The modifications to the subject permit are as follows: the addition of 2.71 acres of conjunctive reclaimed utilization fields and a bulk distribution system consisting of a single hose connection. This permit shall be effective from the date of issuance until August 31, 2016, shall void Permit No. WQ0031857 issued September 5, 2007, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements listed in Attachments A, B and D for they may differ from the previous permit issuance. Failure to establish an adequate system for collecting and maintaining the required operational information shall result in fixture compliance problems. Date — The expiration date has been, extended from. August 31, 2012 to August 31, 2016 due to Session Laws 2009-406 and 2010-177. Permit Description — The previously permitted, however unmentioned. sodium hypochlorite disinfection system with two chemical metering pumps, automatic sampler, chlorine analyzer and effluent flow meter have been added to the permit description. ➢ Condition H.11. (i.e., old Condition IIA.) — The compliance and review boundaries for the conjunctive use fields have been established with the permitting of the 2.71 acre conjunctive use utilization field. Condition HI.2. (i.e., old Condition III.2.) — This condition was modified to state that a certified ORC is not required for conjunctive reclaimed water users. ➢ Condition III.8. (i.e., old Condition IHA.) — This condition was amended to state that the public shall be prohibited access to the wastewater treatment plant site. ➢ Condition Ill.12. (i.e., old Condition II.10.) —The condition was moved to the Operation and Maintenance Requirements section. ➢ Condition IV.7. (i.e., old Condition N.S.) — This condition has been modified to include the monthly reporting requirements for the conjunctive reclaimed utilization field and the bulk distribution system using form NDAR-3. ➢ Condition IV.11. (i.e., old Condition N.7.) —This condition was amended to include that the Permittee shall notify the Division of any ponding or runoff in the conjunctive utilization sites. v Attachment A — This attachment was modified to include the sampling of Total Residual Chlorine in PPI 001 at a frequency of 5 times per week. This attachment was also modified to include a new PPI (002) for the bulk distribution system that includes three parameters to be sampled per bulk event: Total Residual Chlorine, Fecal Coliforrn and Estimated Flow. Please note the following permit conditions and attachments are new since the last permit issuance: Condition II.4. — This condition states that the reclaimed water utilized shall not exceed the application rates specified in Attachment B. Condition 11.5. — This condition states that reclaimed water distributed through the bulgy: distribution systena shall be limited to the uses specified in Attachment D. ➢ Condition H.12. — This condition states that the compliance and review boundaries for the bulk, distribution uses have not been established. ➢ Condition 11.15. — This condition requires any landowner who owns land within the compliance boundary, but who is not the Permittee, to execute and file with the County Register of Deeds an easement with the requirements listed in the said Condition. Please note the previous permit was subject to this requirement under 15A NCAC 02L .0107(f), therefore, this condition is intended to voice this rule. Mr, Jerry A. Walters February 22,20II Page 3 of 4 ➢ Condition HI.3. -- This condition requires that a suitable year round vegetative cover be maintained at all times on the 2.71 acre conjunctive use utilization field. ➢ Condition III.4. — This condition requires that adequate measures be taken to prevent ponding or runoff from the utilization sites listed in Attachment B. ➢ Condition 1115. — This condition requires that utilization not be performed during inclement weather or when the ground is in a condition to cause ponding or runoff. ➢ Condition III.7. — This condition states that only reclaimed water from the Oak Island Satellite Reclamation Facility shall be utilized for the approved bulk conjunctive reclaimed water uses listed in Attachment D. ➢ Condition M.13. — This condition includes the bulk conjunctive reclaimed utilization operations requirements. ➢ Condition N.S. — This condition requires the Permittee to track the amount of reclaimed water utilized on the sites listed in Attachment B. ➢ Condition IV.6. — This condition requires the Pern-duee to track the amount of effluent distributed for bulk conjunctive reclaimed utilization. ➢ Condition 1V.8. — This condition is included to voice the requirements of General Statute 143-215.1 C., which requires the Permittee to provide to its users and the Division of Water Quality an annual report summarizing the performance of the wastewater treatment and utilization facility and the extent to which the facility has violated this permit, or federal or State laws, regulations, or rules related to the protection of water quality. The report shall be prepared on either a calendar or fiscal year basis and shall be provided no later