You were previously issued an authorization for this project on June 2, 2005 with a revision approved on September 26, 2005. This authorization replaces the earlier authorization. In addition to this authorization, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Non-discharge regulations. This approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This Authorization replaces the one issued to you on September 26, 2005. This authorization is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. This approval requires you to follow the conditions listed below. The Additional Conditions of the Authorization are: 1. Impacts Approved The following impacts are hereby approved as long as all of the other specific and general conditions of this Authorization (or Isolated Wetland Permit) are met. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5). 3. Protective Fencing The outside buffer and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer prior to any land disturbing activities to ensure compliance with 15A NCAC 2B .0233. 4. No Impacts Beyond those in Application No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 5. Certificate of Completion Upon completion of all work approved within this authorization, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. This Authorization Certificate shall expire five (5) years from the date of this letter. This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 2B .0233. Chapman: Please accept this letter as the Town of Wake Forest's request for approval of changes to the project referenced above. In September, 2006, the Town of Wake Forest received DWQ approval to impact approximately 13,773 sf of Zone 1 and 13,905 sf of Zone 2 of the protected riparian buffers for the purpose of constructing a greenway trail at the subject property as described within our PCN application dated August 29, 2005. After several site visits with the contractor, we feel that one modification to the construction plans and PCN application is necessary to reduce impacts to the stream bank adjacent to Lot 16 of the Old Mill Stream Subdivision. The stream bank in this location is slowly undermining and is being held together by a tree stump and its roots. If the trail is built where shown on the plans then removal of this stump would be necessary and the stream bank will be jeopardized. We are requesting to shift the trail 5' away from the bank to avoid removal of this stump. As a result of this shift, an 8" diameter Sweetgum tree would have to be removed. Even though the buffer impacts will remain the same, the original application did not request tree removal in the area adjacent to Lot 16. Due to changes in our project, I have enclosed five (5) copies of a revised Pre- Construction Notification Application Form. The PCN form revisions are highlighted in yellow. These changes have been made in the application and are listed below. o Zone 1 Impact (13,773 s.f.). o Zone 2 Impact (13,905 s.f.). 0 Total Impact (27,678 s.f.). o Revised trail alignment at lots 2 and 3. Note: Revisions at Lots 2 and 3 are necessary due to topographical constraints. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Describe the existing conditions on the site and general land use in the vicinity of the project at the time of this application: The site currently has a 4' wide dirt trail that runs in close proximity to the creek edge. The dirt trail is user friendly in several areas but is impeded by ruts and graveled areas where the trial meets an existing sewer easement. The 20' wide sewer easement runs parallel with Richland Creek on the east side and in between the dirt trail and the residential structures of Old Mill Stream Subdivision Phase 1. The sewer easement is located on private property in several locations (Lots 80, 1-3, 11, 15-17) and on Town of Wake Forest property in other locations (4-8, 10). Other areas of the project site are partially wooded with areas of open space. There are several nieces of exercise equipment along the existing dirt trail as well as several pieces of playground equipment located behind Lot 16 on Town of Wake Forest property. This equipment was placed when Phase 1 of the subdivision was built. 10. Describe the overall project in detail, including the type of equipment to be used: See Attachment 11. Explain the purpose of the proposed work: The purpose of the proposed work is to build a 8-10' wide paved recreational/greenway trail that will provide an alternative means of travel and will be handicap accessible This section of greenway is part of a larger planned ;reenway system. This property (maximum of 50' from creek edge) was deeded to the Town of Wake Forest prior to the Neuse River Riparian Buffer Rules (1996) for future reg enwax use. Due to the relationship of individually privately-owned properties and the current buffer, the Town of Wake Forest is unable to place the planned trail completely out of Zone 1 of the Riparian Buffer. IV. Prior Projcct History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Future Project Plans Are any future permit requests anticipated for this project? The Town of Wake Forest is in the process of requesting funds from the North Carolina Clean Water Management Tnist Fund for stream/riparian buffer enhancement within the limits of this greenway project. This enhancement project will include stabilization of a 600 linear feet section of stream bank in the Old Mill Stream subdivision adjacent to Lot 16 (see attached map for area). If funds are approved, this project will commence no less than two years from now. The said project is part of the Richland Creek Restoration project. VI. Proposed Impacts to Waters of the United States/Waters of the State N/A It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All proposed impacts, permanent and temporary, must be listed herein, and must be clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation snap, whether or not impacts are proposed to these systems. Describe the overall project in detail, including the type of equipment to be used: The Old Mill Stream Subdivision, Phase 1, was planned and constructed in 1994. 