On September 6, 2006, an initial interest form for two stream origin determinations was submitted to the NC
Division of Water Quality's Express Review Program by Mr. Jay Keller of Keller Environmental, LLC for your
project known as "Terrell Plantation". According to the initial interest form and our records, the initial stream
determination for this site was made on August 18, 2005 by Mike Horan of the Division of Water Quality (DWQ)
Raleigh Regional Office. An appeal was requested on August 29, 2005 as provided within 15A NCAC 02B
.0233(3)(a). On October 31, 2005 Cyndi Karoly and Amy Chapman conducted the appeal site visit. The buffer
determination appeal letter for Stream Feature A, dated November 22, 2005, states:
"The DWQ has determined that the stream labeled as "A" on the attached map is subject to the Neuse Buffer Rule
beginning at the location indicated on the attached map, and flagged in the field by you [Jay Keller] for the
purposes of surveying the location. This determination shall replace the determination originally performed by
the Regional Office."
This appeal determination is final and binding to the DWQ and the person requesting it according to NCAC 2B
.0233(3)(a). According to this rule, an appeal can be made to the Office of Administrative Hearings within 60
days of the appeal letter (November 22, 2005). Therefore the two streams will be subject to review by DWQ staff
on November 22, 2010 since that determination expires in five years.

Dear Mr. Keller:
On October 31, 2005, at your request I conducted an on-site determination.to review a feature located on
the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is
labeled as "A" on the attached map initialed by me on October 31, 2005. Division of Water Quality
(DWQ) Staff from the Raleigh Regional Office had previously conducted an on-site determination of the
stream and determined it to be subject upstream beyond the smaller pond feature. In your letter to the
Director dated August 29, 2005, you requested an appeal of their determination as provided within 15A
NCAC 02B.0233(3)(a).
At your request, I conducted an appeal of their determination as stated above. During my review I
evaluated the stream using the DWQ Stream Classification Form. I evaluated the stream reach A and
calculated the score to be 9.75 points above the point marked with an "*" on the attached map.
Downstream of this location (where groundwater discharge was apparent during drought conditions), the
stream is at least intermittent.. The form states that if the score is "greater than or equal to 19 points the
stream is at least intermittent".
The DWQ has determined that the stream labeled as "A" on the attached map is subject to the
Neuse Buffer Rule beginning at the location indicated on the attached map, and flagged in the field
by you for the purposes of surveying in the location. This determination shall replace the
determination originally performed by the Regional Office.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the
State. If you have any additional questions or require additional information please call me at (919) 733-
9721. This determination is subject to review as provided in Articles 3 & 4 of G.S. 150B.

We met with Cyndi Karoly and Amy Chapman on October 31, 2005 as part of an appeal call from a prior site visit on
August 18, 2005 by Mike Horan. We have attached the November 22, 2005 appeal letter and the August 29, 2005

This on-site determination shall expire five (S) years from the date of this letter. Landowners or affected parties
that dispute a determination made by the DFVQ or Delegated Local Authority that a surface water exists and that
it is subject to the buffer rule may request a determination by the Director. A request for a determination by the
Director shall be referred to the Director in writing c% Cyndi Karoly, Dii'Q Wetlands/401 Unit, 2321 Crabtree
Blvd, Raleigh, NC 27604-2260. Individuals that dispute a determination by the DIVQ or Delegated Local
Authority that "exempts" a surface water from the buffer rule may ask for an ad judicatory hearing You must
act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory
appeal time does not start until the affected party (Including downstream and adjacent landowners) is notified of
this decision. DIVQ recommends that the applicant conduct this notification in order to be certain that third
party appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 hfail
Service Center, Raleigh, N.C. 27699-6714. This determination is final and binding unless you ask for a hearing
within 60 days.

stream is at least intermittent.. The form states that if the score is "greater than or equal to 19 points the
stream is at least intermittent".
The DWQ has determined that the stream labeled as "A" on the attached map is subject to the
Neuse Buffer Rule beginning at the location indicated on the attached map, and flagged in the field
by you for the purposes of surveying in the location. This determination shall replace the
determination originally performed by the Regional Office.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the

