Post Office Box 3588 Winchester, Va. 22604-2586 Subject: Pump & Haul Permit No. WQ0030125 Carolina By -Products -Rose Hill Duplin County Dear Mr. Gibson: In accordance with your application received April 13, 2006, we are forwarding herewith Permit No. WQ0030125, dated April 13, 2006 to Carolina By -Products for the temporary operation of pump and haul activities transporting up to 20,000 gpd of treated domestic & industrial wastewater from the Carolina By -Products spray irrigation lagoon, Permit No. WQ0000485, to the influent pumping .station of the Town of Rose Hill WWTP, Permit No. NC0056863. This permit shall be effective from April 13, 2006 until October 13, 2006 and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will constitute noncompliance with the permit. Also, please note Condition No. 8 in the permit which states that the permit will not be renewed and that the pump and haul activity will cease upon the expiration date. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Environmental Regional Supervisor II Jb:cs:pump&haul.406 Cc: Mr. Thomas Drum (Town of Rose Hill) Wilmington APS Files Central APS Files NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT, AND NATURAL RESOURCES RALEIGH PUMP AND HAUL PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations: PERMISSION IS HEREBY GRANTED TO Carolina By -Products (Rose Hill) Duplin County for the temporary operation of a pump and haul operation for transporting treated industrial & domestic wastewater from the Carolina By -Products spray irrigation lagoon located at Highway 117, Rose Hill to the Town of Rose Hill Wastewater Treatment Plant influent pumping station with no discharge of wastes directly to the surface waters, pursuant to the application submitted to the Department of Environment, and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until October 13, 2006 and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the subject pump and haul activities are carried out in a manner which has been approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. No type of wastewater other than treated industrial & domestic waste from the Carolina By - Products Manufacturing Facility, located at Highway 117, Rose Hill, shall be included in the pump and haul activities. 6. This permit shall become voidable unless the agreements between Carolina By -Products and the Town of Rose Hill are in full force and effect. 7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all pump and haul activities, and take such immediate corrective action as may be required by this Division. 8. This pump and haul permit shall not be renewed. The pump and haul activity shall cease upon the expiration date of this permit. 9. The treated wastewater collected by this system shall be transferred to the Town of Rose Hill Wastewater Treatment Plant by Carolina By -Products personnel for ultimate treatment and disposal in accordance with conditions of the Town's NPDES Permit No. NCO056863 issued by the Division of Water Quality. Pump & haul transfers to the Town' s influent pumping station shall be accomplished Monday through Friday between the hours of 9 am to 11 am and between the hours of 2 pm and 4 pm. 10. The Permittee (Carolina By -Products) is liable for any damages caused by a spill or failure of the pump and haul operations. 11. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 12. The Permittee (Carolina By- Products) or their designee shall inspect the wastewater collection facilities to prevent malfunctions, deterioration, operator errors, and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions takers by the Permittee. This log of inspections shall be maintained by the Permittee for as long as the pump and haul activities are being conducted and shall be made available upon request to the Division of Water Quality or other permitting authority. 13. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater collection facilities at any reasonable time for the purpose of determining compliance with this permit and may inspect or copy any records that must be kept under the terms and conditions of this permit, and may obtain samples. 127 North Cardinal Dr., Wilmington, North Carolina 28405 An Equal Opportunity Affirmative Action Employer Telephone 910-796-7215 FAX 910-350-2004 50% recyeled/10% post -consumer paper Pump & Haul Permit No. WQ0030125 Page Three 14. An accurate record of the pump and haul activities must be maintained by the Permittee indicating: date wastewater is removed from the facility. name of facility from which wastewater is removed. name of facility receiving wastewater, volume of wastewater removed, status of permanent disposal option. These records shall be submitted to the Wilmington Regional Office of the Division of Water Quality located at 127 Cardinal Drive Extension, Wilmington, North Carolina, 28405 on or before the fifteenth (15th) day of the following month. 15. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A. 16. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal), which have jurisdiction. 17. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office at telephone no.(910) 796-7215 as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any failure of equipment, storage or transportation facilities resulting in a by-pass directly or indirectly to waters or lands of the State. Persons reporting such occurrences by telephone shall also file a written report within 15 days following first knowledge of the occurrence. This report should be directed to Mr. Charles Stehman, Ph.D, P.G., Environmental Regional Supervisor II, NCDENR, 127 Cardinal Drive Extension, Wilmington, North Carolina 28405 and must outline the actions taken to clean up the wastewater and ensure that the problem does not recur. 18. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division, Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H. 0205. Because the Town has fulfilled all the requirements to reduce the monitoring outlined in Condition 111.3. of the June 22, 2006 permit, the Division is issuing the Town an updated Attachment A. Please replace this Attachment A dated June 22, 2006 with the new Attachment A. On August 5, 2009, Session Law 2009-406, entitled "An Act to Extend Certain Government Approvals Affecting the Development of Real Property Within the State," was enacted by the General Assembly and signed into law. The Act, known as the Permit Extension Act of 2009, extends the expiration date of certain government approvals and permits. This permit, WQ0030132, issued by the Division of Water Quality falls within the scope of this Act and is therefore being extended until June 22, 2014. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems.