than 60 days after the end of the calendar or fiscal year. ➢ Condition IV.10. — This condition requires the Permittee to maintain a conjunctive reclaimed water user inspection log. ➢ Condition V.4. -- This condition requires the Permittee to perform inspections on bulk conjunctive reclaimed utilization sites using more than 10,000 GPD. ➢ Condition VI.S. — This condition notes that this permit is subject to revocation or unilateral modification within 60 days notice from the Division if the terms in 15A NCAC 02T .0110 are violated. ➢ Condition VI.9. — This condition notes that this facilities in this permit may not be expanded if the Permittee exemplifies any of the criteria in 15A NCAC 02T .0120(b). Y Attachment B --- This attachment lists the approved sites for conjunctive reclaimed water utilization. ➢ Attachment D — This attachment lists all the approved uses for bulk distributed reclaimed water. Robert Graham, PE — George Finch/Boney and Associates, PA Technical Assistance and Certification Unit Permit File WQ0031857 Notebook File WQ0031857 NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH CONJUNCTIVE RECLAIMED WATER AND BULK DISTRIBUTION SYSTEM PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules and Regulations PERMISSION IS HEREBY GRANTED TO Town of Oak Island Brunswick County FOR THE operation of a 400,000 gallon per day (GPD) wastewater treatment, conjunctive reclaimed water and bulk distribution facility consisting of construction and operation of: an influent pump station with dual 300 gallon per minute (GPM) submersible pumps; a fine screen; two 10,500 gallon, arfoxic tanks with two 2.3 horsepower (hp) submersible mixers; two 42,000 gallon aeration tanks each with a fine bubble diffuser system and served by two 289 cubic feet per minute (CFM) blowers and two 105 GPM wasting pumps; two 5,420 gallon membrane tanks each with one 265 CFM air scour blower and one 417.GPM membrane feed pump; three racks of membrane modules with 16 modules per rack; a chemical metering system for membrane cleaning; two 150 GPM filtrate pumps with dual in -line turbidity meters; a sodium hypochlorite disinfection system with two chlorine metering pumps; one 131,000 gallon effluent storage tank; an effluent pump station with dual 300 GPM effluent pumps; one 75,000 gallon elevated storage and distribution tank; 2,200 feet of 4-inch PVC sludge force main; approximately 8,500 linear feet of 8-inch PVC reclaimed pipeline; an automatic sampler; a chlorine analyzer; an effluent flow meter; and all piping, valves, and appurtenances; the construction and operation of: a 2.71 acre conjunctive reclaimed utilization field consisting of five zones with a total of 122 nozzles each rated at 3.2 GPM to serve the Oak Island Recreation Fields; a bulk distribution system consisting of a single hose connection housed in a locked below grade vault box located at the 2.71 acre conjunctive reclaimed utilization field; and all piping, valves, and appurtenances to serve the Oak Island Satellite Water Reclamation Facility, with no discharge of wastes to surface waters, pursuant to the application received February 1, 2011, and subsequent additional information received by the Division of Water Quality, and in conformity with the project plans, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until August 31, 2016, shall void Permit No. WQ0031857 issued September 5, 2007, and shall be subject to the following specified conditions and limitations: WQ0031857 Version 1.1 Shell Version 101229 Page 1 of 12 I. SCHEDULES 1. In accordance with 15A NCAC 02T .0116, upon completion of construction and prior to operation of this permitted facility, a certification (attached) shall be submitted from a licensed North Carolina Professional Engineer certifying that the permitted facility has been installed in accordance with this permit, Division approved plans and specifications, and other supporting documentation, including the location of all monitoring wells as applicable. If this project is to be completed in phases and artially certified the Permittee shall retain the reMonsibility to track further construction approved under the same hermit, and shall provide „a final certificate of completion once the entire project has been completed. Mail the Certification to the Division of Water Quality, Aquifer Protection Section, 1636 Mail Service Center, Raleigh, NC 27699-1636. 