Reference your con-espondence dated September 17, 2018 in which you requested comments for the referenced project. Preliminary analysis of the project reveals tl�e potential for n�ultiple impacts to stt�eams and jurisdictional wetlands in thc project area. More specifically, impacts to: Stream Name River Basin Stream Stream index Number 303(d) Listing Classification(s) Peters Creek Yadkin Pee Dee C 12-94-12-8 No Ftu�ther investigations at a higher resolution sholild be undertaken to verify the presence of ofller streams and/or jtuisdictional wetlands in flle area. lf any,jurisdictional areas are identiiied, the Division of Water Resources requests that NCDOT and their consultants consider the following envirorunental issues for fl1e proposed project. General Project Comments: Further enviromilental docuinents should provide a detailed and itemized presentation of the proposed impacts to wetlands and streams wifl� corresponding mapping. lf mitigation is necessaiy as required by 15A NCAC 2H.0506(h), it is preferable to present a concephial (if ilot finalized) initigation plan with the enviroiunental documentation. Appropriate mitigation plans will be required prior to issuance of a 401 Water Quality Certification. In accordance with the Environmental Management Commission's Rules (15A NCAC 2H.0506[h]), mitigation will be required for impacts of greater than 300 linear feet to any perennial sri-eam. In the event that mitigation is required, the mitigation plan shall be designed to replace app�-opriate lost fiinctions and values. Future docun�entation, including the 401 Water Quality Certification Application, shall contim►e to incllide an itemized listing of the proposed wetland and stream impacts with corresponding i7�apping. 4. The NCDWR is very concerned with sedi��lent and erosion im}�acts that could result from this project The NCDOT shall address these concerns by describing the potential impacts tl�at may occur to the aquaric environments and any illitigating factors tl�at would reduce the i�npacts. 5. The NCDOT is respectfully reininded that all impacts, including but not limited to, bridging, fill, excavation and clearitlg, and rip rap to jurisdictioual wetlailds, streams, and riparia» buffers need to be included in the fina] impact calculations. These ii��pacts, in addition to any construction impacts, temporaiy or otherwise, also need to be included as part of the 401 Water Quality Certification Application. 6. Wl�enever possible, the NCDWR prefers spanning sh-uctures. Spanning sh-uctures usually do not require work within tl�e sh•eam or gnlbbing of tl�e streail�banks aud do »ot require streaill chamlel reali�lment. The horizontal and vertical clearances provided by bridges shall allow for human and wildlife passage beneath the sh-ucture. Fish p�ssage and ilavigation by canoeists and bo�ters shall not be blocked. Bridge supports (bents) should not be placed in the stream when possiUle. 7. Sediment and erosion control measures should not be placed in wetlands or streams. 8. Boi7•ow/waste areas should avoid wetlands to the maximtml extent practicaL Impacts to wetlands in borrow/waste areas will need to be preseilted in the 401 Water Quality Certification and coulcl precipitate compensatory mitigation. 9. The 401 Water Quality Certification application will need to specifically address the proposed methods for stonnwater managEment. More specifically, stormwater shall not be permitted to discharge directly into sh•eams or st�rface waters. To meet the requirements of NCDOT's NPDES pennit NCS000250, please refer to the most recent version of the North Carolirra Departrner�t of �Tt•nnspoNtatiorr StoN����vuter� Best Mariagernerit Practice,r Toolbm� manual for approved measures. 10. Based on the inforn��tion presented in the document, the �nagnihide of impacts to wetlands and streams m�y require a Nationwide (NW) application to the Corps of Engineers and corresponding 401 Water Quality Certification. Please be advised that a 401 Water Quality Certification requires satisfactory protection of water quality to ensure that water quality standards are met and no wetland or stream uses are lost. Final periliit authorizatioil will require the slibmittal of a formal application by the NCDOT ancl written concun•ence from the NCDWR. Please be aware that any approval will be contingent on appropriate avoidance and. minimization of wetland and streain impacts to the maximum extent practical, the development of an acceptable stot7nwater management plan, and the inclLision of appropriate mitigation pl�tns where appro�riate. 