve the Charlotte Intermodal Distribution Center project. However, if the Mecklenburg County owned parcels on either side of this sewer line are ever developed or sold, any facilities constructed on these parcels will have access to sewer along this section of line. There are no streams, wetlands, open water, or isolated waters within the corridor of the Charlotte Intermodal Distribution Center section of sewer line. The placement of this section of sewer line was not an ideal location for the project but this route was traversed and chosen because no impacts to jurisdictional waters or state waters are required for construction. The more ideal location for the sewer line would have been in the southeast corner of the Charlotte Intermodal Distribution Center parcel but this route would have required impacts to wetlands. Atlas Response to Charlotte Water Public Sewer Project: Please see the enclosed Charlotte Water Public Sewer Extension — Parcel Map and Charlotte Water Public Sewer Extension — USGS Map. Charlotte Water's service watershed in this area is 1,115 acres. The maps show the existing Charlotte Water sewer lines and access tunnels as green polylines. The proposed Charlotte Water trunk sewer line project is delineated as a red polyline. The Jurisdictional Determination request should be submitted soon for this project. Once the delineation is approved in the field, engineering will be finalized. A permit application will be submitted once the delineation has been field verified by the Corps and a grading plan is finalized. Alan Johnson has reviewed the sewer route in the field with Atlas staff. Future expansions of Charlotte Water sewer lines are shown as magenta polylines. These future expansions include three separate lines: one line that will serve Garrison Road and upper Horton Road, one line that will serve West Blvd/Steele Creek Road, and one line that will serve Shopton/Steele Creek Road. The City of Charlotte owns most of the parcels on the east side of 1-485 within the drainage area. The City is working to purchase the remaining parcels. This land will more than likely be developed in the future as an expansion of the Charlotte Intermodal Terminal, the Charlotte Douglas International Airport, and/or as industrial/commercial development due to the proximity to 1-485, the airport, and the intermodal terminal. There is already one industrial building at the corner of West Blvd and Steele Creek Road. Funding Source of the Sewer Line: The orange sewer line segment will be paid for and constructed by The Silverman Group as part of the Charlotte Intermodal Distribution Center. This sewer line will be sized to serve the Charlotte Intermodal Distribution Center project. This line may solely serve this project. As previously stated and illustrated this sewer line has been added to the aquatic resource map for the project. As with most Charlotte Water extension projects that are required for new development The Silverman Group will pay for construction of the trunk sewer line shown on the maps in red. The Silverman Group will be seeking reimbursement of the funds for the trunk sewer line project from Charlotte Water. Charlotte Water is requiring that this line be constructed as a 12" line as opposed to an 8" line since it is a Charlotte Water public trunk line that will serve additional properties and be expanded in the future. Who Will Build the Line: The Silverman Group will construct the orange segment of the sewer line and will not be asking for reimbursement. Charlotte Water will have direct approval, oversight, and management for the trunk sewer line and will be the permittee for this project. Charlotte Water will have a project manager assigned to the trunk sewer project. Charlotte Water will advertise the construction of this project and award the contractor of choice. What Other Project Would use the Line: Atlas has direct knowledge of two other projects within this service area that will tie into Charlotte Water's trunk sewer line (the red polyline). Due to client — consultant confidentiality privileges Atlas is not at liberty to discuss project specifics concerning these two projects. However, the Corps and DWR are aware of both projects that are located on Garrison Road. The Corps and DWR have conducted site visits at both projects. In addition to the two projects that Atlas has direct knowledge of, grading is occurring on a parcel along Horton Road. Atlas has no direct knowledge of the timing of or nature of this project. Almost all the parcels along Garrison Road are currently for sale so development of the Garrison Road corridor is imminent. The project is being engineered. While development is market driven, it is anticipated that this project will be constructed within the next 1-2 years. This project will require City plan approval. The project has been presented to City planning but has not been officially submitted for approval as the final plans are not finished. The delineation on second project that Atlas has direct knowledge of has been field approved by the Corps. DWR has also conducted a site visit. This project is currently being engineered including the grading plan. While development of this parcel is market driven as well, it is anticipated that this project will move forward with Corps/DWR permitting within the next 6-12 months and be constructed within the next 1-2 years. The developer is actively marketing this project. The developer has conducted meetings with the City to discuss the conceptual site plan. In summary, the section of sewer line that may solely serve the Charlotte Intermodal Distribution Center has been added to the aquatic resource maps. There are no jurisdictional waters or isolated waters within the corridor of this sewer line. The separate Charlotte Water trunk sewer line project will be a public utility project that will be constructed to allow for future expansion within the 1,115 acre drainage area.
