A statement consisting of the proposed use of the project property, along with the amount of project property involved, the name and address of the party or parties to whom the rights are to be conveyed, and the name and address of the contact person. Davidson Pointe, located on a 385 impoundment of Lake Norman called Lake Davidson in Iredell County North Carolina, is a Commercial-Residential Development consisting of 124 off water lots and a community pier with a total of 18 double slips for 36 boats. Lake Davidson is considered a part of Lake Norman. Proposed is a Lakeshore Common Area that will be located around the development's shoreline, hence no lakefront lots. The total site area is 46.25 acres. There is 3,657.70 feet of developable shoreline according to Duke Power's Shoreline Management Plan Maps. See Exhibit A for the site plan and Shoreline Management Plan classifications. The proposed lease area of the project property is 0.69 acres for the pier. See exhibit B for the lease area drawings. Directions by road are as follows: Take Exit 30 off of Interstate 77 north of Charlotte. Go right at the end of the exit ramp onto Griffith Street. Lake Davidson is an approximately 385-acre impoundment of Lake Norman with very little development on it. The causeway of Interstate 77 separates Lake Davidson from Lake Norman; however, Lake Davidson is considered part of Lake Norman. Davidson Pointe will be a Commercial- Residential Development according to Duke Power's Shoreline Management Plan. The development will consist of 124 off water lots, a large Common Area along the shoreline and a community pier with a total of 36 berths (18 double slips). The pier facility will consist of a stationary section, a ramp down to the slip section and the 18 double berth slip section. The total site area is 46.25 acres and the amount of shoreline is 3657.70 feet. There will not be any lake front lots within this development, hence, no potential crowding due to private piers. Shaw Resources is applying for approval to construct a community pier consisting of 18 double slips. The facility will not exceed 120 feet from the shoreline. The proposed lease areas for the facility will total 0.69 acres. The pier facility will comply with Duke Power's Shoreline Management Guidelines and Shoreline Management plan classification. There will be minimal disturbance to the 50-foot vegetative buffer during pier. All work will be done with 404/401 compliance in mind. A detailed written description and a technical drawing of the facilities to be constructed including a discussion of the proposed action. The Commercial-Residential slips will consist of a 54-foot long stationary pier, a 20-foot ramp (2 to 3 feet of ramp will rest on the slip facility) and 18 double slips. The 18 double slips arc in the double loaded configuration. The slip section is 198 feet long and will be at a right angle to the ramp and pier. The slips berths are 20 feet deep and 20 feet wide. The fingers are 20 feet long and 4 feet wide. The central wallavay between the slips will be 6 feet wide. The proposed facility will be adjacent to a large common area and will not exceed 120 feet out into the lake. All wood will be salt treated and intended for marine use. The floatation will be of the black encapsulated type. The pilings will be treated for marine use and driven to refusal. The proposed action will have minimal effect on Lake Davidson. There is very little development on this part of Lake Norman. The closest community slips are approximately one mile away. Consequently, there is very little boat traffic on Lake Davidson at this time. The community pier will be built on site and care will be given to prevent construction materials from floating away from the site. Reflectors will be installed on the outer edges of the facility to increase visibility at night. A showing that the proposed construction will be designed to avoid or minimize conflict with natural, historic and scenic values and resources of the project area. The proposed construction is planned so as not to conflict with the natural, historic and scenic values of the project. The applicable sedimentation requirements by the State of NC will be installed and maintained throughout the project. Silt fence will be utilized to prevent sediment from getting into the lake. All erosion control devices will be checked and maintained regularly to prevent any sedimentation from taking place. Disturbances within the 50-foot vegetative buffer will be minimal. There is very little boating traffic on Lake Davidson, therefore, the on site construction of the community slips should not effect boating safety. All work will be done during daylight hours and reflectors will be placed on the slip fingers to aid in locating the slips at night. Also, care will be given to prevent building materials from floating away during the construction phase. The completed facility will not exceed 120 feet out into the lake. v 6. A statement concerning any proposed changes in project operation. The proposed project will not alter project operation. 7. A discussion of any adverse environmental effects, which cannot be avoided should the proposal be implemented and how such adverse effects are proposed to be ® minimized. There arc not any adverse environmental effects that cannot be avoided during the construction of the proposed community slips. The location of the proposed pier is in an area that has few trees. It is not anticipated that there will be any tree removal during the construction of the proposed pier. There will be minimal disturbance to the vegetative buffer during construction. If any equipment is needed to transport materials, it will be of the rubber-tired type and will not cause excessive damage to the vegetation. If any vegetation is disturbed, it will be seeded and stabilized per NCDENR guidelines. E 8. A statement as to why the proposed action is in the public interest. Public interest will be served by providing a lake front development in an attractive manner along the shores of Lake Davidson. Davidson Pointe shall be developed with the intension of preserving the natural beauty of the shoreline and providing a beautiful neighborhood. The pier facility will provide a well-made and convenient location for residents of Davidson Pointe to moor their boats. 