Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Stream is conveyed to the site by concrete pipe. Buffer begins at outlet. Stormwater treatment
for the new impervious substrate placed onsite will be treated in accordance with the Town of
CM's Stormwater Ordinance
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,

Attach a vicinity map clearly showing the location of the property with respect to local

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Stream is conveyed to the site by concrete pipe. Buffer begins at outlet. Stormwater treatment
for the new impervious substrate placed onsite will be treated in accordance with the Town of
CM's Stormwater Ordinance
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

Dear Ms. Karoly:
In response to the Certified Mail Return Receipt Request letter dated September 26, 2005
and received by Mr. Jay Gileece, I am providing the following:
1. Please show all buffer impacts on the site plan.
All buffer impacts are indicated. Total impacts to the buffer are 12,845 square
feet (Zone 16,114 sf and Zone 2 6,731 sf).
2. Please indicate proposed commercial building layout as overlays on the site
plan.
The proposed building footprints are indicated in addition to the impervious
area required for the parking lots.
3. Please specify the percent of project imperviousness area based on the
estimated built-out conditions.
Lots 1 and 2 (2.2871 acres) of the subject property shall not exceed 70%
impervious.
4. Please indicate all stormwater outfalls on the site plan.
All stormwater outfalls are indicated.
5. Please indicate the diffuse flow provision measures on the site plan, including
worksheets for facilities such as level spreaders.
Lot 3 has been constructed as per Cary Stormwater Regulations to provide
stormwater treatment and retention for the stormwater generated by the new
impervious on Lots 1 and 2.
6. Is it possible to shift the road alignment to the east in order to place the road
crossing over an existing culvert? If not, please describe the constraint on the
corridor adjacent to Cary Parkway.
Every attempt was made to minimize the impact to the buffer. Cary
streetscape requires a fifty (50) foot sight buffer to be placed adjacent to the
property along the Cary Parkway forcing the alignment into the displayed
configuration.
In addition, native species of trees will be planted along the impact slope of the road
crossing, used depending upon availability from the following list:
River birch (Betula nigra)
Black willow (Salix nigra)
Willow oak (Quercus phellos)

On September 14, 2005, the Division of Water Quality (DWQ) received your application dated
September 12, 2005, to impact 100 feet of streams, 6,011 square feet of Zone 1 Neuse River
basin riparian buffers and 7,250 square feet of Zone 2 Neuse River basin riparian buffers to
construct the proposed commercial site. This application was placed on hold with our letter of
September 25, 2005. Your consultant (Mr. Steve Mitchell) responded to that letter on October
18, 2005 (received in the Division on October 20, 2005). On October 25, 2005, the Division
again asked for additional information since the October 18 response did not address all of the
issues raised in our September 25 letter. On November 2, 2005, we received an email from Mr.
Mitchell that still does not answer the issues raised in our September 25 and October 25 letters.
The DWQ has determined that your application is still incomplete and/or provided inaccurate
information as discussed below. Therefore we are returning your application as incomplete and
will require you to reapply and pay an additional 401 Certification fee for this approval. With
that new submittal, please be sure that all the issues raised in our September and October letters
are clearly addressed. The issues in our October 25 letter that are still outstanding are repeated
below so you can more efficiently address them in your next submittal.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts

Stream is conveyed to the site by concrete pipe. Buffer begins at outlet. Stormwater treatment

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Stream is conveyed to the site by concrete pipe. Buffer begins at outlet. Stormwater treatment
for the new impervious substrate placed onsite will be treated in accordance with the Town of
CM's Stormwater Ordinance
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

On September 14, 2005, the Division of Water Quality (DWQ) received your application dated
September 12, 2005, to impact 100 feet of streams, 6,011 square feet of Zone 1 Neuse River
basin riparian buffers and 7,250 square feet of Zone 2 Neuse River basin riparian buffers to
construct the proposed commercial site. This application was placed on hold with our letter of
September 25, 2005. Your consultant (Mr. Steve Mitchell) responded to that letter on October
18, 2005 (received in the Division on October 20, 2005). On October 25, 2005, the Division
again asked for additional information since the October 18 response did not address all of the
issues raised in our September 25 letter. On November 2, 2005, we received an email from Mr.
Mitchell that still does not answer the issues raised in our September 25 and October 25 letters.
The DWQ has determined that your application is still incomplete and/or provided inaccurate
information as discussed below. Therefore we are returning your application as incomplete and
will require you to reapply and pay an additional 401 Certification fee for this approval. With
that new submittal, please be sure that all the issues raised in our September and October letters
are clearly addressed. The issues in our October 25 letter that are still outstanding are repeated
below so you can more efficiently address them in your next submittal.
Additional Information Requested in our September and October letters:
1. Please specify the percent of project imperviousness area based on the estimated built-out
conditions.
2. Please indicate all stormwater outfalls on the site plan.
3. Please indicate the diffuse flow provision measures on the site plan, including worksheets

to move toward denial of your application as required by 15A NCAC 211.0506 and will place
this project on hold as incomplete until we receive this additional information. Please provide
the following information so that we may continue to review your project.
Additional Information Requested:

Dear Mr. Gileece:
On September 14, 2005, the Division of Water Quality (DWQ) received your application dated
September 12, 2005, to impact 100 feet of streams, 6,011 square feet of Zone 1 Neuse River
basin riparian buffers and 7,250 square feet of Zone 2 Neuse River basin riparian buffers to
construct the proposed commercial site. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. The DWQ will require
additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive the additional information
requested below, we will have to move toward denial of your application as required by 15A
NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional
information. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. Please show all buffer impacts on the site plan.
2. Please indicate proposed commercial building layout as overlays on the site plan, and
describe the type of facilities proposed.
Please specify the percent of project imperviousness area based on the estimated built-out
conditions.
4. Please indicate all stormwater outfalls on the site plan.
5. Please indicate the diffuse flow provision measures on the site plan, including worksheets
for facilities such as level spreaders.

6. Is it possible to shift the road alignment to the east in order to place the road crossing
over an existing culvert? If not, please describe the constraints on the corridor adjacent to
Cary Parkway.
Please respond within three weeks of the date of this letter by sending this information to me in
writing and Eric Kulz of the DWQ Raleigh Regional Office. If we do not hear from you within
three weeks, we will assume that you no longer want to pursue this project and we will consider
the project as withdrawn.
