This permit, issued on September 30, 2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Corolla Ferrv Dock
1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
2) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2008

3) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
4) The authorized covered platform at the end of the access pier shall not be enclosed. Any material used
on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides
along with benches and knee walls are permitted. Lattice is specifically excluded from being used under
this authorization.
5) The roof of the covered platform shall not be designed for second story use.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
8) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day
operation of the facility to prevent facility waste from entering the adjacent waters. Such
discharge, either directly or indirectly, to adjacent waters could contravene state water quality
standards, thereby violating state law.
NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in
association with the docking facility. The issuance of this permit does not relieve the permittee
from taking all proper steps to ensure the integrity of the structure and the safety of moored
boats. The permittee shall not hold the State of North Carolina or the United States liable for any
damage to the structure or moored boats.

11) In order to ensure compliance with the buffer requirements of the Coastal Resources Commission, the
proposed highground gazebo and associated decking shall be relocated so that all portions of the gazebo
and all but a maximum of 200 square feet of the associated uncovered decking are a minimum of 30 feet
from the normal water level. A modified site plan depicting this relocation shall be submitted to and
approved by the Division of Coastal Management prior to initiation of construction of the gazebo and
associated deck.
12) In order to ensure that the gazebo and associated deck do not adversely impact the historic character of
the Whalehead Club, the permittee shall coordinate the design of the gazebo and associated decking with
the N.C. State Historic Preservation Office (SHPO) before beginning construction on this component of
the project. Contact the SHPO at (919) 733-4763 to initiate this coordination. A written statement of
SHPO's concurrence shall also be submitted to the Division of Coastal Management prior to initiation of
construction of the gazebo and associated deck.
General
13) No vegetated wetlands, marsh grass or submerged aquatic vegetation shall be excavated or filled, even
temporarily.
14) Dredging in any manner, including "kicking" with boat propellers, is not authorized.
15) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal water level.

8. PROJECT SUMMARY: Currituck County proposes to construct a pier 8'-11" x 507' long
with a 8' x 50' concrete floating dock for a pedestrian passenger ferry, to run from Corolla to
an existing docking facility on the Currituck Mainland, near the old Currituck Courthouse.
The plans also include a 640sf gazebo and a walking path from the existing parking lot
adjacent to the boat ramp.
The project site is located at the Historic Whalehead Club on the Currituck Outer Banks in
Corolla Village (also known as Heritage Park), and more specifically described as being on the
west side of NC 12 (Ocean Trail), adjacent to Whalehead Bay and Currituck Sound, immediately
south of the Corolla Lighthouse. Situated on the north side of the property is the Corolla
Lighthouse and to the south is Corolla Light Planned Unit Development Subdivision. The
property is bounded on the west side by Currituck Sound (Whalehead Bay) and to the east by
NC 12 (Ocean Trail).
The Whalehead Club property is located on approximately 35 acres that was originally developed
as a hunting and fishing club during the mid 1920s. Improvements on the property include the
main house (or lodge), a boathouse, a footbridge, a man-made canal, a boat basin, and a pond on
the northeast corner of the property. In 1986, Advanced Property Concepts began construction on
a 36 slip docking facility in the boat basin in 1987 under CAMA Major Permit #141-86, but
defaulted on the property soon after the basin was completed. Currituck County purchased the
club from the receiving bank, and began renovations that have included reconstruction of the
footbridge, repairs to the house, the addition of a public boat ramp and six slips (CAMA Major
Permit #148-89), and the placement of riprap along the shoreline adjacent to the sound for
erosion control (LAMA Major Permit #166-96).
In 1997, Currituck County applied for a third CAMA Major Permit to dredge a channel from the
Currituck Sound to the boat basin. The request included placing dredge spoil in a second pond,
located on the southwest side of the clubhouse, between the house and Currituck Sound. The
Division denied the request based on inconsistencies with state standards, and the Currituck
County Land Use Plan.
On the southwest side of the main house is the man-made pond excavated in the 1980s in