5.77 acres (4 parcels) were deeded to the Town of Wake Forest in December 1996 for Open Space and Greenway use. These parcels of land are plated as "50 foot wide Greenway & Watercourse Buffer", "Greenway & Open Space", "Greenway & Public Sanitary Sewer Easement". When the property was deeded to the town, the town's intention was to one day, when funding would be available, to provide an accessible recreational trail for the area residents. Now that funding has become available, the town would like to deliver that promise. The Town of Wake Forest has received NCDOT Enhancement funding for the design and construction of a 10' wide, .5 mile segment of a paved recreational/greenway trail to be located adjacent to Richland Creek and the Old Mill Stream Subdivision in Wake Forest, NC. The trail use would be limited to non-motorized vehicles and pedestrians. This section of greenway trail is only one segment of a larger greenway system that is planned to tie into future greenway trails to the north and south. The Richland. Creek corridor is one of two maul greenway corridors plamied for Wake Forest. Please refer to the preliminary construction plans for the following information. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower- impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed.. If applicable, discuss construction techniques to be followed during construction to reduce impacts. There are several constraints in addition to Neuse River Riparian Rules that are limiting the flexibility of the trail location. At Lots 2 and 3, there are topography and accessibility issues. Placement of the trail on the high side (6 `above the existing trail) would require a retaining wall and railing at these locations. Another issue related to lots 2 and 3 is the removal of vegetation in order to locate the trail further away from the creek edge rather than locate the paved trail where there is already a cleared path. At Lots 11, 15 and 16, the close proximity of property lines to the creek's edge limits the proposed trail to only one location. A minimum of eight feet (8') is required for construction purposes, therefore the proposed trail is located this distance from the property line. As mentioned in Part III. Project Information (#10) the land was dedicated to the Town of Wake Forest for greenway use prior to the adoption of the Neuse River Riparian Rules. As an attempt to minimize and avoid buffer impacts, staff members met with the adjacent property owners to discuss purchasing greenway easements (more specifically - changing the usage rights of the existing sewer easement to include greenway use), but the residents did not agree to this request. In addition, the town is planning on incorporating best management practices for trail construction. The Town of Wake Forest will perform Best Management Practices (local, state, county BMP) to ensure that runoff, sediment, and construction waste do not get washed into the stream, pollute surface waters and wetlands that may be down stream Examples of these BMP's include the following: © Installation of sediment and erosion control fence. O Groundcover will be established upon completion of work. a All buffers will be maintained. o Qualified Town staff (Engineering staff) will monitor construction activity. e Require that any excavated soil be located on the site in a manner that eliminates the possibility of sediments running into the street or adjoining properties. o Require that soil piles be covered until the soil is either used or removed. o No washing of construction equipment and vehicles will be allowed adjacent to a construction site. The dirt trail is user friendly in several areas but is impeded by ruts and graveled areas where the trial meets an existing; sewer easement. The 20' wide sewer easement runs parallel with Richland Creek on the east side and in between the dirt trail and the residential structures of Old Mill Stream Subdivision Phase 1. The sewer easement is located on private property in several locations (Lots 80, 1-3, 11, 15-17) and on Town of Wake Forest property in other locations (4-8, 10). Other areas of the project site are partially wooded with areas of open space. There are several nieces of exercise equipment along the existing dirt trail as well as several pieces of playground equipment located behind Lot 16 on Town of Wake Forest property. This equipment was placed when Phase 1 of the subdivision was built. 