Dear Mr. Gottsleben:
On April 26, 2004, you requested a 401 Water Quality Certification from the Division of Water
Quality (DWQ) for your project. We wrote to you on August 22, 2005 discussing concerns that we
have regarding the design of the project and stating that it would be placed on hold for three weeks
giving you time to address DWQ's concerns. As of today, DWQ has not received a response to this
request. Therefore, your file is hereby considered withdrawn and will not be reviewed until DWQ's
earlier concerns are addressed. Once you have collected sufficient information to have a complete
application (please see our August 22, 2005 letter for the missing information), you will need to
reapply for DWQ approval. This includes submitting a complete application package with the
appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this
activity and any work done within waters of the state would be a violation of North Carolina General

RE: Site visit to proposed house site
Lot 3, Windsong II, Breeze Way, Aurora, NC
Beaufort County
On August 15, 2005, Kyle Barnes and I visited your house site to discuss the
implications of the Tar-Pamlico River buffer rules for construction of a home on this site. After
that meeting, I agreed to prepare a written summary of the site visit and all permitting issues
that had arisen at the site. The following issues will need to be addressed before DWQ can
issue a Minor Variance to allow impacts to the protected buffers in order to construct the house.
1. Relocation of the house to impact only Zone 2: As we discussed in the field,
there is sufficient room on this lot to relocate the proposed house location so it
only impacts Zone 2 of the protected buffer. This will require redesign and
relocation of the connecting garage on the site.
2. Stormwater management: Management of the stormwater from all of the new
impervious surfaces (including rooftops, driveways, enclosed decks, etc.) will be
a requirement of DWQ's approval. We suggest that you direct the stormwater to
infiltrate and sheet flow into the remaining buffer on the site to ensure that
additional nutrients do not enter surface water.
3. Buffer mitigation: Buffer mitigation will be required at a 1.5:1 ratio for the
square feet of impact to Zone 2. We did not see any location to replant trees on
site since the site is wooded. Payment to the Ecosystem Enhancement Program
or a private mitigation bank would be acceptable to DWQ.
4. Relocation of the septic tank/drain field: As we discussed in the field, the
proposed location of the septic tank/drain field will need to be relocated to a
location outside the protected buffer. Please contact the Beaufort County Health
Department to find a suitable location.

for the prompt reply.
understand your position with regard to the possibility of reconfiguring the house and
garage. I interpret your response to suggest that only a reorientation of the structures is
requested, and not a redesign of either structure. We remain concerned that any
reorientation may have a significant impact on the value of the project as it relates to
site lines, orientation to the path of the sun, and general appeal and efficiency of the
finished project. However, if you would like to submit a scale drawing of the proposed
reconfiguration you have in mind, we would take this into consideration. Given this
response and per your suggestion, we agree to arrange for a site visit to review plans
for the structures and associated mitigation issues.
The schedule for beginning our project is flexible, pending sale of our current home and
considering the recent surge in the cost of building materials which suggests it would be
prudent to delay construction as material prices are forecast to decline over the next 12-
24 months. In addition, travel to the site from our present home is a bit of an
undertaking. Our next scheduled trip to the area is for early May 2005, and I request
that we plan to make arrangements to meet at that time, and that you agree to keep this
project file open and active until we complete the site visit.

Enclosed please find an application for a general variance for Lot #3 at Windsong II,
Aurora, NC. This application has been prepared with the assistance of Doug Hylton
(WRECO) who is very familiar with the site and who has assisted with other approved
applications in this sub-division.
Per the indication on the site plan, it is our intention to plant the required number of
mitigation trees in the areas indicated as part of our landscape plan, or as may specified
by your office in the approval document, in lieu of payment to the NC Wetlands
Restoration Program fund.
We expect to relocate to the New Bern area in the coming months and to begin
construction of our home shortly thereafter. Accordingly, I would greatly appreciate
some of your limited time to review and approve this application so that we can finalize
our plans and begin the project.

