Base Camp Lejeune, datcd March 14, 2006.. This Certification replaces the Certification issued to you
on November 14, 2005. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Solid Waste, Sediment and Erosion Control,
Stormwater, Dam Safety, Non-discharge and Water Supply Watershed regulations.

NORTH CAROLINA 401 WATER QUALITY CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-
500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ)
Regulations in 15 NCAC 2H, Section.0500 to the Commanding General of Marine Corps Base Camp
Lejeune to fill 0.418 acres of jurisdictional wetlands in the White Oak River Basin, associated with the
construction of targets and service roads in Onslow County, North Carolina, pursuant to an application filed
on the 11th day of July of 2005, and in additional correspondence received September 29, 2005 and March
13, 2006.
The application and supporting documentation provides adequate assurance that the proposed work will
not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the
State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application, the
supporting documentation, and conditions hereinafter set forth.
This approval is only valid for the purpose and design submitted in the application materials and as
described in the Public Notice. If the project is changed, prior to notification a new application for a new
Certification is required. If the property is sold, the new owner must be given a copy of the Certification
and approval letter and is thereby responsible for complying with all conditions of this Certification. Any
new owner must notify t5e Division and request the Certification be issued in their name. Should wetland
or stream fill be requested in the future, additional compensatory mitigation may be required as described
in 15A NCAC 2H.0506 (h) (6) and (7). If any plan revisions from the approved site plan result in a
change in stream or wetland impact or an increase in impervious surfaces, the DWQ shall be notified in
writing and a new application for 401 Certification may be required. For this approval to be valid,
compliance with the conditions listed below is required.

Sediment and Erosion Control:
2. Erosion and sediment control practices must be in full compliance with all specifications governing
the proper design, installation and operation and maintenance of such Best Management Practices in
order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Sediment and Erosion Control Planning and Design Manual.

b. The design, installation, operation, and maintenance of the sediment and erosion
control measures must be such that they equal, or exceed, the requirements specified
in the most recent version of the North Carolina Sediment and Erosion Control
Manual. The devices shall be maintained on all construction sites, borrow sites, and
waste pile (spoil) projects, including contractor-owned or leased borrow pits
associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the 404/401Permit Application. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards,
statutes, or rules occur;
4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored within six months of the date that the
Division of Land Resources has released the project;

Continuing Compliance:
5. The Commanding General and Marine Corps Base Camp Lejeune, shall conduct construction
activities in a manner consistent with State water quality standards (including any. requirements
resulting from compliance with section 303(d) of the Clean Water Act) and any other appropriate
requirements of State law and federal law. If the Division determines that such standards or laws are
not being met (including the failure to sustain a designated or achieved use) or that State or federal
law is being violated, or that further conditions are necessary to assure compliance, the Division may
reevaluate and modify this Certification to include conditions appropriate to assure compliance with
such standards and requirements in accordance with 15A NCAC 2H.0507(d). Before modifying the
Certification, the Division shall notify the Commanding General and/or Marine Corps Base Camp
Lejeune and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC
211.0503 and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any
new or revised conditions shall be provided to the Commanding General and/or Marine Corps Base
Camp Lejeune in writing, shall be provided to the United States Army Corps of Engineers for
reference in any Permit issued pursuant to Section 404 of the Clean Water Act, and shall also become
conditions of the 404 Permit for the project;
Miti ation:
6. Compensatory Mitigation Using a Mitigation Bank
Mitigation must be provided for the proposed impacts as specified in the table below. We
understand that you intend to purchase credits from the Greater Sandy Run Wetland Mitigation
Bank in Onslow County as described in your application to meet this mitigation requirement.
Our records show that the Greater Sandy Run Wetland Mitigation Bank in Onslow County is
available for credit release for your project. This contribution has been determined by the DWQ
to be a suitable method to meet the mitigation requirement. Until the Greater Sandy Run Wetland

Mitigation Bank receives and clears your check, and proof of payment has been provided to this
Office, no impacts specified in this Authorization Certificate shall occur. For accounting

Can your office just make the change and issue? I even sent them and on hold letter
stating the amount of mitigation they proposed and requesting info. on the bank
credits available. These mods are killing me. What about the one for 04-0047,
Village at Motts Landing, New Hanover? I have no concerns with either mod request.