11. If concrete is used d�iring constn►ction, a dry work area shall be maintained to prevent direct contact between curing concrete and strea�r� water. Water that inadvertently contacts uncLired concrete sha11 not be discharged to surface waters due to the potei�tial for elevated pH and possible aquaric life and fish kills. Co��crete shall be handled in accordance with the NPDES Construction General Permit NCGO10000. 12. If teinporary access roads or deto�u•s are constructed, the site shall be gradecl to its preconstr�iction contoiirs and elevations. Disturbed areas shall be seecled or mulcl�ed to stabilize the soil and appropriaee native woody species shall be planted. When using temporary structures, the area sl�all be cleared but not gruUbed. Clearing the area with chain saws, mowers, b�ish-l�oas, or other mechanized equipment and leaving the sri�mps and root mat intact allows the area to re-vegetate naturally and minimizes soil disturUance. 13. Unless otherwise authorized, placement of culverts and other st�lictures in waters and streams shall be placed below tl�e elevation of the streambed by one foot for all culvei-ts with a diameter greater than 48 inches, and 20 percent of the culvert diameter fior culverts having a diameter less than 48 inches, to allow low tlow t� ���� ���,�,�..:�„�-�,�.- North Carolina Department of Environmental Quality I Division of Water Resources 512 North Salisbury Street I 1617 Mail Service Center � Raleigh, North Carolina 27699-1617 919.707.9000 passage of water and aquatic life. Design and placement of culverts and other structurzs including temporary erosion control n�easures sl�all not be conducted in a manner tl�at may result in dis-equilibriuin of wetlands or sh-eainbeds or bai�]<s, adjacent to ar upstream aud downsn•eam of the above sn•uctures. Tl�e applicant is required to provide evidence that the equilibriun� is being maintained ifrequested in writing by the NCDWR. If this condition is unable to be inet due to bedrock or othe�r limiti��g features encountered during construction, please contact the NCDWR for guidance on how to proceed and to detei-�liine whether or not a pernlit modification will be required. 14. If multiple pipes or barrels are re�quired, they shall be desigt�ed to mimic nahu-al strea��� cross section as closely as possible including pipes or ba�-�-els at flood plain elevation, floodplain beilcl�es, atld/or sills may be required where appi•opriate. Widening the stream cl�annel should be avoided. Stream cham�el widening at the inlet or outlet end of shlictures typically decreases water velocity cati�sing sedime�nt deposition that requires inereased maintenauce and disi�pts aquatic life }�assage. 15. If foundation test borings arE necessaiy; it shall be noted in the document. Geotechnical work is a��proved tuider General 401 Certification Number 4085/Nationwide Permit No. 6 for Survey Activities. 16. Sediment and erosion control measures sufficient to protect water resources must be implemented and maintained in accordance with the most recent version of North Carolina Sediment and Erosiou Couh•ol Planiling and Desib Manual and the inost recent version of NCS000250. 17. All worlc in or adjacent to streanl waters sha1L be conducted in a dry work area. Approved BMP nleasures from fl1e most ciu•rent version of the NCDOT Construction and Maintenance Activities inanLlal such as sandUags, rock berms, cofferdams and ofller diversion structures shall be used to prevent excavation in flowing water. 18. Heavy equipment should be operated fi•om the banlc rather than in stream channels in order to minimize sedimentation and reduce the lil<Elihood of inh-oducing other pollutants into sh•eams. This eqLiipn�e;nt sh�ll be inspected daily and inaintained to prevEnt contamination of stu�facE waters from le�king fuels, lubricants, hydraulic fluids, or other toxic matErials. 19. Riprap shall not be placed in flie active thalweg channel or placed in the streaillbed in a n7anner that precludes aquatic life passage. Bioengineering boulders or structures should be properly designed, sized and installed. 20. Riparian vegetation (native trees and shi�ibs) shall be preserved to the maximum extent possible. Riparian vegetation m�ist be reestablished witlun the construction limits of the project by the end of the growing season following completion of constr�iction.