I am in receipt of the response from your department dated June 9 which was received
in our mail on June17. Your prompt response to our application of April 21 was much
appreciated. I'd like to address your reply in 3 parts; the first addressing your
comments on Zone 1 impact and redesign considerations, the second addressing buffer
mitigation, and the third concerning questions re: the Riparian Buffer Restoration Fund.
Zone 1 Impact/Building Redesign
Based on the identified set backs and a requirement not to impact Zone 1 at all, the
building lot is essentially unbuildable and functionally obsolete. These set backs
significantly reduce the value of the property by reduction of the usable land area
originally purchased. A radical redesign, which would be required if leniency was not
granted, would negatively impact the value of the home and property, and would
jeopardize our substantial investment.
In the 3+ years that were spent developing the design for the project, we attempted to
find ways to keep structures out of Zone 1 while still maintaining a design that would be
functionally practical and aesthetically appealing, with reasonable views of and access
to the water. We concluded that, in order to do this, the house structure would have to
be some unconventional organic shape, or would have to have a distorted aspect ratio,
i.e., a building that with its length being double its width. Such restrictions greatly limit
the design, and given similar square footage and equivalent costs in materials and
labors, would result in a structure that was neither functionally practical nor aesthetically
appealing, greatly diminishing its value and the appeal of the property in general. As
designed, we have positioned the structures on the lot in a manner to provide minimum
impact on Zone 1 by positioning the building on the widest portion of the lot within
reasonable distance of the water, and strongly believe that there is no better location
given the design goals and the approved location of the drain field.
With regard to the relative positions of the house and the garage structures, included
with this letter are North and South elevation drawings showing their interconnection

which was not evident on the initial application. The connection between the buildings
is considered an essential design element of the project. You will note that there is a
second floor connecting bridge and first floor connecting walkway between the house
and the garage structure. The distance between the two structures is the minimum
practical for vehicle access to the garage. Moving the structures closer together would
require the garage to become deeper, essentially negating any gains.
In conclusion, we do not agree that a redesign or a reconfiguration is a practical solution
given the financial impact it would have on the property/structures and the resale
potential of same.
Buffer Mitigation
ask that you revisit the site plan included with our application, my cover letter, and our
response to Section 3 which describes the buffer mitigation measures we believe may
be suitable to support approval as submitted. Based on an impact area of 3216 ft sq
and an assumption that each canopy hardwood tree would require 136 ft sq, we
propose planting not less than 24 quality hardwood canopy trees, in addition to installing
diffuser pads, to achieve the necessary mitigation. As your response did not address
our submittal in this regard, I request that you either accept our mitigation plan, or
propose an alternate plan that would satisfy any concerns.
Riparian Buffer Restoration Fund
While we would prefer to address any concerns through a mitigation plan, even if such
plan was different from our initial proposal, payment to the fund may be considered as a
last resort. Should you recommend payment to the fund, please advise details as to
costs and terms for my consideration.

Dear Mr. & Mrs. Gottsleben:
On April 26, 2004, the Division of Water Quality (DWQ) Wetlands/401 Unit received your variance request dated April 21,
2004. The DWQ has determined that your project is eligible for the use of the "General" Major Variance From the Neuse
and Tar-Pamlico Riparian Buffer Rules for residential structures on existing lots within the coastal counties as defined by the
Coastal Area Management Act, Approved 51912001. However, the DWQ heeds additional information in order to complete
the approval process of your variance. Therefore, unless additional information is provided as described below, we will
have to move toward denial of your request per 15A NCAC 2B.0259(9) and will place this project on hold as incomplete
until we receive this additional information: Specifically:
Additional Information:
o Zone 1 Impacts - It appears that you can either redesign or reconfigure your proposed house, garage or their
location on the lot to avoid the Zone 1 buffer impacts. Condition No. 7 of the attached Coastal General Variance
requires that impacts to the buffer should be minimized to the greatest extent practicable. Please redesign or
otherwise reconfigure your proposed plans to avoid the Zone 1 impacts or provided additional justification as to why
these impacts can not be avoided. Please note that buffer mitigation will be required for any Zone 1 impacts, if
approved.
Please respond in writing within three weeks of the date of this letter by sending a copy of this information to me and Mr.
Tom Steffens of the DWQ Washington Regional Office at (252) 946-6481. If we do not hear from you in three weeks, we
will assume that you no longer want to pursue this project and we will consider the project as withdrawn. Please call Mr.