2. The Wilmington Regional Office, telephone number (910) 796-7215, shall be notified at least 48 hours in advance (excluding weekends and h6lidays) of operation of the installed facilities such that an in -place inspection can be made. Notification to the Aquifer Protection Section's regional supervisor shall be made from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. No later than six months prior to the expiration of this permit, the Permittee shall request renewal of this permit on official Division forms. Upon receipt of the request, the Division will review the adequacy of the facilities described therein, and if warranted, will renew the permit for such period of time and under such conditions and limitations as it may deem appropriate. Please note Rule 15A NCAC 02T .0105(d) requires an updated site map to be submitted with the permit renewal application. II. PERFORMANCE STANDARDS The subject non -discharge facilities shall be effectively maintained and operated at all times so there is no discharge to surface waters, nor any contravention of groundwater or surface water standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, or failure of the utilization areas to adequately assimilate the reclaimed water, the Permittee shall take immediate corrective actions including Division required actions, such as the construction of additional or replacement wastewater treatment or utilization facilities. 2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from the operation of this facility. 3. Effluent limitations shall not exceed those specified. in Attachment A. 4. Application rates, whether hydraulic, nutrient or other pollutant, shall not exceed those specified in Attachment B. 5. Reclaimed water distributed through the bulk distribution system shall be limited to the uses specified in Attachment D. WQ0031857 Version 1.1 Shell Version 101229 NE!w 2 of 12 5. The following shall be requirements for the reclaimed water distribution, storage and utilization facilities: a. All reclaimed water valves, storage facilities and outlets shall be, tagged or labeled to warn the public or employees that reclaimed water is not intended for drinking. Where appropriate, such warning shall inform the public or employees to avoid contact with reclaimed water. b. All reclaimed water piping, valves, outlets and other appurtenances shall be color -coded, taped or otherwise marked to identify the source of the water as being reclaimed water. i. All reclaimed water piping and appurtenances shall be either colored purple (i.e., Pantone 522) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER — DO NOT DRINK" or be installed with a purple (i.e., Pantone 522) identification tape or polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and repeated every three feet or less. ii. Identification tape shall be at least three inches wide and have white or black lettering on purple (i.e., Pantone 522) field stating "CAUTION: RECLAIMED WATER -- DO NOT DRINK." Identification tape shall be installed on top of reclaimed water pipelines, fastened at least every 10 feet to each pipe length and ran continuously the entire length of the pipe. iii. Existing underground distribution systems retrofitted for the purpose of distributing reclaimed water shall be taped or otherwise identified as noted above. This identification need not extend the entire length of the distribution system, but shall be incorporated within 10 feet of crossing any potable water supply line or sanitary sewer line. c. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits operation by authorized personnel only. d. Above -ground hose bibs (i.e., spigots or other hand -operated connections) shall not be present. Hose bibs shall be located in locked below -grade vaults that shall be clearly labeled non -potable. As an alternative to the use of locked below -grade vaults with standard hose bibs services, hose bibs, which can only be operated by a special tool or connected to a special hose connection, may be placed in non -lockable underground services boxes clearly labeled non potable. 7. The Permittee shall maintain an active cross -connection control program that shall have the following minimum requirements: a. No direct cross -connections shall be allowed between the reclaimed water and potable water systems. b. Where both reclaimed water and potable water are supplied to a reclaimed water utilization site, a reduced pressure principle backflow preventer, an approved air gap separation or other Division of Environmental Health approved device shall be installed at the potable water service connection to the use area. The installation of the reduced pressure principle backflow prevention device shall allow proper testing. c. Where potable water is used to supplement a reclaimed water utilization system, the Permittee or potable water supplier shall approve and regularly inspect the air gap separation. 8. Reclaimed water distribution lines shall be located 10 feet horizontally from and 18 inches below any water line where practicable. Where these separation distances cannot be met, the piping and integrity testing procedures shall meet water main standards in accordance with 15A NCAC 18C. 9. Reclaimed water distribution lines shall not be less than 100 feet from a well unless the piping and integrity testing procedures meet water main standards in accordance with 15A NCAC 18C, but in no case shall they be less than 25 feet from a private well or 50 feet from a public well. 10. Reclaimed water distribution lines shall meet the separation distances to sewer lines in accordance with Rule .0305 of Subchapter 02T. WQ0031857 Version 1.1 . Shell Version 101729 Page 3 of 12 11. The compliance and review boundaries are established at the utilization area boundaries. Any exceedance of standards at the compliance or review boundary shall require action in accordance with 15A NCAC 02L .0106. 