conjunction with restoration requirements, resulting from a violation that was issued to a
previous owner of the property, by the US Army Corp of Engineers. The violation issued was for
the unauthorized filling of an existing pond that was located on the property prior to 1985, on the
northeast side of the tract, as noted above.
High ground vegetation on the property includes Live Oak (Quercus virginiana), Loblolly Pine
(Pintts taeda), Black Cherry (Prunus serotina), Wax Myrtle (Myrica cerifera), and a variety of
lawn grass and ornamentals. Wetland vegetation includes Olney's Three Square (Scirptts
americanus), Salt Meadow Hay (Spartina patens), Soft Rush (Juncos effusus), Sea Ox-eye
(Borrichia frutescens), big cord grass (Spartina cynosourides), and Cattail (Typha latifolia).
Submerged aquatic vegetation includes water milfoil (Myriophylltnn spicatum) and widgeon
grass (Ruppia ntaritinta). Birds seen in and around the pond include, but are not limited to, the
Great Blue Heron (Ardea herodias), Little Blue Heron (Egretta caerulea), Great Egret
(Casmerodius albus), American Coot (Fulica Americana), Double-Crested Cormorant
(Phalacrocorax attvitus), kingfisher (Ceryle alcyon), Canadian Goose (Branta Canadensis), and
a variety of ducks.
In 2003 the NC Ferry Division was issued a violation for the unauthorized dredging of a 700'
channel and basin in Whalehead Bay terminating at the dock immediately adjacent to the boat
ramp. The channel was restored to the pre-dredge depth and a survey was made to determine
damage to surrounding submerged aquatic vegetation.
The Currituck Sound is classified as joint waters by agreement between the Marine Fisheries
Commission and Wildlife Resources Commission. The Division of Environmental
Management's water quality classification for the Albemarle Sound is SC (fish propagation).
Review indicates that there are no identified archeological sites on the property, but that it is on
the National Historic Register.
PROJECT DESCRIPTION
The applicant, Currituck County, is proposing to construct a ferry docking facility at the
Whalehead Club in Corolla Village. The pier system being proposed will be used to transport a
maximum of 49 pedestrians back and forth from the Currituck Outer Banks and Currituck
mainland. The existing facility is located near the Currituck County Courthouse off Courthouse
Road, and currently docks a ferry servicing Knotts Island. In 2004 NCDOT obtained permits to
construct a separate dock for the Corolla Ferry.
The vessel that will be used is a 50' pontoon boat that drafts approximately 34". The proposed
pier will provide a floating dock to on and off load passengers. Water depths at the proposed
dock location are approximately four feet below normal water level (NWL). A NCDOT survey of
the adjacent water bottom shows that he proposed pier will be near, but shade know SAV beds.

The proposed pier and docking facility will include a walking path from an existing boat ramp
parking area and following along the shoreline of Whalehead Bay to the peninsula on the south
side of the property. Located on the west end of the peninsula, adjacent to the pier, the County
proposes to construct a gazebo and deck/Boardwalk for waiting passengers, to provide shelter
during inclement weather.
The facility will include the following:
1) Pier and Walkway Access
A Pier 8'-11" x 507 with a 4' x 20' metal gangway leading to an 8' x 50' concrete
floating dock held in place by four pilings. Approximately 5.5' of the gangway will
overlap the floating dock for safe access. A roofed area will be constructed over the end
of the fixed pier to protect passengers from the elements. Approximately 86.5' from the
end of the fixed pier, the pier will split to a narrower four-foot wide walking path leading
to the covered area. The fixed pier will terminate at the covered area with a walkway on
the south side sloping down to a day use dock where approximately six boats can tie up
along the side of the structure. The covered area will also lead to the gangway and
floating dock on the north side of the pier. A railing will be constructed along the
perimeter of the entire pier system to assure the safety of the passengers, with the
exception of the day use area toe off vessels.

2) Gazebo and Deck (Referenced as a Boardwalk on the Plans)
Located landward of the pier, the county is proposing the construction of a partially
enclosed gazebo and deck. A small section of the deck will extend over Estuarine and
Public Trust Water Area of Environmental Concern (AEC). The entire gazebo will be
located within the Estuarine Shoreline AEC and the 30' Buffer.

