APPROVAL OF STORMWATER MANAGEMENT PLAN
Dear Mr. McNeely:
On December 16, 2005, the Division of Water Quality (DWQ) received the revised storm water
management plan prepared by your engineer, Mr. Lee Kizer, of Western Piedmont Community College.
This Plan has been reviewed and satisfies the storm water management conditions of the 401 Water
Quality Certification issued on January 3, 2095.
The structural storm water practices as approved by DWQ as well as drainage patterns must be
maintained in perpetuity. No changes to the structural storm water practices shall be made without
written authorization from the Division of Water Quality. Storm water easements shall be recorded for a
distance of at least 10 feet on each side of all storm water conveyances on all lots containing these
structures including future access for maintenance. The storm water easements shall allow for the ability
to maintain the structures, perform corrective actions as described above and shall provide protection of
the structures from potential alternations by future property owners.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Please provide the percent of impervious area for the project.
Response
According to the original site plan for the Continuing Education Center, the project site
consists of approximately 3.0 acres (incorrectly reported as 2.5 acres in my transmittal to
you on November 28). With a total project area of 197 acres, this represents 1.5 percent
of impervious surface.
Request
Please provide a copy of the Sedimentation and Erosion Control Plan approval for the
project.

Response
According to our architect who was the lead designer for the project, no PCN was
submitted for the project since the location of the project did not involve any wetlands,
buffer areas or other criteria that would have required the filing of a PCN.

In attempt to further clarify the request, I will once again provide a basic project
description:
WPCC has a main campus and an East Campus (built in 2003) that is separated by
Hunting Creek in Burke County. A map that shows the location of the two campuses is
included as Exhibit B. The College wishes to install two eight-foot diameter culverts in
Hunting Creek at the location shown on Exhibit B. The purpose of the culverts is to
provide access for maintenance vehicles that must travel between the two campus
locations. The area that is to be impacted by the construction of the culverts consists of
less than 0.1 acres. The plans and specifications for the culverts, including a cross section
and profile that shows the design provides for the passage of aquatic life have been sent
to you previously. No other development, construction or any other land disturbing
activity is involved with this project. We are simply requesting permission to install two
culverts.
Again, I trust the above responses and enclosed drawings provide the necessary
information required to obtain the permit to install the culverts. If however, you should
need additional information or have any questions, please feel free to contact me.

This office has reviewed the erosion and sedimentation control plan submitted for the project listed below. We
find the plan to be acceptable and hereby issue this Letter of Approval. Please be advised that Title 15A, North
Carolina Administrative Code 4B.001 7(a), requires that a copy of the approved soil erosion control plan be on
file at the job site. Also, you should consider this letter to give the Notice required by NCGS S 113A-61(d) of our
right of periodic inspection to ensure compliance with the approved plan. This plan approval shall expire three
(3) years following the date of approval, if no land-disturbing activity has been undertaken, as is required by Title
15A NCAC 48.0029.
The State's Sedimentation Pollution Control Program is a performance-oriented program requiring protection of
the natural resources and adjoining properties. If, following commencement of this project, it is determined that
the plan is inadequate to meet the requirements of NCGS §113A-51 to 66, this office may require revisions to
the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of
this plan is conditioned upon your compliance with federal and state water quality laws, regulations, and rules.
In addition, local city or county ordinances or rules may also apply to this land-disturbing activity. This approval
does not supersede any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided in the Financial
Responsibility Form which you have provided. You are requested to file an amended form if there is any change
in the information included on the form. Title 15A NCAC 46.0127(c) amended July 1, 2000, states: No person
shall initiate a land-disturbing activity before notifying the agency that issued the plan approval of the date
that the land-disturbing activity will begin. Thank you for your cooperation.