12. The compliance and review boundaries for bulk distribution activities have not been established pursuant to 15A NCAC 02T .0910(a)(5). Any exceedance of standards shall require action in accordance with 15A NCAC 02L .0106. 13. The Permittee shall apply for a permit modification to establish a new compliance boundary prior to any sale or transfer of property affecting a compliance boundary. 14. In accordance with 15A NCAC 02L .0107(d), no wells, excluding Division approved monitoring wells, shall be constructed within the compliance boundary except as provided for in 15A NCAC 02L ..0107(g). - - 15. Except as provided for in 15A NCAC 02L .0107(g), the Permittee shall ensure any landowner who is not the Permittee and owns land within the compliance boundary shall execute and file with the Brunswick County Register of Deeds an easement running with the land containing the following items: a. A notice of the permit and number or other description as allowed in 15A NCAC 02L .0107(f)(1); b. Prohibits construction and operation of water supply wells within the compliance boundary; and c. Reserves the right of the Permittee or the State to enter the property within the compliance boundary for purposes related to the permit. The Director may terminate the easement when its purpose has been fulfilled or is no longer needed 16. The facilities permitted herein shall be constructed according to the following setbacks: a. The setbacks for reclaimed utilization sites permitted after September 1, 2006 shall be as follows (all distances in feet): i. Surface waters not classified SA: 25 ii. Surface waters classified SA-., 100 iii. Any well with exception to monitoring wells 100 b. The setbacks for storage and treatment units permitted after September 1, 2006 shall be as follows (all distances in feet): i. Any habitable residence or place of public assembly under separate ownership ° ii. Any private or public water supply source: iii. Surface waters. - iv. Any well with exception of monitoring wells: v. Any property line: 100 100 50 100 50 WQ0031857 Version 1.1 Shell Version 101229. • Page 4 of 11 M. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. The Permittee shall maintain an Operation and Maintenance Plan pursuant to 15A NCAC 02T .0913, which at a minimum shall include operational functions, maintenance schedules, safety measures and a spill response plan. 2. Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC) classification of the subject non -discharge facilities, in accordance with 15A NCAC 08G .0200 the Permittec shall designate and employ a certified operator in responsible charge (ORC) and one or more certified operator(s) as back-up ORC(s). The ORC or their back-up shall visit the facilities in accordance with 15A NCAC 08G .0200, and shall comply with all other conditions specified in the previously cited rules. At the time of this pen -nit issuance, a certified ORC is not required for conjunctive reclaimed water users. A suitable year round vegetative cover shall be maintained at all times, such that crop health is optimized, allows for even distribution of reclaimed water and allows inspection of the utilization system. 4. Adequate measures shall be taken to prevent reclaimed water ponding in or runoff from the utilization sites listed in Attachment B. 5. Utilization shall not be performed during inclement weather or when the ground is in a condition that will cause ponding or runoff. 6. Only reclaimed water from the Oak Island Satellite Water Reclamation Facility shall be utilized on the sites listed in Attachment B. 7. Only reclaimed water from the Oak Island Satellite Water Reclamation Facility shall be utilized for the approved bulk distribution uses listed in Attachment D. 8. Public access to the reclaimed water utilization sites shall be controlled during active site use. Such controls may include the posting of signs showing the activities being conducted at each site. Public access to the wastewater treatment facilities shall be prohibited. The residuals generated from the wastewater treatment facilities shall be disposed or utilized in accordance with 15A NCAC 02T .1100, The Permittee shall maintain a residual management plan pursuant to 15A NCAC 02T .0914. 10. Diversion or bypassing of untreated or partially treated wastewater from the treatment facilities is prohibited, unless diverted to an alternate treatment or collection system. 