Dear Ms. Karoly:
This letter is written in response to DWQ # 051058,
Certification No. 3545 issued November 14, 2005 for a project at
the SR-7 Range in the Camp Lejeune Greater Sandy Run Training
Complex. The certification application for this project was
previously submitted by Avolis Engineering, P.A. on behalf of
Camp Lejeune. The project consists of installing new targets
and access paths within the maintained footprint of an existing
live-fire range, the SR-7 Range.
Our compensatory mitigation proposal for the subject project was
to provide 2.92 acres of restored 404 wetlands for 0.418 acres
404 wetland impacts. Mitigation credits were to be debited from
available credits in Camp Lejeune's Greater Sandy Run Area
Wetland Mitigation Bank.
It has come to our attention, that the mitigation of 2.92 acres
that we proposed in the application exceeds the required
compensatory mitigation requirements that would satisfy this
project.
In accordance with 15A NCAC 02H.0502, the minimum acceptable
mitigation ratio for the replacement of wetland acres is at a
ratio of 1:1 acres mitigated to acres lost. Camp Lejeune
proposes to mitigate 0.418 acres of non-riparian impacts with
0.627 acres of restored pocosin/pine flat wetland credits from
the GSRA Wetland Bank, a ratio of 1.5 to 1 acres mitigated to
acres lost in accordance with the approved credit/debit ratios
as stated in the Greater Sandy Run Wetland Mitigation Banking
Instrument, November 2, 2000.
We request that you modify and re-issue DWQ # 051058,
Certification No. 3545 issued November 14, 2005 to reflect our
mitigation request of 0.627 acres.

Nicole, I am providing the attached information in response to your letter (also attached).
1. Impact justification.
Camp Lejeune Marine Base currently performs live-fire weapons training on the SR-7 range in the GSRA. A
DA'Permit, Action ID No. 1199400693 was issued on 10 April 1995 to discharge fill material into 404 Wetlands for
the Military Construction Project P-949, now the SR-7 Range, a range designed for main battle tanks and variants
of armored personnel carriers in the Marine Corps> '> current inventory.
Our current proposal will simply permit the installation of additional, automated targets within the
previously cleared and constructed, range footprint. They will be placed at distances from firing points where no
targets currently exist. This range enhancement project is in response to new training requirements that have
evolved as a result of numerous, recent contingency operations. The types of weapons, training intensity and
duration of training at this range is not expected to change significantly. The new targets simply provide more
opportunities for marine infantry to use their weapons at various distances using existing, organic capabilities.
All reasonable measures have been taken to minimize, avoid, and mitigate wetland impacts for this project.
Placing targets in this existing range allows personnel to meet training requirements without requiring the
construction of a new range. The targets must be located at designated, known distances, requiring some targets
to be located in wetlands. However, the target sites and access roads have been designed to minimize impacts to
the greatest extent possible. This activity is consistent with the Greater Sandy Run Area Master Development Plan
to develop a multi-purpose range complex.
2. Mitigation
Attached is the Greater Sandy Run Area Wetland Mitigation Banking Instrument signed December 2000. Paragraph 14 of
the General Provisions provides details of the forms and amounts of compensatory mitigation in the GSRA Bank. The
bank was intended to provide 886.8 acres of pocosin (non-riparian) restoration. We've used 356 pocosin restoration
credits to date. 135 Pocosin credits are currently available as compensatory Mitigation in the Bank. The USACE
approved performance criteria and released 490.5 pocosin credits and 143.4 bottomland hardwood credits (in Big
Shakey Swamp) in 2004 (letter attached).
3. Future Plans/Preservation
The Marine Corps has no current plans for additional impacts to the SR-7 Range area. The 1250 acre wetland
mitigation bank in the GSRA was established to provide compensatory mitigation for unavoidable wetland impact sin
the GSRA. There are no current plans to designate additional wetland preservation areas within the GSRA.