§ 15013-3. Special provisions on licensing.
(a) When an applicant or a licensee makes a timely and sufficient application for issuance i ta-
license er ypatiena is including the payment of any required license fee, the existing license Aj ,
gGp0p3t+B octtigg does not expire until a decision on the application is finally made by the agency-and if the
application is denied or the terms of the new license or occupational license are limited, until the last day for
applying for judicial review of the agency order. This subsection does not affect agency action summarily
suspending a license or occupational license under subsections (b) and (c) of this section.
(b) Before the commencement of proceedings for the suspension, revocation, annulment, withdrawal,
recall, cancellation, or amendMp;it of any license oth??tfian-aR-ec uC etiZ -n Piceme- the agency shall give notice
to the licensee, pursuan ro"-fl a provisions of G.S. 1506-23. Before the commencement of such proceedings
involving an occupational license, the agency shall give notice pursuant to the provisions of G.S. 15013-38. In
either case, the licensee shall be given an opportunity to show compliance with all lawful requirements for
retention of the license or occupational license.
(c) If the agency finds that the public health, safety, or welfare requires emergency action and
incorporates this finding in its order, summary suspension of a license or occupational license may be ordered
effective on the date specified in the order or on service of the certified copy of the order at the last known
address of the licensee, whichever is later, and effective during the proceedings. The proceedings shall be
promptly commenced and determined.
Nothing in this subsection shall be construed as amending or repealing any special statutes, in effect prior
to February 1, 1976, which provide for the summary suspension of a license.
(d) This section does not apply to the following:
(1) Revocations of occupational licenses based solely on a court order of child support
delinquency or a Department of Health and Human Services determination of child
support delinquency issued pursuant to G.S. 110-142, 110-142.1, or 110-142.2.
(2) Refusal to renew an occupational license pursuant to G.S. 87-10.1, 87-22.2, 87-44.2, or
89C-18.1, based solely on a Department of Revenue determination that the licensee
owes a delinquent income tax debt.
§ 1506-4. Declaratory rulings.
(a) On request of a person aggrieved, an agency shall issue a declaratory ruling as to the validity of a rule
or as to the applicability to a given state of facts of a statute administered by the agency or of a rule or order of the
agency, except when the agency for good cause finds issuance of a ruling undesirable. The agency shall
prescribe in its rules the circumstances in which rulings shall or shall not be issued. A declaratory ruling is binding
on the agency and the person requesting it unless ' is altered or set aside b the court. An agency may no
retroac ively change a ec ara ory u nothing in this section prevents an agency from prospectively
changing a declaratory ruling. A declaratory ruling is su icial r 'n the same manner as an order in
a contested case. Failure of the agency To issue a eclaratory ruling on the merits wit in 6 ays o ere uest

This on-site determination shall expire five (S) years from the date of this letter. Landowners or affectedparties
that dispute a determination made by the DiVQ or Delegated Local Authority that a surface water exists and that
it is subject to the buffer rule may request a determination by the Director. A request for a determination by the
Director shall be referred to the Director in writing c% Cyndi Karoly, DTVQ Wetlands/401 Unit, 2321 Crabtree
Blvd, Raleigh, NC 27604-2260. Individuals that dispute a determination by the DNQ or Delegated Local
Authority that "exempts" a surface water fron the buffer rule may ask for an ad judicatory hearing. You must
act within 60 days of the date thatyou receive this letter. Applicants are hereby notified that the 60-day statutory
appeal time does not start until the affected party (including downstream: and adjacent landowners) is notified of
this decision. DFVQ recommends that the applicant conduct this notification in order to be certain that third
party appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail
Service Center, Raleigh, N.C. 27699-6714. This determination is final and binding unless you ask for a hearing
within 60 days.

This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected parties
that dispute a determination made by the DIVQ or Delegated Local Authority that a surface water exists and that
it is subject to the buffer rule may request a determination by the Director. A request for a determination by the
Director shall be referred to the Director in writing c% Cyndi Karoly, DIVQ Wetlands1401 Unit, 2321 Crabtree
Blvd, Raleigh, NC 27604-2260. Individuals that dispute a determination by the DIVQ or Delegated Local
Authority that "exempts" a surface water from the buffer rule may ask for an ad judicatory hearing. You must
act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory
appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of
this decision. DIVQ recommends that the applicant conduct this notification in order to be certain that third
party appeals are made in a timely manner. To ask fora hearing, sentd a tvrittert petition, which confornns to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail
Service Center, Raleigh, N.C. 27699-6714. Tltis deternnittatiott is final and bittdutg unless you ask fora hearing
within 60 days.
The (owner/future owners) should notify the Division of Water Quality (including any other Local, State, and
Federal Agencies) of this decision concerning any future correspondences regarding the subject property (stated
above). This project may require a Section 4041401 Permit for the proposed activity. Any inquiries should be
directed to the Division of Water Quality (Central Office) at (919)-733-1786, and the US Army Corp of Engineers
(Raleigh Regulatory Field Office) at (919)-876-8441.