11. All effluent shall be routed to the West Brunswick Regional Water Reclamation Facility, Permit Number WQ0023693, should the limit for fecal coliform (e.g., daily maximum concentration of 25 colonies per 100 mI) or turbidity (e.g., instantaneous maximum of 10 NTU) be exceeded, until the problems associated with the wastewater treatment plant have been corrected. WQ0031857 Version 1.1 Shell Version 101229 Page 5 of 12 12. An education program shall be developed and implemented to inform reclaimed water users of the proper use of reclaimed water. Educational material shall be provided to all facilities provided with reclaimed water, and these materials shall be maintained consistent with the reclaimed water uses. All educational materials shall be made available to the Division upon request. The Permittee shall develop, implement, and maintain an on -going, comprehensive educational program regarding the Town of Oak Island Reclaimed Water Program and all associated facilities. This program shall be designed to be multi -faceted in that several audiences may use, come into contact with, or install systems associated with reclaimed water shall be specifically targeted. Target audience's shall include, but shall not be limited to, the following: a. Permittee's staff (i.e., especially inspection staff); b. Residential, commercial, industrial, and institutional users; c. Landscaping and lawn care companies; d. Irrigation system installers; e. Tank truck drivers; and f. Construction companies and other contractors (i.e., especially plumbing contractors). All educational programming and materials shall be available in English and Spanish and may be in the farm of formal training sessions, public meetings, publication of notices in local newspapers, notification through television and radio news programs, maintenance of an informational web site, as well as the distribution of flyers or any combination thereof. The following is a non -inclusive list of topics that may be included in educational programming and materials (i.e., various target audiences may have needs that are specific to their involvement with the Town of Oak Island Reclaimed Water Program and all associated facilities): a. Reclaimed water description and safety; , b. Review of all applicable local ordinances (i.e., "Waste While Watering," "Rain Sensor," and "Reclaimed Water") as well as the consequences associated with violating any of the requirements contained therein; c. Review of application and review process, permit approval, and inspection requirements; d. Approved and disapproved uses of reclaimed water; e. Procedures for application (i.e., including buffer maintenance and application rate determination), use, and storage of reclaimed water as well as the disposal of unused reclaimed water; f. Procedures for spill prevention, control, and notification requirements; g. Personal safety and hygiene issues; h. Description of labeling requirements and security measures (i.e., special hose fittings, locked valve boxes, special pipe color, etc.); i. Cross -connection control program description. WQ0031857 Version 1.1 Shell Version 101229 Page 6 of 12 13. For bulk conjunctive distribution operations the following requirements shall be met: a. The Permittee shall develop and implement an operation and maintenance plan, which includes but is not limited to the following i. Description of operation; ii. Description of anticipated maintenance; iii. Safety measures, including site restrictions; iv. Spill prevention and spill response plan; v. Contact information for plant personnel, emergency responders, and regulatory agencies; vi. Approval procedures of users; vii. Operational requirements for users; and viii.If reclaimed water is to be stored for greater than 72 hours prior to use, include a description of how compliance with reclaimed water quality standards will be ensured at the time of use. b. An education program shall be developed and implemented to inform bulk conjunctive reclaimed utilization users of the proper use of reclaimed water for each approved use (Attachment D). Educational material shall be provided to all individuals accepting the bulb reclaimed water and shall be made available to the Division upon request.. c. The Permittee shall approve tank truck drivers for participation in the bulk reclaimed water distribution program prior to distribution of reclaimed water. In addition, the Permittee shall provide bilingual (English and Spanish) training to all tank truck drivers approved to participate in the bulk reclaimed water distribution program at a regular frequency. These sessions shall provide training on, but not limited to, the following topics: i. Reclaimed water description and safety; ii. Allowable and prohibited uses of reclaimed water; iii. Procedures for the application (including buffer maintenance), uses, and storage of reclaimed water as well as the disposal of unused reclaimed water; iv. Procedures for spill prevention, countermeasures, and control as well as notification requirements; v. Personal safety and hygiene issues; and vi. Interaction with the general public. d. Tank trucks used to transport reclaimed water shall meet the following requirements: i. Tank trucks and other equipment used to distribute reclaimed water shall be clearly identified with advisory signs. Signage could include but is not limited to "RECLAIMED WATER — DO NOT DRINK", "NON -POTABLE WATER", or a combination of similar phrases. ii. Tank trucks used to transport reclaimed water shall not be used to transport potable water that is used for drinking or other potable purposes. iii. Tank trucks used to transport reclaimed