On July 11, the Division of Water Quality (DWQ) received your application dated April 4, 2005 to
impact 0.418 acres of wetlands to construct the proposed targets for rifle training. The DWQ has
determined that your application was incomplete and/or provided inaccurate information as discussed
below. The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional
information requested below, we will have to move toward denial of your application as required by 15A
NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional
information. Please provide the following information so that we may continue to review your project.
Additional Information Requested:
1. Impact Justification (Avoidance and Minimization)
The US Army Corps of engineers requested this additional information on practical alternatives and
minimization and avoidance. A copy of this additional information has not been provided to DWQ.
2. Mitigation
The Public Notice issued by the Corps notes that you are proposing to mitigate for the impacts
utilizing the existing GSRA Mitigation Bank at a 4:1 ratio. Please provide information on credits
used and credits available for enhancement and restoration at the bank. In addition, does the Marine
Corps Base plan on future impacts in this area in the future? Is preservation of the remaining
wetlands feasible?
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Cyndi Karoly of the DWQ 401 Oversight Unit at 1650 Mail Service Center, Raleigh, NC 27699-
1650. If we do not hear from you within three weeks, we will assume that you no longer want to pursue
this project and we will consider the project as withdrawn.

DWQ has reviewed the, "Wetland Mitigation Bank Monitoring Summary, 2004, Final, Marine
Corps Base; Camp LeJeune, Greater Sandy Run Area, North Carolina." Our office agrees that
the site improvements, "significantly enhanced hydrology in 2004" (p. 7-18), and "the inclusion
of volunteer tree species significantly increased the tree survival counts" (p. 7-19).
One concern arose while reviewing the report. The hydrographs for the burned pine plantation
and the pocosin sites showed high surface water levels during the later half of the growing
season. The primary concern, especially for the pine plantation, is that this may negatively
impact the planted or desired wetland vegetation species that are capable of surviving on the site.
The report indicates that this may already be happening in the pine plantation site (p. 7- 5), "[t]he
decrease in the number of species recorded from 2002 to 2004 is likely due to the inundation of
the pine plantation."
DWQ feels that future monitoring should focus on the level of inundation and the level of impact
it is or may have on the vegetation present on the site.
These comments are made in order to assist in the establishment of a successful wetland

place has had unchangeable effects on our landscape. WE need to now say enough that this area a closed
pocosin sitting on top of two great aquafers should be exempt from live fire and do more to protect it not add
more to the problem.
Live fire on our wetlands is leading to disaster for the environment look at Edwards base is Mass.. Look in NC at
old Camp Butner These are just a few but most DOD ranges even with the new green policy will still pollute the
waters and aquafers
Please help your fellow citizens and taxpayers and serve those who live here with concern for yourselves.

Authority
The Corps will evaluate this application and a decide whether to issue, conditionally issue, or
deny the proposed work pursuant to applicable procedures pursuant to Section 404 of the Clean
Water Act.
Location
The project site, known as SR-7 or P-949, is located at 34-38.91, 77-29.53, in the northeast
portion of the Greater Sandy Run Area (GSRA) Training Complex, on the west side of US
Highway 17, adjacent to Great Sandy Run Pocosin, just south of Verona, Onslow County, North
Carolina.
Existing Site Conditions
The current SR-7 range, formerly known as P-949, was constructed in the mid-1990's for tank
and light armored vehicle training. This range was one of the earlier built ranges associated with
a comprehensive plan to construct a multi-range complex for military training maneuvers from
infantry small arms fire to heavy armored vehicles. In order to develop the SR-7 Range, Camp
Lejeune was required to obtain a Department of the Army permit. Authorization, via an

