September 8, 2006 EXPRESS REVIEW DENIAL LETTER George Van Nortwick PO Box 310 Rolesville, NC 27571 Project Name: Terrell Plantation (DWQ# 2005-2099) Dear Mr. Nortwick: Wake County On September 6, 2006, an initial interest form for two stream origin determinations was submitted to the NC Division of Water Quality's Express Review Program by Mr. Jay Keller of Keller Environmental, LLC for your project known as "Terrell Plantation". According to the initial interest form and our records, the initial stream determination for this site was made on August 18, 2005 by Mike Horan of the Division of Water Quality (DWQ) Raleigh Regional Office. An appeal was requested on August 29, 2005 as provided within 15A NCAC 02B .0233(3)(a). On October 31, 2005 Cyndi Karoly and Amy Chapman conducted the appeal site visit. The buffer determination appeal letter for Stream Feature A, dated November 22, 2005, states: "The DWQ has determined that the stream labeled as "A" on the attached map is subject to the Neuse Buffer Rule beginning at the location indicated on the attached map, and flagged in the field by you [Jay Keller] for the purposes of surveying the location. This determination shall replace the determination originally performed by the Regional Office." This appeal determination is final and binding to the DWQ and the person requesting it according to NCAC 2B .0233(3)(a). According to this rule, an appeal can be made to the Office of Administrative Hearings within 60 days of the appeal letter (November 22, 2005). Therefore the two streams will be subject to review by DWQ staff on November 22, 2010 since that determination expires in five years. Director Division of Water Quality DWQ Project # 20052099 Wake County Subject Property: Buffer Determination Appeal for Stream Feature A, Rolesville Terrell Plantation, Rolesville, NC On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B.0233) Dear Mr. Keller: On October 31, 2005, at your request I conducted an on-site determination.to review a feature located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is labeled as "A" on the attached map initialed by me on October 31, 2005. Division of Water Quality (DWQ) Staff from the Raleigh Regional Office had previously conducted an on-site determination of the stream and determined it to be subject upstream beyond the smaller pond feature. In your letter to the Director dated August 29, 2005, you requested an appeal of their determination as provided within 15A NCAC 02B.0233(3)(a). At your request, I conducted an appeal of their determination as stated above. During my review I evaluated the stream using the DWQ Stream Classification Form. I evaluated the stream reach A and calculated the score to be 9.75 points above the point marked with an "*" on the attached map. Downstream of this location (where groundwater discharge was apparent during drought conditions), the stream is at least intermittent.. The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent". The DWQ has determined that the stream labeled as "A" on the attached map is subject to the Neuse Buffer Rule beginning at the location indicated on the attached map, and flagged in the field by you for the purposes of surveying in the location. This determination shall replace the determination originally performed by the Regional Office. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State.