water shall not be filled through on -board piping or removable hoses that may subsequently be used to fill tanks with water from a potable water supply. Tank trucks owned and operated by the Permittee and dedicated to be filled by reclaimed water only may be filled through on -board piping. iv. Tank trucks shall not have been used to haul septage, biosolids, or other waste or chemical transport. v. Tank trucks shall not have any type of removable container or portable bladder except if the tank/bladder is permanently labeled for reclaimed water use only and a letter from the truck owner is submitted to the Permittee indicating that in no case shall any removable container or portable bladder be used for both reclaimed and potable water at any time. Any Division required monitoring {including groundwater, plant tissue, soil and surface water analyses) necessary to ensure groundwater and surface water protection shall be established, and an acceptable sampling reporting schedule shall be followed. 2. Per 15A NCAC 02H .0800, a Division certified laboratory shall conduct all laboratory analyses for the required effluent, groundwater or surface water parameters. 3. Flow distributed to the conjunctive reclaimed water system shall be continuously monitored, and daily flow values shall be reported on Form NDMR. The Permittee shall install and maintain an appropriate flow measurement device to ensure the accuracy and reliability of flow measurement consistent with accepted engineering and scientific practices. Selected flow measurement devices shall be capable of measuring flows with a maximum deviation of less than ten percent from true flow; accurately calibrated at a minimum of once per year; and maintained to ensure the accuracy of measurements is consistent with the selected device's accepted capability. The Permittee shall maintain records of flow measurement device calibration on file for a period of at least five years. At a minimum, documentation shall include: a. Date of flow measurement device calibration, b. Name of person performing calibration, and c. Percent from true flow. 4. The Permittee shall monitor the effluent from the subject facilities at the frequencies and locations for the parameters specified in Attachment A. 5, The Permittee shall maintain adequate records tracking the amount of reclaimed water distributed or utilized. At a minimum, these records shall include the following information for each utilization site listed in Attachment B: a. Date of distribution or utilization; b. Volume of reclaimed water distributed or utilized (i.e., monthly total); and c. Weather conditions (for irrigation sites owned or operated by the Permittee only). 6. The Permittee shall maintain adequate records of all bulk conjunctive reclaimed water distributed. These records shall include, but are not necessarily limited to: a. Date, time, and volume of each bulk distribution event; b. Name and drivers license number for tank truck operators; c. Bulk fill certification number; d. Intended use of the reclaimed water; e. Turbidity measurement result; and f. Total volume of bulk reclaimed water distributed each month. 7. Three copies of all monitoring data (as specified in Conditions IV.3. and IVA.) on Form NDMR for each PPI, three copies of all operation and disposal records (as specified in Condition N.S.) on Form NDAR-3 for every site in Attachment B, and three copies of all bulk conjunctive use distribution records (as specified in Condition IV.6.) on Form NDAR-3 shall be submitted shall be submitted on or before the last day of the following month. if no activities occurred during the monitoring month, monitoring reports are still required documenting the absence of the activity. Pursuant to § 143-215.1 C., the Permittee shall provide to its users and the Division of Water Quality an annual report summarizing the performance of the wastewater treatment and utilization facility and the extent to which the facility has violated this permit, or federal or State laws, regulations, or rules related to the protection of water quality. This report shall be prepared on either a calendar or fiscal year basis and shall be provided no later than 60 days after the end of the calendar or fiscal year. Two copies of the annual report provided to the Permittee's users shall be submitted to: Division of Water Quality Aquifer Protection Section 1636 Mail Service Center Raleigh, North Carolina 27699-163.6 9. A maintenance log shall be maintained at this facility. This log shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. At a minimum, this log shall include: - a. Date of calibration of flow measurement device; b. Visual observations of the plant and plant site; and c. Record of preventative maintenance (e.g., changing of equipment, adjustments, testing, inspections and cleanings, etc.). 10. A reclaimed water user inspection log shall be maintained at this faciiit3 . This log shall be maintained at the facility for a period of no less than five years, and shall be made available to the Division upon request. At a minimum, this log shall include: a. Visual observations of the reclaimed water user facilities; and b. Record of preventative maintenance (e.g., pump and valve maintenance, cross connection control, etc.). 11. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office, telephone number (910) 796-7215, as soon as possible, but in no case more than 24 hours, or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the facility resulting in the treatment of significant amounts of wastes that is abnormal in quantity or characteristic, including the known passage of a hazardous substance. b. Any process unit failure (e.g., mechanical, electrical, etc.), due to known or unknown reasons, rendering the facility incapable of adequate wastewater treatment. c. Any facility failure resulting in a by-pass directly to receiving surface waters. d. Any time self -monitoring indicates the facility has gone out of compliance with its permit limitations. e. Ponding in or runoff from the utilization sites. Any emergency requiring immediate reporting (e.g., discharges to surface waters, imminent failure of a storage structure, etc,) outside normal business hours shall be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following first knowledge of the occurrence. INSPECTIONS The Pern-dttee shall provide adequate inspection and maintenance to ensure proper operation of the wastewater treatment and utilization facilities. 2. The Permittee or their designee shall inspect the wastewater treatment and utilization facilities to prevent malfunctions, facility deterioration and operator errors resulting in discharges, which may cause the release of wastes to the environment, a threat to human health or a public nuisance. The Permittee shall maintain an inspection log that includes, at a minimum, the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for a period of five years from the date of the inspection, and this log shall be made available to the Division upon request. 3. Any duly authorized Division representative may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater treatment and utilization facilities permitted herein at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records required to be maintained under the terms and conditions of this permit, and may collect groundwater, surface water or leachate samples. 4. In accordance with 15A NCAC 02T .0911(f) and to ensure compliance with the conditions of this permit, the Perrnittee shall inspect the utilization sites of all reclaimed water users who obtain more than 10,000 gallons per day of bulk distributed reclaimed water. Permittee inspection of these bulk distribution reclaimed water utilization sites does not need to exceed one inspection per quarter. The Permittee shall maintain records of these inspections for at least five years, and shall make them available to the Division upon request. VI. GENERAL CONDITIONS 1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes 143- 215.6A to 143-215.6C, 2. This permit shall become voidable if the permitted facilities are not constructed in accordance with the conditions of this permit, the Division approved plans and specifications, and other supporting documentation. 3. This permit is effective only with respect to the nature and volume of wastes described in the permit application, Division approved plans and specifications, and other supporting documentation. No variances to applicable rules governing the construction or operation of the permitted facilities are granted, unless specifically requested and approved in this permit pursuant to 15A NCAC 02T .0105(n). 4. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies (e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules in 15A NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCG010000; any requirements pertaining to wetlands under 15A NCAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of Chapter 143 of the General Statutes, 5. In the event the permitted facilities change ownership or the Permittee changes their name, a formal permit modification request shall be submitted to the Division. This request shall be made on official Division forms, and shall include appropriate property ownership documentation and other supporting documentation as necessary. The Permittee of record shall remain fully responsible for maintaining and operating the facilities permitted herein until a permit is issued to the new owner. The Permittee shall maintain this permit until all permitted facilities herein are properly closed or permitted under another permit issued by the appropriate permitting authority pursuant to 15A NCAC 02T .01050). 8. This permit is subject to revocation or unilateral modification upon 60 days notice from the Division Director, in whole or part for the requirements listed in 15A NCAC 02T .0110. 9. Unless the Division Director grants a variance, expansion of the permitted facilities contained herein shall not be granted if the Permittee exemplifies any of the criteria in 15A NCAC 02T .0120(b), 10. The Permittee shall pay the annual fee within 30 days after being billed by the Division.