Individual Permit, was granted in April 1995 (Reference Action ID. 199400693) to impact 17.25
acres of jurisdictional wetlands. These impacts were compensated by restoring wetlands within
the current Greater Sandy Run Mitigation Bank, which is located just south of the range.
The large range contains a series of tank and armored vehicle trails with target emplacements
positioned at strategic locations. The entire range has been cleared of canopy and sub-canopy
trees and is kept mowed or drum chopped for visional and safety purposes. The range is
underlain with Leon fine Sand and Woodington loamy fine sand, which both are hydric soils.
Jurisdictional wetlands are present throughout the range.
Applicant's Stated Purpose
The purpose of the proposal is to provide additional small arm targets for M-16 rifle training
using 200, 400, and 600-meter distances. The targets will be used by dismounting infantryman,
or foot soldiers, that work in unison with tank and light armored vehicles. Current conditions at
SR-7 effectively reduce the use of rifle training, which result in inefficient training for
infantryman. Permanent roads will be constructed in order to adequately service and repair to
these targets. These roads will allow maintenance vehicles and equipments to access the targets
on a regular basis year-round without being delayed or prohibited during wet conditions.
Project Description
The project proposal will provide a total of 26 additional target emplacements within Range SR-
7. The targets will be small "Pop-up" targets with a 10' by 10' footprint or base per target. Each
target will be positioned on a 6-ft. by 6-ft. level fill pad, at 1.0 foot above the existing wetland
elevations. These targets will be grouped into three areas, two groups of (9) targets and one
group of (8) targets. To service the groups of targets, three access roads are needed so
maintenance and service on the emplacements can be conducted. Each road will be constructed
with a top width of 12 feet at 2:1 slopes, totaling 22 feet wide, and will vary in length. The roads
will be 170 feet, 234 feet, and 275 feet long, and will contain a 37-foot wide by 22-foot long turn
around area at the terminus of each road. Geotextile fabric will be placed at original elevations
and clean earthen fill material will be deposited over the fabric to 2.5 feet above the original
contours. The road will be capped with 6-inches of ABC stone and the slopes seeded for
stabilization. No roadside ditches are proposed.
The construction of the targets and service roads will impact 0.418 acre of jurisdictional
wetlands. To adequately compensate for these wetlands impacts, the applicant is proposing to
utilize the existing GSRA Mitigation Bank at a ratio of 4:1, which will total the mitigation at
2.92 acres of wetlands. All restoration construction has been completed within the bank and the
site is currently in its third monitoring period.
Other Required Authorizations
This notice and all applicable application materials are being forwarded to the appropriate State
agencies for review. The Corps will generally not make a final permit decision until the North
Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification

required by Section 401 of the Clean Water Act (PL 92-500). The receipt of the application and
this public notice in the NCDWQ Central Office in Raleigh serves as application to the NCDWQ
for certification. A waiver will be deemed to occur if the NCDWQ fails to act on this request for
certification within sixty days of the date of the receipt of this notice in the NCDWQ Central
Office. Additional information regarding the Clean Water Act certification may be reviewed at
the NCDWQ Central Office, 401 Oversight and Express Permits Unit, 2321 Crabtree Boulevard,
Raleigh, North Carolina 27604-2260. All persons desiring to make comments regarding the
application for certification under Section 401 of the Clean Water Act should do so in writing
delivered to the North Carolina Division of Water Quality (NCDWQ), 1650 Mail Service Center,
Raleigh, North Carolina 27699-1650 Attention: Ms Cyndi Karoly (all other projects) by June
27, 2005.
The applicant has not provided to the Corps, a certification statement that his/her proposed
activity complies with and will be conducted in a manner that is consistent with the approved
North Carolina Coastal Zone Management Program. Pursuant to 33 CFR 325.2(b)(2), the Corps
can not issue a permit for the proposed work until the applicant submits such a certification to
the Corps and the North Carolina Division of Coastal Management (NCDCM), and the NCDCM
notifies the Corps that it concurs with the applicant's consistency certification.
Cultural Resources
The Corps has consulted the latest published version of the National Register of Historic Places
and is not aware that any registered properties, or properties listed as being eligible for inclusion
therein are located within the project area or will be affected by the proposed work. Presently,
unknown archeological, scientific, prehistoric, or historical data may be located within the
project area and/or could be affected by the proposed work.
Endangered Species
The Corps has reviewed the project area, examined all information provided by the applicant and
consulted the latest North Carolina Natural Heritage Database. Based on available information,
the Corps is not aware of the presence of species listed as threatened or endangered or their
critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA)
within the project area. A final determination on the effects of the proposed project will be made
upon additional review of the project and completion of any necessary biological assessment
and/or consultation with the U.S. Fish and Wildlife Service."
It should be noted that Section 7 consultation with the U.S. Fish and Wildlife Service was
conducted during the original permit review and no listed species were present at that time.
Evaluation
The decision whether to issue a permit will be based on an evaluation of the probable impacts,
including cumulative impacts, of the proposed activity on the public interest. That decision will
reflect the national concern for both protection and utilization of important resources. The
benefit, which reasonably may be expected to accrue from the proposal, must be balanced

