Your application for a 401 Water Quality Certification was received in the Central Office on July 20, 2006. According to our
rules [15A NCAC 2H .0507 (A)], if final action is not taken within 60 days, the Certification is waived unless DWQ has
objected in writing to your application. Therefore, DWQ has waived the requirement for a 401 Water Quality Certification for
your plans to shade 0.0025 acres of vegetated wetland-coastal wetland to construct an elevated walkway, dredge 0.904 acres of
non-vegetated wetland-shallow bottom/estuarine and public trust water of a canal and channel, fill 0.2569 acres of non-

PROJECT SITE DESCRIPTION
The applicant's property is located off Tower Lane, a recently paved street, adjacent to the water
tower on Colington Road, in Dare County. The road is also the entrance to Carlyle on the Sound, a
newly platted 73 lot residential subdivision. Access to the property is via a dirt road off Shingle
Landing Road within the subdivision. While the formal address of the property is listed as 200
Tower Road, recent changes to the road system have not been addressed by Dare County at this
time. Structures on the property include a single-family dwelling, a small pile supported storage
building, a gravity feed septic system, 375' of bulkhead, and a small dock.
Carlyle on the Sound was purchased and developed from three parcels, part of which was divided
out of the Bramble tract. Currently the Bramble tract consists of 39.4 acres fronting on the
Albemarle Sound and a small unnamed canal off of the Sound. The shoreline of the property begins
at the southeast corner following along the Albemarle Sound for approximately 1,682', curving
around a peninsula and running in an easterly direction up the canal approximately 852' to its
approximate end through a Coastal Wetland, and back around in a westerly direction for
approximately 835' along the northern bank of the canal, terminating at a bulkhead in Colington
Harbour Subdivision, at the northwest corner at the mouth of the canal. The average depth in -the
canal is approximately 2' below NWL. A small amount of submerged aquatic vegetation (widgeon
grass and milfoil) was found within the basin at the mouth of the canal. The canal formed by the
tributary is completely within the Bramble property running in an east to west alignment forming a
peninsula on the south side of the tract abutting the Albemarle Sound. The north side of the Bramble
property abuts the Carlyle on the Sound.
Mr. Bramble's property has a total of approximately 3,500 linear feet of estuarine shoreline along
the Albemarle Sound and the canal, with 375' of existing bulkhead along the Sound adjacent to an
existing residence. No other shoreline control structures are located on the applicant's property.
Beginning at the mouth of the canal and traveling along the shoreline in an easterly direction, along
the sound, there is evidence of extensive erosion forming a one to two-foot escarpment that drops
from a heavily vegetated shoreline to a sandy beach littered with downed trees. Upland vegetation
includes, but is not limited to, loblolly pine (Pinus taeda), live oak (Quercus virginiana), diamond
leaf oak (Quercus laurifolia), red bay (Persea borbonia), sweetgum (Liquidambar styraciflua),
catbrier (Smilax glauca), wax myrtle (Myrica. cerifera), groundsel tree (Baccharis haliinifolia),
switch cane (Arundinaria gigantea), poison ivy (Toxicodendron radicans), Virginia creeper
(Parthenocissus quinquefolia), and false nettle (Boehrneria cylindrical).
The shoreline along the canal is primarily wooded with some Coastal and Section 404 Wetlands
intermixed. The northwest end of the canal shoreline opens into a Coastal Wetland that transitions to a
high ground berm along the canals edge created from dredge spoil prior to the implementation of
regulations limiting the placement of such spoil material.
Along the south side of the canal the shoreline transitions from a high ground berm to a low area that
forms clear hydrological connection from the canal to a Coastal Wetland. Located on the south side of
the peninsula this Coastal Wetland area opens, through a less well-defined connection, to the Albemarle
Sound.

