The Land Application Unit has conducted a preliminary review of the subject permit application
package. Additional information is required before we may continue our review. Please address
the following items no later than October 30, 2009.
1. The designed 5 -day upset pond (constructed wetland) doesn't show a permanent liquid level,
This seems unusual for a wetland. Please note that the 5 -day storage capacity of the upset pond
must be available at all time.
2. According to the cover letter submitted with the application package, use of reclaimed
water for toilet flushing is being mentioned. Please clarify this utilization (i.e., location(s)
where reclaimed water will be used and anticipated flow). Also the utilization of
reclaimed water for toilet flushing needs to be included in the plan and specification to
address the distribution piping, cross connection control, and how public health and
environment will be protected.
3. One of the permit conditions regarding earthen basins (storage ponds, 5 -day upset pond,
etc.) states that "A protective vegetative cover shall be established and maintained on all earthen
embankments (i.e., outside toe of embankment to maximum allowable temporary storage
elevation on the inside of the embankment), berms, pipe runs, erosion control areas, and surface
water diversions. Trees, shrubs, and other woody vegetation shall not be allowed to grow on
the earthen dikes or embankments. Earthen embankment areas shall be kept mowed or
otherwise controlled and accessible". It is our concern that the current design of the 5 -day
and storage ponds will not be able to meet this permit condition. Trees, shrubs, and plants
are put in and around the ponds. Please explain how the stability of the pond's slope and
the integrity of the liner will be protected from these trees and plants roots.

4. The operation and maintenance plan (under spill control) must include contact
information for regulatory agencies in accordance with 15A NCAC 02T.0507(4)(b).
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Please note that the subject wastewater recycle systems need to be
constructed as soon as possible to prevent the violation to waters of the State. Any oversights
that occurred in the review of the subject application package are still the responsibility of the
applicant. In addition, any omissions made in responding to the above items may result in future
requests for additional information.