10. Describe the overall project in detail, including the type of equipment to be used: T See Attachment 11. Explain the purpose of the proposed work: The purpose of the proposed work is to build a 8-10' wide paved recreational/g=reenway trail that will provide an alternative means of travel and will be handicap accessible. This section of greenway is part of a larger planned greenway system. This property (maximum of 50' from creek edge) was deeded to the Town of Wake Forest prior to the Neuse River Riparian Buffer Rules (1996) for future reg enway use. Due to the relationship of individually privately-owned properties and the current buffer, the Town of Wake Forest is unable to place the planned trail completely out of Zone 1 of the Riparian Buffer. Describe the overall project in detail, including the type of equipment to be used: The Old Mill Stream Subdivision, Phase 1, was planned and constructed in 1994. 5.77 acres (4 parcels) were deeded to the Town of Wake Forest in December 1996 for Open Space and Greenway use. These parcels of land are plated as "50 foot wide Greenway & Watercourse Buffer", "Greenway & Open Space", "Greenway & Public Sanitary Sewer Easement". When the property was deeded to the town, the town's intention was to one day, when funding would be available, to provide an accessible recreational trail for the area residents. Now that funding has become available, the town would like to deliver that promise. The Town of Wake Forest has received NCDOT Enhancement funding for the design and construction of a 10' wide, .5 mile segment of a paved recreational/greenway trail to be located adjacent to Richland Creek and the Old Mill Stream Subdivision in Wake Forest, NC. The trail use would be limited to non-motorized vehicles and pedestrians. This section of greenway trail is only one segment of a larger greenway system that is planned to tie into future greenway trails to the north and south. The Richland Creek corridor is one of two main greenway corridors planned for Wake Forest. Please refer to the preliminary construction plans for the following information. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower- impact site layouts, and explain why these design options tivere not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction: to reduce impacts. There are several constraints in addition to Neuse River Riparian Rules that are limiting the flexibility of the trail location. At Lots 2 and 3, there are topography and accessibility issues. Placement of the trail on the high side (6 `above the existing trail) would require a retaining wall and railing at these locations. Another issue related to lots 2 and 3 is the removal of vegetation in order to locate the trail further away from the creek edge rather than locate the paved trail where there is already a cleared path. At Lots 11, 15 and 16, the close proximity of property lines to the creek's edge limits the proposed trail to only one location. A minimum of eight feet (8') is required for construction purposes, therefore the proposed trail is located this distance from the property line. As mentioned in Part III. Project Information (910) the land was dedicated to the Town of Wake Forest for greenway use prior to the adoption of the Neuse River Riparian Rules. As an attempt to minimize and avoid buffer impacts, staff members met with the adjacent property owners to discuss purchasing greenway easements (more specifically - changing the usage rights of the existing sewer easement to include greenway use), but the residents did not agree to this request. In addition, the town is planning on incorporating best management practices for trail construction. Controlling runoff from the trail (by sloping the trail away from the Richland Creek), enhancing existing vegetation, using alternative paving material, and requiring compact construction equipment (mini-excavators, chain saws for clearing, mechanical winches for movement of heavy objects, and trail trailers for equipment and material mobilization) are among the best management practices the town will exercise. Stormwater (required by DWQ) Describe impervious acreage (both existing and proposed) versus total acreage on the site. Discuss stornnvater controls proposed in order to protect surface waters and wetlands downstremn from the property. Total site acres = 5.77. The existing dirt trail (which is so compact that it is already impervious) is approximately 4' wide and runs 2,400 linear feet = 9,600 square feet of impervious surface. Proposed trail = 24,000 square feet (8-10' wide x 2,400 linear feet) of impervious surface area. The Town of Wake Forest will perform Best Management Practices (local, state, county BMP) to ensure that runoff, sediment, and construction waste do not get washed into the stream, pollute surface waters and wetlands that may be down stream. Examples of these BMP's include the following: ® Installation of sediment and erosion control fence. o Groundcover will be established upon completion of work. o All buffers will be maintained. ® Qualified Town staff (Engineering staff) will monitor construction activity. 0 Require that any excavated soil be located on the site in a manner that eliminates the possibility of sediments running into the street or adjoining properties. 0 Require that soil piles be covered until the soil is either used or removed. 0 No washing of construction equipment and vehicles will be allowed adjacent to a construction site.