The center of the peninsula and the eastern section of the property located on the east side of the
access to the property is vegetated with a variety of Coastal and Section 404 Wetland vegetation
including, but not limited to, saltgrass (Distichlis spicata), salt meadow hay (Spartina patens),
cattail (Typha spp.), giant cord grass (Spartina cynosuroides), sawgrass (Cladium janiaicense),
bulrush (Scirpus spp.), black needlerush (Juncus roemerianus), soft rush (Juncus effusus), sedge
(Carex spp.), spikerush (Eleocaris spp.), and sea oxeye (Borrichia frutescens). See the enclosed
site plan for wetland locations.
The Albemarle Sound, and its tributaries adjacent to the applicant's property are classified as
coastal waters by agreement between the Marine Fisheries Commission and Wildlife Resource
Commission. The Division of Environmental Management's water quality classification for
Albemarle Sound, at the location in question, is SA (shell fishing). Additional review indicates
that there are no unusual geological formations associated with the applicant's property. While
several archeological sites have been identified on Colington Island, staff does not know of any
identified sites within the immediate vicinity of the applicant's property.
Previous permits issued for development on the property include: 1) USACE Nationwide #14
Action ID 2005510744 on April 19, 2005, 2) NCDWQ Water Quality Certification #05-0431 on
April 11, 2005, and, 3) NC DCM CAMA Major Permit #193-89 on October 24, 1989. Copies of
the referenced permits are enclosed in the application packet.
CAMA Major Permit #193-89 was issued for the construction of a bulkhead and dredging part of
the canal and a section of channel. Originally the dredge portion of the permit included a 100' x
50' area within the basin and 450' of channel. The permit was modified later to include additional
dredging totaling 650' (not including the basin).
PROJECT DESCRIPTION
The applicant Toby Bramble proposes to dredge 880' of existing channel and canal, excavate high
ground to create two boat slips and set pilings for three additional slips within the existing basin,
construct a walkway and pedestrian bridge over a small tributary at the end of the canal, and
bulkhead, riprap breakwater the entire shoreline of his property. An existing dock located within
the basin will be removed. The following is a complete breakdown of the proposed development
activity on the Bramble property:
I. SHORELINE STABILIAZATION
The applicant has approximately 3,500 linear feet of shoreline along the Albemarle Sound
and a canal, most of which will be stabilized with the following methods.
a. Riprap: Three sections of shoreline are designated as having riprap.
1) The first begins on the southeast corner along the Albemarle Sound the applicant
proposes to install 388' linear feet (LF) of rock riprap with an 8' base width.
According to the drawings approximately 5' of the base will be placed below normal
water level (NWL).

2) The second location being proposed is around a small section of Coastal Wetlands
along the Sound on the south side of the peninsula waterward of the proposed
bulkhead. A small patch of Juncus and a large live oak are being eroded, and the
applicant would like to preserve them by placing 73' of riprap around the vegetation.
The riprap will be placed at NWL and extend 8' waterward of NWL.
Riprap Fill:
73' x 8' = 484sf Shallow Bottom/ Estuarine Water Fill
3) The third location is a 116' section beginning at the northeast corner of the shoreline
near the mouth of the canal, adjacent to Colington Harbour Subdivision. The riprap
will have a base width of 8' with approximately 5' of the base below NWL. This
section will tie into an existing bulkhead at Colington Harbour.

Total impacts from riprap fill from 1,2,and 3 above are as follows:

b. Bulkhead: Approximately 1,863' of the applicant's shoreline would be bulkheaded under
the proposal submitted. The total length will comprise of four sections of vinyl bulkhead
as follows.
1) The first section of bulkhead being proposed will begin with a 10' return wall at the
end of the first section of riprap along the Albemarle Sound and extend 406' and tie
into the east side of the existing 357' bulkhead in front of the residence and will be
constructed at NWL and landward of a small area of Coastal Wetlands. High ground
disturbance to install tiebacks and grade associated backfill is addressed on page 8.
2) The second section will be 673' long and begin on the west side of the existing
bulkhead on the Sound, and follow along the shoreline to the west, around the mouth
of the canal and terminate at a 75' opening that connects to an adjacent Coastal
Wetland. The proposed bulkhead will be constructed at NWL along the mouth of, and
in the canal, and an average 2' waterward of NWL for the whole alignment. No
backfill is proposed in conjunction with the interior of the canal along this alignment.