The following is WPCC's response to your request via FAX on 10/17/2005 for additional
information regarding our permit application to install two (2) eight-foot diameter
culverts on Hunting Creek in Burke County.
Request
Please provide cross section details showing the provisions for aquatic life passage.
Response
The cross section of the proposed culverts and a longitudinal profile are shown on
drawing #2 enclosed. The installation of the culverts will restore the stream channel to
it's previous condition and allow for lower velocities along the reach and a clay/silt
bottom that is consistent with the natural conditions that exist in Hunting Creek.
Request
Please provide detail for the storm water management practices as required by GC 3402.
Response
The proposed culvert will access the WPCC East Campus, which consists of 189 +- acres
of undeveloped farm land and a 3.73 acre tract that contains our new Continuing
Education Center. A storm water management detail and sedimentation and erosion
control plan for the Continuing Education Center was submitted to NCDENR and
approved in 2003 as part of the construction drawings submittal for the project. A copy of
the storm water management detail is included for your review (drawing #5).

Request
Please specify the percent of imperviousness area based on the estimated built-out
conditions.
Response
The 3.73 acre tract that contains the Continuing Education Center has approximately 2.5
acres of impervious surface. Assuming a 1" rainfall and a runoff coefficient of 0.9,
approximately 0.1875 acre*feet of runoff would be expected, an increase of 0.125 acre*ft
over the pre-construction open grass surface. All of the runoff is diverted to a single rip-
rap lined outlet as shown on drawing #5, and then to level overland flow, eventually to a
1.3 acre pond as shown on drawing #6. Due to the configuration of the stormwater
system, the location of the pond, and the large area below the pond, there will be
absolutely no adverse impact on Hunting Creek or any of it's tributaries as a result of the
installation of the culverts.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. McNeely:
You have our approval, in accordance with the attached conditions and those listed
below, to place fill within or otherwise impact 12 feet of streams for the purpose of a
culvert crossing at the subject property, as described within your application received by
the N.C. Division of Water Quality (DWQ) on November 30, 2004. After reviewing your
application, we have decided that the impacts are covered by General Water Quality
Certification Number(s) 3404 (GC3404). The Certification(s) allows you to use
Nationwide Permit(s) 14 when issued by the US Army Corps of Engineers (USACE). In
addition, you should obtain or otherwise comply with any other required federal, state or
local permits before you go ahead with your project including (but not limited to) Erosion
and Sediment Control, Non-discharge, and stormwater regulations. Also, this
approval to proceed with your proposed impacts or to conduct impacts to waters
as depicted in your application shall expire upon expiration of the 404 or CAMA
Permit.
This approval is for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new
application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all
conditions. If total fills for this project (now or in the future) exceed one acre of wetland
or 150 linear feet of stream, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in
the attached certification and any additional conditions listed below.

1. Impacts Approved
The following impacts are hereby approved as long as all of the other specific
and general conditions of this Certification (or Isolated Wetland Permit) are met.

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all
specifications governing the proper design, installation and operation and
maintenance of such Best Management Practices in order to protect surface
waters standards:
a. The erosion and sediment control measures for the project must be
designed, installed, operated, and maintained in accordance with the most
recent version of the North Carolina Sediment and Erosion Control Planning
and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and
erosion control measures must be such that they equal, or exceed, the
requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on
all construction sites, borrow sites, and waste pile (spoil) projects, including
contractor-owned or leased borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be
designed, installed, operated, and maintained in accordance with the most
recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the
reclamation in accordance with the requirements of the Sedimentation
Pollution Control Act.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian
areas beyond the footprint of the impacts depicted in the Pre-Construction
Notification. All construction activities, including the design, installation, operation,
and maintenance of sediment and erosion control Best Management Practices,
shall be performed so that no violations of state water quality standards, statutes,
or rules occur.

4. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters
to the maximum extent practicable. If placement of sediment and erosion control
devices in wetlands and waters is unavoidable, they shall be removed and the
natural grade restored within six months of the date that the Division of Land
Resources has released the project.
5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification
or applicable Buffer Rules, and any subsequent modifications, the applicant is
required to return the attached certificate of completion to the 401/Wetlands Unit,
North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC,
27699-1650.
6. Diffuse Flow
All constructed stormwater conveyance outlets shall be directed and maintained
as diffuse flow at non-erosive velocities through the protected stream buffers
such that it will not re-concentrate before discharging into a stream. If this is not
possible, it may be necessary to provide stormwater facilities that are considered
to remove nitrogen. This may require additional approval from this Office.
7. Written Stormwater Management Plan
Written stormwater management plans must be implemented and the stormwater
management facilities shall be constructed and operational before any
permanent building is occupied at the subject site. The structural stormwater
practices as well as drainage patterns must be maintained in perpetuity. No
changes to the structural stormwater practices shall be made without written
authorization from the Division of Water Quality.
8. Turbidity Standard
The turbidity standard of 50 NTUs (Nephelometric Turbidity Units) shall not be
exceeded as described in 15 A NCAC 2B. .0200. Appropriate sediment and
erosion control practices must be used to meet this standard.
9. No Impacts Beyond those in Application
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or
riparian areas beyond the footprint of the impacts depicted in the Pre-
construction Notification. All construction activities, including the design,
installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water
quality standards, statutes, or rules occur.

10. Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retained
jurisdictional wetlands, waters and protective buffers in order to assure
compliance for future wetland, water and buffer impact. These mechanisms shall
be put in place prior to impacting any wetlands, waters and/or buffers approved
for impact under this Certification Approval and Authorization Certificate. A
sample deed notification can be downloaded from the 401/Wetlands Unit web
site at http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed
notification may be modified as appropriate to suit to this project.
11. Culvert Installation
Culverts required for this project shall be installed in such a manner that the
original stream profiles are not altered. Existing stream dimensions (including the
cross section dimensions, pattern, and longitudinal profile) must be maintained
above and below locations of each culvert. Culverts shall be designed and
installed to allow for aquatic life movement as well as to prevent head cutting of the
streams. If any of the existing pipes are or become perched, the appropriate
stream grade shall be re-established or, if the pipes installed in a perched manner,
the pipes shall be removed and re-installed correctly.
Culvert(s) shall not be installed in such a manner that will cause aggradation or
erosion of the stream up or down stream of the culvert(s). Existing stream
dimensions (including the cross section dimensions, pattern and longitudinal
profile) shall be maintained above and below locations of each culvert. Therefore,
you must provide plans with adequate details that indicate that the current stability
of the stream will be maintained or enhanced. You must receive written approval
from this Office for the above plans before the culvert(s) is installed. Culvert(s)
must be installed according to approved plans.
The establishment of native, woody vegetation and other soft stream bank
stabilization techniques must be used where practicable instead of rip rap or other
bank hardening methods. If rip-rap is necessary, it shall not be placed in the
stream bed, unless specifically approved by the Division of Water Quality.
Violations of any condition herein set forth may result in revocation of this Certification
and may result in criminal and/or civil penalties. The authorization to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application and
as authorized by this Certification, shall expire upon expiration of the 404 or CAMA
Permit.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing
property boundaries and development plans in relation to surrounding properties. Both
the vicinity map and site plan must include a scale and north arrow. The specific
footprints of all buildings, impervious surfaces, or other facilities must be included. If

Impact Justification (Avoidance and Minimization)

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts
to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required
when necessary to ensure that adverse effects to the aquatic environment are minimal.
Factors including size and type of proposed impact and function and relative value of the
impacted aquatic resource will be considered in determining acceptability of appropriate and
practicable mitigation as.proposed. Examples of mitigation that may be appropriate and
practicable include, but are not limited to: reducing the size of the project; establishing and
maintaining wetland and/or upland vegetated buffers to protect open waters such as streams;
and replacing losses of aquatic resource functions and values by creating, restoring,
enhancing, or preserving similar functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in
order for USACE or DWQ to consider the application complete for processing. Any
application lacking a required mitigation plan or NCWRP concurrence shall be placed on
hold as incomplete. An applicant may also choose to review the current guidelines for
stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina,
available at bttp://h2o.enr.state.nc.us/ncwetlands/stnnizide.htnil .