2) Access Path
A six-foot wide sidewalk is proposed from the parking area on the west side of the
property, adjacent to the boat ramp, extending to the gazebo. The walkway will
provide a walking path and will be accessible to a cart to transport handicapped
pedestrians to the waterward end of the pier. The County has proposed using pervious
concrete, paver bricks, or shell as allowed. The path will have an 18' x18' area at the
beginning of the path near the parking lot.
Total area of path within the Estuarine Shoreline AEC: 4,254sf
Area of path that will fall within the 30' buffer: 750sf
Note: The above impacts are the applicant's calculations.
Staff calculations suggest impacts are slightly higher at 4,470sf.
ANTICIPATED IMPACTS
. Total area shaded by the proposed pier and dock system will be approximately 4,828sf by
staff calculation, if approved.
. The landward portion of the pier/walkway will shade 190sf of Estuarine Shoreline.
. It is anticipated that the 640sf pile supported gazebo, proposed within the 30' buffer, may
cause a slight increase in surface runoff from the roof.
. The deck/boardwalk will shade a small area of Estuarine Water (80sf).
. The ferry service, facilitated by the construction of the proposed pier, will provide
pedestrian access to and from the Currituck mainland, as well as providing access to the
Currituck County school system by children living on the Outer Banks (currently there is
no school on the Currituck Outer Banks).
. It is anticipated that the ferry service facilitated by the proposed project will also provide
increased access to workers commuting to the Outer Banks.
. It is also anticipated there will be increased visitors to Heritage Park and the Currituck
beaches by day-trippers
. Temporary localized turbidity is anticipated within the project area during construction if
the permit is approved.
. The existing depth at the proposed dock location appears to be sufficient for the ferry to
operate with the hydro-lift and avoid scrubbing the water bottom under normal operating
conditions.

The purpose for this CAMA application is to provide access to navigable waters
for a passenger ferry in which the main purpose is to transport school children across the
Currituck Sound from Corolla to the ferry docks at Currituck on the mainland.
The Whalehead property in Corolla aka Currituck Heritage Park is an
approximate 35 acre parcel owned by Currituck County which consists of the Whalehead
Club, a restored 1925 hunt club, and the North Carolina Wildlife Resources Commissions
Outer Banks Center for Wildlife Education. This park also includes a boat basin, boat
ramp, pedestrian bridge, and 5 short piers for boat docking. Navigable water to and from
the boat basin, boat ramp, and docking piers are limited because of shallow waters. The
current water depths prohibit the NCDOT passenger ferry from access to the existing
piers making it a necessity for a new pier off the southwest property corner extending out
into navigable waters of -4 to -4.5 feet.
The project includes a walkway from the existing boat ramp parking lot to the
proposed gazebo and pier. The walkway will be pervious pavers or crushed shell for a
length of 709 feet, width 6 feet, covering a total of 4254 square feet. 140 feet of the
walkway or a total of 750 square feet of the proposed walkway is located within the 30
foot CAMA buffer as well as the 640 square foot gazebo which is located at the
southwestern end of the walkway and at the beginning of the proposed pier. The walkway
will be connected to the pier by a semicircle deck around the gazebo. The pier is
proposed at 507 feet long with an 8 foot wide decking with total width including
handrails at 8'-11". Elevations of the pier start at 3.5 at the gazebo/deck and transition to
6.0 in the first 72 feet with the last 72 feet transitions from 6.0 to 3.5 feet. The end of the
dock will be covered with a cedar singled roof of 205 square feet (sheet 4 of 5
dimensions is in error). On the north side there will be an 8x50 concrete floating dock
provided by NCDOT placed perpendicular to the pier which will be connected to the pier
by a 4x20 aluminum gangway. At the end of the pier on the south side there will be a
sloped day use pier for six (6) boat moorings. This will be a 72 feet long and 4 foot wide
and will be inset into the main pier. No portion of the proposed pier that is located over
the water will shade any SAV's.
This development will not cause irreversible damage to valuable, historic
artichiteetural or archaeological resources as documented by the local historic
commission or the North Carolina Department of Cultural Resources.