The area along the Sound, as previously noted, has sustained severe erosion over the
past several years resulting in the felling of numerous trees along the shoreline that
must be removed prior to installing the proposed bulkhead. This section of bulkhead,
as proposed, will cross two small openings approximately 8' and 10' wide where
overwash also feeds the adjacent Coastal Wetland noted above. This opening
provides minimal hydrology during heavy (non-tropical) storm events. The primary
hydrological connection is on the north side of the peninsula in the canal. There are
two areas noted on the plans as Reclamation Area #1 and Reclamation Area #2 in and
adjacent to the Sound. The bulkhead along Reclamation Area 41 will be an average of
approximately 24.93' waterward of NWL for a distance of 250', and the average
water depth within the fill area is 0.5'. The bulkhead along Reclamation Area #2 will
be an average of approximately 10' waterward of NWL for a distance of 200', and the
average water depth within the fill area is 0.5'.

It is anticipated that there will be approximately 18,630sf of high ground disturbance
in association with the bulkhead installations.
3. A third section of bulkhead is proposed on the north side of the house in the basin and
canal. Beginning at the east end of a slotted breakwater (addressed below) in the
canal the applicant proposes to install a 196' bulkhead that will extend around the
basin to a Coastal Wetland adjacent to the small tributary feeding into the canal. The
bulkhead will parallel the coastal Wetlands along the tributary for approximately 40'
and terminate. As proposed this bulkhead will be constructed at NWL with no
proposed backfill. A proposed elevated walkway will be constructed over the
bulkhead and in the canal if approved.
4. The fourth and final section of bulkhead will be constructed on the north side of the
canal beginning at a proposed pedestrian bridge (See Page 7) and run in a westerly
direction and terminate at a return wall at the proposed riprap alignment described in
subsection 3. On page four of this report, for a total of 588'. The bulkhead will be
constructed as close to NWL as possible and will not include any back fill. There is
little to no evidence of erosion along the north shore of the canal where this bulkhead
is being proposed.
Breakwater: The development proposal includes the construction of a 344' slotted vinyl
breakwater along the south side of the canal beginning on the east side of the 75' opening
that connects to an adjacent Coastal Wetland (See Subsection b.2. on Page 4), and
following along the shoreline at NWL and terminating at the west comer of the basin
directly behind the house. Access to the shoreline during construction will be from the
water. The land adjacent to the proposed breakwater is a mix of high ground and Section
404 Wetlands. No back fill is proposed in conjunction with the breakwater.

II. DREDGING
The applicant is proposing to dredge an area 650' x 50' within the canal and basin
and a 230'x 30' channel into the Albemarle Sound to a depth of four feet below
NWL. The total length of the proposed dredge alignment will be 880'. According to
the application the area to be dredged will be in line with a previously approved
alignment under CAMA Major permit # 193-89. Review of the permit and permit
modifications indicates that the length requested was 650', not 880', but a comparison
of the drawing and aerial photography revealed that the proposed alignment closely
approximates the alignment shown in the drawing submitted and approved for the
original permit and modification. However, the width of the proposed channel does
not appear to be consistent with the dimensions previously requested and approved.
The channel widths requested and approved were 20' in the channel and canal.
In addition to maintenance dredging, the applicant would like to excavate 1,989sf of
high ground adjacent to the basin on the north side of the canal for two 40' x 14'
stern-to boat slips. The approximate area will be 120' x 16.5' (ave.) and will be
excavated to a depth of 4' below NWL. The average existing grade is approximately
3' above NWL within the area to be dredged is approximately. Material removed
from this site will be placed in an above ground retention area to be addressed below.

According to the application it is estimated that the total amount of material to be
hydraulically dredged will be 2,963cy. For the purpose of calculating dredge spoil
total this higher amount will be used.
As reflected in the second set of calculations above, a 728sf area of shoaling has
occurred within the canal and will be dredged bringing the total of clamshell and
hydraulic dredge material up to approximately 3,533cy.
III. SPOIL SITES
The applicant proposes to use a hydraulic dredge and a clamshell dredge at the site.

material. The retention areas will be excavated to a depth of three feet below grade
with a two-foot high berm five feet wide around the perimeter. A two-foot freeboard
will be maintained around each spoil site to prevent material from leaving the site. A
silt fence will be placed around the perimeter of each retention area for added
precaution. Retention Area #1 interior dimensions will be approximately 4,160sf, and
the interior dimensions of Retention Area #2 will be approximately 3,040sf.
Excavated material will be used to create the berm around the excavated spoil sites
and to backfill the reclamation areas behind the proposed bulkheads along the
Albemarle Sound. Dredge spoil will also be used in the back fill process as needed,
with the remaining material to be trucked off site.