9. A detailed written description and map showing the location and type of proposed facility(s). Also include a copy of a survey prepared by a registered land surveyor of the entire shoreline area within the boundaries of the development. This survey must clearly indicate the FERC project boundary (i.e. contour elevation), the points of intersection of side lot lines with the project boundary, the designated lot number for each lot having project frontage, and the location, labels and necessary descriptive information for all existing or planned facilities that now or will penetrate FERC project boundary, including, but not limited to, shoreline stabilization for the amenities areas, boat slips, storm water outfalls, including any associated rip rap, utility line crossings, excavation areas, etc., but not including individual private piers and shoreline stabilization associated therewith. The survey should also include the shoreline classifications according to Duke Power's Shoreline Management Plan (SMP), especially any areas classified as Environmental or Natural Areas. The aquatic habitat including depths and bottom types and areas of emergent vegetation or woody debris. The condition of the existing shoreline including areas of erosion, stabilization and vegetative cover. The survey should also indicate that the applicant is the current owner or leaseholder of the property adjoining the project boundary from which the facility(s) will be located. Davidson Pointe on Lake Davidson, a part of Lake Norman, is a commercial-residential development that will contain a total of 46.25 acres. The development will have a total of 164 lots. There is 3657.70 feet of developable shoreline according to Duke Power's Shoreline Management Classifications. See Exhibit A for the proposed site plan and classifications using Duke Power's Shoreline Management Plan. See Exhibit B for the registered survey of the lease area. The proposed lease area is 0.69 acres and will include the proposed pier and boat slips. The shoreline adjacent to the proposed pier is level with a gentle slope down to the water. There is already a pathway through the 50-foot buffer to an old dilapidated pier. The old pier will be removed prior to constructing the new pier. It is not anticipated that any trees will be removed during the construction of the pier. The lake bottom is a combination of sand and red clay with isolated areas of large rocks, (see pictures). The survey shows the applicant is the current owner of the property. 10. Thirteen color copies each of photographs of the commercial project area location(s), the shoreline along the area(s) and the upland area adjoining the area(s). These photographs should show aquatic habitat, vegetative cover, land cover and shoreline buffer conditions present at the project site and within 100 feet landward of the shoreline. Describe what measures will be used to ensure boating safety in the vicinity of the proposal during and after construction activity. The pier will be constructed at the site. All construction will be done during daylight hours so all construction activities can be easily seen to boating traffic. Care will be given to prevent any building materials from floating away. The amount of boating traffic on Lake Davidson in very light and the construction of the proposed pier will provide little hazard to boaters. Reflectors will be attached to the facility to aid in locating the pier at night. 12. Describe the magnitude and pattern of existing boat traffic in the area, including any existing recreational uses (public or private) at and near the proposal, including areas of attraction such as marine gas facilities, restaurants, and mooring areas. Describe the effect of increased boat traffic, associated the proposed facilities, on the existing boat traffic in the area. Since Lake Davidson is an impoundment of Lake Norman and of relatively small size 385 acres), it has not been developed at the rate that the rest of Lake Norman has. Consequently there is very little boat traffic on Lake Davidson. There arc no recreational areas, marine gas facilities or restaurants located on Lake Davidson. The nearest mooring areas are private and approximately one mile away. The developer is imposing a 10-horse power limit for boats moored at the proposed facility. Since there is very limited use of Lake Davidson by local boat owners, the impact of the proposed facility should have little effect on boating safety or over crowding. 13. For projects that include water withdrawals, a complete description of the design and construction of the water pipeline intake structure (including elevation data), intake screen size, intake velocities, proposed water withdrawal rates, and maximum pumping capacities must be included along with a description of measures proposed to mitigate the potential entrainment of fish or aquatic organisms. Note: This item is only included for projects that ivill have water ivithdraival facilities as part of the proposal. There will be no water withdrawal for this project at this time. 14. Describe any shoreline disturbance that may occur as a result of the proposal (e.g. ramps, pipeline trenches, etc.) especially land disturbances within 100 feet of the project boundary. There will be no boat launch ramp or trenches associated with this project. It is anticipated that minimal ground disturbing activities may occur during pier construction due to material transport. Any disturbances will be stabilized and seeded as soon as practical. There is already a pathway through the buffer that leads to the proposed pier location.
