We wrote to you on September 23, 2005 discussing concerns that we have regarding the design of the project and stating that it would be placed on hold for three weeks giving you time to address DWQ's concerns. As of today, DWQ has not received a response to this request. Therefore, your file is hereby considered withdrawn and will not be reviewed until DWQ's earlier concerns are addressed. Once you have collected sufficient information to have a complete application (please see our September 23, 2005 letter for the missing information), you will need to reapply for DWQ approval. This includes submitting a complete application package with the appropriate fee. Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity and any work done within waters of the state would be a violation of North Carolina General Statuses and Administrative Code. The Division of Water Quality (DWQ) is required to prepare a "preliminary finding" /"finding of fact" as to whether the variance request meets the requirements of 15A NCAC 02B .0233(9)(a). The DWQ may attach conditions to a variance approval that support the purpose, spirit and intent of the riparian buffer protection program. Conditions usually include stormwater management and buffer mitigation. Additional information will be required before we can proceed with the review of your variance request. Therefore, unless additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B .0233 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: 1. Buffer Mitigation Buffer mitigation will most likely be required as a condition if you choose to proceed with either the Minor or Major Variance. If you choose to proceed with a variance, then please provide a buffer mitigation plan pursuant to 15A NCAC 02B .0233. 2. Stormwater Management Stormwater management will be required as a condition if you choose to proceed with either the Minor or Major Variance. Please consider screening in a portion of the existing deck or screening in an area to the east of the existing deck. • The variance request form request additional impacts than that are shown on the plan. This plan should be drawn to scale, please draw accurately. The foundation and several rows of cinder block were already up. They were at first going to move the structure, but due to the presence of some large hardwood trees, it looked like any place they moved it to would probably damage the roots of the trees. I really don't have a problem with this one, although they did buy the house in 2002 (not that anyone would have told them about the buffer rules).