The total given does not take into account the amount of water that will entrain the
spoil material being removed. Based on this it is anticipated that the total amount of
water and solids entering the spoil retention site will be double. Based on this
assumption it is anticipated that each site will be filled four times. Some of this
material, once decanted, will be placed behind the proposed bulkhead with the
remaining material being trucked off site.
IV. WALKWAY, PEDESTRIAN BRIDGE, FINGER PIERS & MOORING PILINGS
The total length of the proposed structure will be 296', and of that 266' will be a
walkway, and 30' will be a pedestrian bridge. The walkway will wrap around the
basin to the east, cross a small tidal creek, Coastal and Section 404 Wetlands and high
ground to access a total of five boat slips with a total of eleven mooring pilings and
two 12' long finger piers 3'-0" wide at the shoreline and tapering to a width of P-0".
The walkway will be 6' wide and a small area will extend over the water. Estimated
impacts from shading are as follows.
Walkway over High Ground: 1,282sf
Finger Piers (Over Estuarine and Public Trust Water): 48sf

Five boat slips are proposed within the project area. Three 24' x 14' slips are to be
located at the south end of the basin adjacent to the two proposed finger piers, and
two stern-to slips 40' x 14' will be placed in the area to be excavated on the north side
of the canal.
V. In addition to the disturbance listed in the previous sections it is anticipated that an
additional 7,397sf of grading and incidental fill will be undertaken at the proposed
bulkhead installations along the Albemarle Sound.
Grading and Fill:
406' x 18' (approx.) = 7,397sf High Ground Disturbance
ANTICIPATED IMPACTS
• Localized turbidity is anticipated during installation of the bulkheads and during
excavation and dredging.
• The loss of 11,217sf of sandy shallow water bottom and Estuarine and Public Trust
Water.
• Shading of 110'sf of Coastal Wetlands.
• Shading of 678sf of shallow water bottom and the loss of navigation due to the
construction of a small area of dock and finger piers.
• Creation of 2,717sf of shallow bottom, and Estuarine and Public Trust waters, from the
excavation of high ground for two boat slips and the removal of a small sandy shoal
within the canal.
• The disturbance of 39,400sf of water bottom during the dredging of the canal and
channel.
• Temporary impacts to adjacent wetlands during construction of bulkheads and
breakwater.
• New habitat created by the placement of riprap below NWL.
• Increased intensity of use based on the number of boat slips being created may result in
secondary impacts to the adjacent water body from oils and trash associated with
recreational uses.