against its reasonably foreseeable detriments. All factors which may be relevant to the proposal
will be considered including the cumulative effects thereof, among those are conservation,
economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and
wildlife values, flood hazards, flood plain values-(in accordance with Executive Order 11988),
land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For activities involving
the discharge of dredged or fill materials in waters of the United States, the evaluation of the
impact of the activity on the public interest will include application of the Environmental
Protection Agency's 404(b)(1) guidelines.
Commenting Information
The Corps is soliciting comments from the public; Federal, State and local agencies and officials;
Indian Tribes and other interested parties in order to consider and evaluate the impacts of this
proposed activity. Any comments received will be considered by the Corps to determine
whether to issue, modify, condition or deny a permit for this proposal. To make this decision,
comments are used to assess impacts on endangered species, historic properties, water quality,
general environmental effects and the other public interest factors listed above. Comments are
used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact
Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also
used to determine the need for a public hearing and to determine the overall public interest of the
proposed activity.
Any person may request, in writing, within the comment period specified in this notice, that a
public hearing be held to consider the application. Requests for public hearings shall state, with
particularity, the reasons for holding a public hearing. Requests for a public hearing shall be
granted, unless the District Engineer determines that the issues raised are insubstantial or there is
otherwise no valid interest to be served by a hearing.

Project site is located off of U.S. Fliehway 17 bemeen Verona and Dixon. Entrance to proiect is located 1.25 miles south of the intersection of NCSR
1119 and U.S. High%vay 17. Exit onto ,ravel road on the %\estern side of U.S. High%%ay 17 and on the northern side of the overpass. The site is a
portion of i\1CB Camp Lejeune's Greater Sandy Run (GSRA) area.

Project proposes to provide a total of 26 additional target emplacements at the existing Ranee SR-7. The targets are small "Pop Up" targets associated
with rifleman training. The targets are located at distances of 200m, 400 m and 600 in from the shooting area on the range. Each target requires a 10'
x 10' fill area to construct the supporting slab where the control equipment and protective berm will be constructed. The targets would be grouped at 3
locations and would require 3 separate access roads to reach the targets with maintenance vehicles. The access roads are 12' wide each with 5'
provided on each side for the roadway fill slope. The roadways would be gravel and would originate from the existing gravel road running down the
Southern side of the range. This request is being submitted as a modification to CESAW-CO-E Permit No. 199400693, Dated April 10, 1995 for the
construction of Multipurpose Training Range P-949.

The purpose of this project is to provide small arms targets for rifle training at the SR-7 range. The targets must be serviced and repaired on a regular
basis due to the nature of firing operations. The Ranee SR-7 location is an established training range with existing facilities and safety features which
provide a logical location for these additional targets. The targets will provide 200, 400 and 600 meter distances for training for shooters.
USE BLOCKS 20-22 IF DREDGED AND/OR FILL MATERIAL IS TO BE DISCHARGED
20. Reason(s) for Discharge
The existing areas where the targets are proposed are wet and soft during the wetter times of the year. Maintenance vehicles servicing the targets
would severely rut the ground and result in impassible conditions. The individual targets must be elevated to keep the equipment dry and functioning.
The proposed roadways would bridge over these poor conditions. The targets require regular servicing during training operations to keep them
functioning properly. 17.2 acres of wetland impact were previously permitted by CESAW-CO-E Permit No. 199400693 at the range.

Clean permitted borrow pit fill would be used to construct the roadway fill and side slopes and the 26 target areas (total discharge = 1,024 cubic yards).
A 6-inch thick ABC stone laver would be used to stabilize the 12-foot wide road surface (total discharge = 157.5 cubic yards). The area to be impacted
is Currenth• motived on a regular basis as a part of the range operations.

Dear Mr. Shaver:
This letter provides the comments of the U. S. Fish and Wildlife Service (Service) on the subject Public
Notice, dated June 13, 2005. The applicant, Commanding General, Marine Corps Base Camp Lejeune,
has applied for a Department of the Army (DA) permit to impact 0.418 acres of jurisdictional wetlands to
construct service roads and target emplacements on Range SR-7 within the Greater Sandy Run Area
(GSRA) Training Complex. These comments are submitted in accordance with the Fish and Wildlife
Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the
FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in
your public interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources.
Project Area, Proposed Activities, and Environmental Impacts
The project area, Range SR-7, is adjacent to the Great Sandy Run Pocosin. The range is underlain by
hydric soils and jurisdictional wetlands are present throughout the range. The applicant proposes to
construct 26 target emplacements, each 10 feet by 10 feet, and three access roads to maintain and service
these emplacements. No roadside ditches are proposed. Construction of the target emplacement and
access roads would impact 0.418 of an acre of jurisdictional wetlands.
Compensatory mitigation would be provided by at the Greater Sandy Run Mitigation Bank. The PN
states that all restoration construction has been completed within the bank and the site is currently in its
third year of monitoring. The proposed compensation ratio is 4:1 which would require 1.672 acres of
compensation. However, the PN states that mitigation would total 2.92 acres of wetlands. This
discrepancy should be clarified. The Service would accept compensation at a 4:1 ratio. The Service
supports the concept of on-site wetland compensation and the development of compensatory wetlands
before the occurrence of impacts.
Federally Protected Species
The Service has reviewed available information on federally-threatened or endangered species known to
occur in Onslow County. We have also reviewed information from the North Carolina Natural Heritage
Program (NCNHP) database which contains excellent data on the special status species, both federal and
state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey

(USGS). Data from USGS quads provide the most project-specific information on species which should
be considered in permitting this project. The project area is in the Jacksonville South quad. The
occurrence data of special status species within this quad can be obtained on the internet under the
heritage data link of < http://www.nenhp.org/Pages/heritagedata.htm] >.
The only federally listed species with a current occurrence record in the NCNHP database for the
Jacksonville South quad is the endangered red-cockaded woodpecker (RCW) (Picoides borealis). Map
data indicate that there are no known occurrences of this species near the project area. Furthermore, the
PN states that the entire range has been cleared of canopy and sub-canopy trees and is kept mowed or
drum chopped. Such practices would eliminate RCW nesting and foraging habitat. Based on our review
of all available information we do not believe the proposed activities are likely to adversely affect the
RCW. Therefore, the Service would concur with a determination by the District Engineer that the action
is not likely to adversely affect species designated as threatened, endangered, or their designated critical
habitat. However, the requirement of section 7 would need to be reconsidered if. (1) new information
reveals impacts of this identified action that may affect listed species or critical habitat in a manner not
previously considered; (2) this action is subsequently modified in a manner that was not considered in this
review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified
action.
Service Recommendations
Based on information in the PN, we do not believe that the proposed activity will have significant adverse
and/or irreversible effects on general fish and wildlife resources under our jurisdiction. Therefore, the
Service has no objection, from the standpoint of fish and wildlife, to the issuance of a DA permit for the
proposed work.

On June 15, 2005, the Public Notice for the application on behalf of Marine Corps Base Camp Lejeune to potentially impact
wetlands of Sandy Run Area in order to construct the subject project was received by the N.C. Division of Water Quality.
The comment period ends June 27, 2005. DWQ is unable to move ahead to review this project without receipt of two
copies of all application materials provided to the U.S. Army Corps of Engineering. The fee for applications is $200 for
projects impacting less than an acre of wetland and less than 150 linear feet of streams. For projects impacting one or more
acres of wetland or 150 or more feet of streams, the fee is $475. The formal review for the 401 Water Quality Certification
cannot be initiated until this fee is paid and the copies are provided. Please reference the DWQ # shown above on all future
correspondence and mailings.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected
buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.

1. Please reference your request for a Department of the Army authorization and a State Water
Quality Certification to construct 26 additional target emplacements, which would impact 0.425
acres of 404 wetlands, at the existing Target Range SR-7 located with Camp Lejeune, Onslow
County, North Carolina.
2. On 6 February 1990, the Department of the Army (DA) and the U.S. Environmental
Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with Clean Water Act Section
404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands
through the selection of the least damaging, practical alternative; second, taking appropriate and
practical steps to reduce impacts on waters and wetlands; and finally, compensation for
remaining unavoidable impacts to the extent appropriate and practical. To enable us to process
your application, in compliance with the MOA, we request that you provide the following
additional information:
a. Permits for work within wetlands or other special aquatic sites are available only if the
proposed work is the least environmentally damaging, practicable alternative. Please furnish
information regarding any other alternatives, including upland alternatives, to the work for which
you have applied and provide justification that your selected plan is the least damaging to water
or wetland areas.
b. It is necessary for you to have taken all appropriate and practicable steps to minimize wetland
or water losses. Please indicate all that you have done, especially regarding development and
modification of plans and proposed construction techniques, to minimize adverse impacts.
c. The MOA requires that appropriate and practicable mitigation will be required for all
unavoidable adverse impacts remaining after all appropriate and practicable minimization has
been employed. Please indicate your plan to mitigate for the projected, unavoidable loss of
waters or wetlands or provide information as to the absence of any such appropriate and
practicable measures.
