Quality (DWQ) for your project. We wrote to you on March 29, 2004 discussing concerns that we
have regarding the design of the project and stating that it would be placed on hold for three weeks
giving you time to address DWQ's concerns. As of today, DWQ has not received a response to this
request. Therefore, your file is hereby considered withdrawn and will not be reviewed until DWQ's
earlier concerns are addressed. Once you have collected sufficient information to have a complete
application (please see our March 29, 2004 letter for the missing information), you will need to
reapply for DWQ approval. This includes submitting a complete application package with the
appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this

regarding your plan to fill wetlands or waters for the purpose of constructing a church in Wake County.
Approval from DWQ is required to disturb these areas. Please provide 7 copies of the following
information and refer to the DWQ # listed above in your reply. Please show these on maps of suitable
scale (for instance 1" = 100 feet) so we can begin to determine your projects' compliance with 15A
NCAC 211.0500.
1. Please indicate on your site plan where wetland impact area #1 and #2 are located.
2. Please provide justification for elevating the entire property to same elevation to the
adjacent property, as you have requested. We do not believe that the two projects are not
inherently connected such that they would need to be construction at the same elevation.
3. Our calculations show that only 15% of this site will be impervious, however cursory
observation of your site plan indicates that well over 30% of the project area would be
impervious. You are reminded that if your project reaches 30% impervious, then a
stormwater management plan will be required.
4. Please show all isolated wetland impacts including fill slopes on the site plan.
5. Please provide detail for the stormwater management practices as required by
IWGP 100000.
6. Please indicate all stormwater outfalls on the site plan.
7. This office believes that the parking are on the plan can be moved or reconfigured to
minimize the impacts to the isolated wetlands. Please revise the plans to minimize the
impacts.
8. Please clarify whether on-site stormwater management is proposed since it is not clear
from the application.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction

10. Describe the overall project in detail, including the type of equipment to be used: The
Morrisville LDS Church is purchasing the 3.48 ac. site for new church construction and
associated parking. A portion of the site falls in the 100-year floodplain therefore the ground
elevation will be raised 4 to 5 ft (approx. 294') to a similar elevation as the adjacent shopping
center. The planned stormwater retention basin will be designed with an outlet at natural
ground elevation (290'-291'). Stormwater from outlet will be piped to a BMP on adjacent
property to the south for treatment along with the stormwater from the shopping center.
11. Explain the purpose of the proposed work:_ To develop a buildable site at a similar elevation
as the adiacent Morrisville Square Shopping Center. ExistingiparkinQ area for shopping
center varies from 293 to 294'.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including; all prior phases of the same subdivision) in the past, please explain. Include

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building; ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
To provide necessary parking, stormwater management and meet Town building ordinances
the site size has itself been minimized. Additionally, the isolated wetlands were created due to
filling for the Morrisville Square Shopping Center.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
littp://li2o.cnr.state.nc.us/newetlands/strm(,ide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.

BMP.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to
accept payment for non-riparian wetlands impacts associated with the subject project. Please note that the decision by the
NCEEP to accept the mitigation requirements of this project does not assure that this payment will be approved by the
U.S. Army Corps of Engineers and the N.C. Division of Water Quality Wetlands/401 Unit. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NCEEP for impacts associated with this project is
appropriate.
This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
Permit/401 Certification within this time frame, this acceptance will expire.
Based on the information supplied by you in a letter dated February 13, 2004 the non-riparian wetlands restoration that is
necessary to satisfy the compensatory mitigation requirements for this project is summarized in the following table. The
maximum amount of mitigation that the NCEEP will accent for this moiect is also indicated in this table.

On December 3, 2003, 1 conducted a site visit of feature A involved in the above
referenced project as identified on the attached maps. It was determined that the feature shown
on the USGS Cary, NC Quad, but absent on the map Wake County Soil Survey could potentially
be subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management
Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:
02B.0233 (NCAC.0233).
The Division of Water Quality (DWQ) has determined that the surface water labeled
as "A" on the a ttached m aps i s n of s ubject t o t he N euse B uffer R ule. This on-site
determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delega
Local Authority that a surface water exists and that it is subject to the buffer rule may reque:
determination by the Director. A request for a determination by the Director shall be referred to
Director in writing, c/o John Domey, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh,
27604-2260.
Individuals that dispute a determination by the DWQ or Delegated Local Authority 1
"exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. You must
within sixty (60) days of the date that you receive this letter. Applicants are hereby notified that
sixty (60) day statutory appeal time does not start until the affected party (including downstream

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should

10. Describe the overall project in detail, including; the type of equipment to be used: The
Morrisville LDS Church is purchasing the 3.48 ac. site for new church construction and
associated parking. A portion of the site falls in the 100-year floodplain therefore the around
elevation will be raised 4 to 5 ft (approx. 294') to a similar elevation as the adjacent shopping
center. The planned stormwater retention basin will be designed with an outlet at natural
around elevation (290'-291'). Stormwater from outlet will be piped to a BMP on adjacent
property to the south for treatment along with the stormwater from the shopping center.
11. Explain the purpose of the proposed work: To develop a buildable site at a similar elevation
as the adjacent Morrisville Square Shopping Center. Existing parking; area for shopping
center varies from 293 to 294'.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction

To provide necessarv narking, stormwater management and meet Town building ordinances
the site size has itself been minimized. Additionally, the isolated wetlands were created due to
filling for the Morrisville Square Shopping Center.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 21-1 .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
littp:Hll2o.enr.state.nc.us/ncwetlands/strm?;ide.hUnl.
1. Provide a brief description of the proposed mitigation plan. The description should provide

and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to
accept payment for non-riparian wetlands impacts associated with the subject project. Please note that the decision by the
NCEEP to accept the mitigation requirements of this project does not assure that this payment will be approved by the
U.S. Army Corps of Engineers and the N.C. Division of Water Quality Wetlands/401 Unit. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NCEEP for impacts associated with this project is

This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
Permit/401 Certification within this time frame, this acceptance will expire.

On December 3, 2003, 1 conducted a site visit of feature A involved in the above
referenced project as identified on the attached maps. It was determined that the feature shown
on the USGS Cary, NC Quad, but absent on the map Wake County Soil Survey could potentially
be subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management
Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:
026.0233 (NCAC.0233).
The Division of Water Quality (DWQ) has determined that the surface water labeled
as "A" on the a ttached m aps i s n of s ubject t o t he N euse B uffer R ule. This on-site
determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a determination by the Director shall be referred to the
Director in writing, c/o John Domey, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, NC
27604-2260.
Individuals that dispute a determination by the DWQ or Delegated Local Authority that
"exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. You must act
within sixty (60) days of the date that you receive this letter. Applicants are hereby notified that the
sixty (60) day statutory appeal time does not start until the affected party (including downstream and
adjacent landowners) is notified of this decision. DWQ recommends that the applicant conducts
this notification in order to be certain that third party appeals are made in a timely manner. To ask
for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611,7447. This

cannot be accomplished in a timely manner. You may wish to obtain a consultant to obtain a more timely
delineation of the wetlands. Once the consultant has flagged a wetland line on the property, Corps staff will
review it, and, if it is accurate, we strongly. recommend that you have the line surveyed for final approval by the
Corps. The Corps will not make a final jurisdictional determination on your property without an approved survey.
The waters of the U.S., to include wetlands, on your lot have been delineated,. and the limits of the Corps
jurisdiction have been explained to you. Unless there is a change in the law or our published regulations, this
determination may be relied upon for a period not to exceed five years from the date of this notification.