" General" MAJOR VARIANCE
From the Neuse and Tar Pamlico Riparian Buffer Protection Rules for residential
structures on existing lots within the coastal counties as defined by the Coastal Area
Management Act that meet the conditions stated below.
This "general" major variance from the Riparian Buffer Protection Rules in the Neuse
(15A NCAC 2B.0233) and Tar-Pamlico (15A NCAC 2B.0259) River Basins is hereby issued by
the NC Environmental Management Commission (EMC) for impacts to the protected buffers as
long as the conditions prescribed below are met.
The applicant must submit to Division of Water Quality (DWQ) three copies of the DWQ
"General" Major Variance Application Form that describes how the following conditions of this
variance will be met. If these conditions can not be met, an individual Major or Minor Variance
from the Buffer Rules may be sought from the EMC. This "General" Major Variance shall expire
on April 11, 2006 unless it is renewed before that time by the EMC.
Conditions:
1. The residential lot must be located within one of the coastal counties as
defined by the Coastal Area Management Act (CAMA).
2. Applicants must show that they have met the requirements for a variance
as specified in the buffer rules in "VARIANCES" [15A NCAC 2B
.0233(9)(a)(i)-(iii) and 15A NCAC 2B .0259(9)(a)(i)-(iii)] for the
specific river basin where the impacts will occur.

Construction is for residential buildings and related structures such as
garages, decks, porches, attached commercial buildings, driveways and
sheds.
5. Substantial expenditures and contractual obligations must have occurred
in good faith prior to the August 1, 2000 e€-tho-Bu€fer-ules-far-the
speeifie basin where the i-mpaets-win 0 our-. Substantial expenditures
and obligations must have been made in reasonable reliance upon
governmental permits and/or approvals (such as 401 Water Quality
Certifications, CAMA permits, active connection to an existing sanitary
sewer system or local septic system approvals). Supportive written
documentation must be submitted to the DWQ for review.
6. The lot must be buildable, without wetland impacts except for driveways
and/or utility crossings and any impact to the buffer shall be minimi7.ed
to the maximum extent practical.
7. Where impacts to the buffer will occur, the impact should be minimized
to the greatest extent practicable as determined by DWQ staff.

9 Any on-site wastewater treatment must not be located within 50 feet of a
surface water as specified in "ZONES OF THE RIPARIAN BUFFER'
[15A NCAC 2B .0233(4) and 15A NCAC 2B .0259(4)] of the buffer
rules. The only exceptions include any pretreatment systems meeting the
Treatment Standard 1 as found in 15A NCAC 18A. 1969 Innovativc
System Approval regulated by the NC Division of Environmental Health,
Oa-site Wastewater Section.
9. On-site stormwater management controls must be shown on the
application and stormwater runoff must be directed away from the
adjacent surface water and/or coast wetland as determined sufficient by
DWQ staff; measures such as rain gardens, bio-retention areas,
vegetative filter strips and planting of trees or shrubs along bulkheads
and/or property lines to maximize pollutant removal may be required as
determined by DWQ staff. If the applicant is required to obtain a
Sedimentation and Erosion Control Permit or a CAMA Major Permit,
then a Stormwater Permit may be required from the DWQ.
10. Mitigation will be required at a 1:1 ratio for impacts to Zone 1. This
mitigation can be accomplished by either (1) payment into the Riparian
Buffer Restoration Fund (administered by the DWQ Wetlands
Restoration Program), (2) planting or protection of a riparian area not
subject to the buffer rules, or (3) additional planting of a partially
buffered location on-site or in close proximity to the impacted area.
Mitigation plans must be approved in writing by the DWQ prior to
construction.
11. The applicant must receive written approval from the DWQ based on the
submittal of the "General" Major Variance Application Foci
acknowledging that these conditions have been met before any impacts
occur to the riparian buffer.
12. The applicant must contact the appropriate District office of the N.C.
Division of Coastal Management or Local Permitting Officer for any
current requirements for CAMA Major, Minor or General Permits.

On July 6, 2004, the Division of Water Quality (DWQ) Wetlands/401 Unit received additional information
regarding your variance request dated April 21, 2004. The DWQ has determined that your project is eligible for
the use of the "General" Major Variance From the Neuse and Tar-Pamlico Riparian Buffer Rules for residential
structures on existing lots within the coastal counties as defined by the Coastal Area Management Act, Approved
51912001. However, the DWQ needs additional information in order to complete the approval process of your
variance. Therefore, unless additional information is provided as described below, we will have to move toward
denial of your request per 15A NCAC 2B .0259(9) and will place this project on hold as incomplete until we
receive this additional information. Specifically:
Additional Information:
o Zone 1 Impacts - It appears that you can either redesign or reconfigure your proposed house, garage or
their location on the lot to avoid the Zone 1 buffer impacts. Condition No. 7 of the attached Coastal
General Variance requires that impacts to the buffer should be minimized to the greatest extent
practicable. Please redesign or otherwise reconfigure your proposed plans to avoid the Zone 1 impacts or
provided additional justification as to why these impacts can not be avoided. Specifically, it appears
based on the information received on July 6, 2004 that the house and garage could be reconfigured
in their orientation to each other in a manner that would result in no impacts or reduced impacts to
Zone 1 of the protected riparian buffers. If you do not believe that you can reconfigure or redesign
your plans in a manner to avoid the Zone 1 impacts, then the DWQ recommends a site meeting to