The subject property is located on Tower Lane, a currently gravel and dirt road on the south
side of Colington Road beside the Dare County Water Tower on Colington Island. The property
is a 39.4 acre parcel that has been recently been separated from a previously larger tract that is
being developed into a residential subdivision. The subject property is and has historically been
owned by the Bramble family. The property front on the Albemarle Sound and includes the
Bramble homestead. It is the intention of the family to preserve the remainder of their property.
This would include some water dependent improvements. No additional upland development is
proposed at this time. Included on the property are uplands, wetlands (Section 404 and
coastal), a canal and small boat basin. Section 404 wetlands have been delineated by Quible
and confirmed by USACE on 8-17-04. Since the subject property was part of a larger tract that
is currently being developed as a residential subdivision, it was necessary to receive a USACE
Nationwide #14 Permit and 401 Water Quality Certification for roadway impacts to Section 404
wetlands. These permits include driveway improvement leading to the Bramble homestead,
where retaining walls and driveway fill and surfacing are currently taking place outside AEC's.
The subject property has received CAMA Permits and renewals under 193-89 (enclosed) for
maintenance dredging and shoreline stabilization. The CAMA Permit has since expired. The
proposed work includes maintenance dredging to the previously permitted depth of -4 ft. The
material will be hydraulically dredged and clamshell excavated by a local dredge service. On
the current site plan and application, there are two hydraulic dredge soil retention areas
indicated, both of which are outside of the 30 ft vegetative buffer. There is also a designated
clamshell dredge spoil staging location. We have met representatives from Cape Dredging to
discuss and plan the logistics behind getting this job completed. The best and most efficient
way to complete the work is to perform a combination hydraulic dredge and clamshell
operation. As shown on the site plan, the clamshell operation via barge will occur inside the
canal after completion of the hydraulic dredging connecting to the 4 ft water depth contour. See
also, the new cross-section of the hydraulic dredge retention areas. The two dredge retention
areas will be excavated to create bowl-like earthen structures down to 3 ft below existing grade.
Excavated material will be used to construct a berm around the perimeter that will be
approximately 1 ft above existing grade. The additional material from creation of the retention
areas will be directly used for bulkhead backfill. For hydraulic dredging, berms will be
constructed with an influent and effluent pipe for the dredge slurry. On the site plan, influent
pipes are depicted on the Albemarle Sound side of the berm. If during the hydraulic dredge
procedure it is found that placement of the influent pipes inside the canal is more efficient,
placement will be adjusted as needed. The clamshell dredge material from inside the canal will
be transported from small barge to a dump truck that will be backed up near the small existing
dock. See truck route to and from canal identified on the site plan. The material will
immediately be transported to the dredge material stockpile location that is now indicated on the
site plan. This application also proposes excavation of highground in the boat basin area for
two side-to slips, and the creation of three additional stern-to slips. The stern-to slips (1-3) are
proposed to be 14 ft x 24 ft and include two triangular finger piers. The side-to slips are
proposed to be 14 ft x 40 ft for safe maneuvering. These slips do not include any excavation or
disturbance to wetlands. There is an existing dilapidated dock shown on the site plan that will
be removed prior to any proposed improvements. Shoreline stabilization is proposed in this
application and includes a total of 1,863 If of vinyl bulkhead, 366 If of vertical slotted sheetpile -- ?2. 4t
for areas within the canal and basin that are adjacent to wetlands, and 577 If of granitic rip-rap.

Construction of the bulkhead will be strategically timed to coincide with the dredge activity.
Therefore, suitable (sand dominated) dredge material can be used for bulkhead backfill as it
dries out instead of having to stockpile. This is a cost-efficient approach that is commonly
employed to avoid "double-handling" of material when possible. A cross-section of the
proposed vertical sheetpile/breakwater design is included on the site plan. This design has
been provided and is endorsed by UNC Sea Grant. This is essentially a free-standing bulkhead
structure with piles, whalers and sheathing with gaps so that the hydrologic connection is not
lost. There is a location along the canal where DCM has identified a coastal wetland
connection to a significant interior area of coastal wetlands. In this location, there will be no
stabilization structures proposed to maintain this connection (See "open area" designation on
the site plan). There are two proposed reclamation areas where the shoreline has significantly
eroded in recent years and erosion escarpments have formed. In this area, many mature trees
have been lost due to this erosion and the applicant simply wants to preserve the integrity of his
property. The downed trees will be cut and carried out of this area prior to any shoreline
stabilization and fill. Reclamation Area 1 is 6,233 sq ft and Reclamation Area 2 is 1,992 sq ft.
Bulkhead is proposed at the waterward edge of the proposed reclamation areas. For
reclamation Area 1, the average distance is 20 ft and the maximum is 37 ft. For reclamation
Area 2, the average distance is 9 ft and the maximum is 12 ft. The bulkhead will be backfilled
with sand material from maintenance dredging. The material from the canal is sand dominated
from the outer third to the existing connecting depth of -4 ft. The inside of the canal is silt
dominated and will not be used for bulkhead backfill except for where the material is dominated
by sand. The enclosed photographs include existing conditions as well as depictions of
permitted hydraulic dredge events from the past. Also proposed is a 308 If x 6 ft wide water
dependent walkway in the basin area. Where the walkway crosses wetland or tidal creek, the
pile supports will raise the decking a minimum of three ft above normal water level.
This revised application package (site plan and MP forms) has specifically addressed
deficiencies identified by DCM from written correspondences and from meetings.
