OF WATER QUALITY D'R`-? ; `` OFFICE In the year 2000, I purchased a lot containing 6 acres of land at 8715 Wilkinson Boulevard in Charlotte, N.C. It had a stream running through a long gully. I applied for permission to install pipe in the stream so that I could fill it with dirt in order to have a useable piece of property. I asked for 300 feet and received permission for only 125 feet. I paid the permit fees, hired a contractor and have been able to create a decent looking area for some use but am not able to use all of the land. I applied again for permission to pipe in 175 feet and was informed in a letter, by D. Rex Gleason, PE, that since fish were in the stream, I would have to pay $220.00 per lineal feet for any additional footage plus pay the same for 125 feet that had already been installed. This would cost me $66,000.00 -just for permission to pay for the pipe and installation. Today I received a permit from the U.S. Army Corps of Engineers to go ahead with this project but stated that written concurrence from the NC Division of Water Quality may also be required. This is the same group that told me I would have to pay an additional $66,000.00 to get permission to finish. This seems very unfair to me and I am asking your help in this matter. Thank you. This was based on the observance of a school of minnows (approx. a dozen - 3-4 inches) at the upstream end of the reach. It had not rained recently and had been a drought for a while. Site visit was on Sept. 20, 2005. I didn't do a form at the time, feeling it wasn't necessary, but can go back out there and do one. I explained to Mr. Sparrow that we really need a complete application to proceed with review, and that he needs to be conferring with the Corps of Engineers as to what type of 404 Permit he'll need to cover the additional impacts. I also mentioned that if he's not able to work through these details, he'll need to find a consultant with experience in 404/401 issues. In the meantime, this file was placed on hold by the MRO with no associated deadline, so I'll return it to the hold drawer. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete.