" General" MAJOR VARIANCE
From the Neuse and Tar Pamlico Riparian Buffer Protection Rules for residential
structures on existing lots within the coastal counties as defined by the Coastal Area
Management Act that meet the conditions stated below.
This "general" major variance from the Riparian Buffer Protection Rules in the Neuse
(15A NCAC 2B .0233) and Tar-Pamlico (15A NCAC 2B .0259) River Basins is hereby issued by
the NC Environmental Management Commission (EMC) for impacts to the protected buffers as
long as the conditions prescribed below are met.
The applicant must submit to Division of Water Quality (DWQ) three copies of the DWQ
"General" Major Variance Application Form that describes how the following conditions of this
variance will be met. If these conditions can not be met, an individual Major or Minor Variance
from the Buffer Rules may be sought from the EMC. This "General" Major Variance shall expire
on April 11, 2006 unless it is renewed before that time by the EMC.
Conditions:
1. The residential lot must be located within one of the coastal counties as
defined by the Coastal Area Management Act (CAMA).
2. Applicants must show that they have met the requirements for a variance
as specified in the buffer rules in "VARIANCES" [15A NCAC 2B
.0233(9)(a)(i)-(iii) and 15A NCAC 2B .0259(9)(a)(i)-(iii)] for the
specific river basin where the impacts will occur.

4. Construction is for residential buildings and related structures such as
garages, decks, porches, attached commercial buildings, driveways and
sheds.
5. Substantial expenditures and contractual obligations must have occurred
in good faith prior to the August 1. 2000 e€te BufferRulasfeF-the

and obligations must have been made in reasonable reliance upon
governmental permits and/or approvals (such as 401 Water Quality
Certifications, CAMA permits, active connection to an existing sanitary
sewer system or local septic system approvals). Supportive written
documentation must be submitted to the DWQ for review.
6. The lot must be buildable, without wetland impacts except for driveways
and/or utility crossings and any impact to the buffer shall be minimi7.ed
to the maximum extent practical.
7. Where impacts to the buffer will occur, the impact should be minimized
to the greatest extent practicable as determined by DWQ staff.

8. Any on-site wastewater treatment must not be located within 50 feet of a
surface water as specified in "ZONES OF THE RIPARIAN BUFFER'
[15A NCAC 2B .0233(4) and 15A NCAC 2B .0259(4)] of the buffer
rules. The only exceptions include any pretreatment systems meeting the
Treatment Standard 1 as found in 15A NCAC 18A. 1969 Innovative
System Approval regulated by the NC Division of Environmental Health,
On-site Wastewater Section.
9. On-site stormwater management controls must be shown on the
application and stormwater runoff must be directed away from the
adjacent surface water and/or coast wetland as determined sufficient by
DWQ staff; measures such as rain gardens, bio-retention areas,
vegetative filter strips and planting of trees or shrubs along bulkheads
and/or property lines to maximize pollutant removal may be required as
determined by DWQ staff If the applicant is required to obtain a
Sedimentation and Erosion Control Permit or a CAMA Major Permit,
then a Stormwater Permit may be required from the DWQ.
10. Mitigation will be required at a 1:1 ratio for impacts to Zone 1. This
mitigation can be accomplished by either (1) payment into the Riparian
Buffer Restoration Fund (administered by the DWQ Wetlands
Restoration Program), (2) planting or protection of a riparian area not
subject to the buffer rules, or (3) additional planting of a partially
buffered location on-site or in close proximity to the impacted area.
Mitigation plans must be approved in writing by the DWQ prior to
construction.
11. The applicant must receive written approval from the DWQ based on the
submittal of the "General" Major Variance Application Form
acknowledging that these conditions have been met before any impacts
occur to the riparian buffer.
12. The applicant must contact the appropriate District office of the N.C.
Division of Coastal Management or Local Permitting Officer for any
current requirements for CAMA Major, Minor or General Permits.
