Habitat Conservation Program DATE: March 21, 2006 SUBJECT: The Summit at Lake Norman- Phase IV, DWQ No. 050638-version 3, Catawba County The applicant is requesting 401 Water Quality Certification from the North Carolina Division of Water Quality. The NCWRC has reviewed information provided by the applicant and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed development will impact land indicated to be 90% wooded. The amount of imperviousness that will occur is not indicated: however, two stream crossings for roads will impact 299 linear feet of perennial stream. According to the application, these streams have an average width of five (5) feet. The application indicates that the pipes will be laid one (1) foot below grade and have an energy dissipater. The loss of forested lands will substantially diminish wildlife habitat and influence aquatic resources. Based on our review of the submittal and our knowledge of the area, we are concerned about direct impacts associated with culvert design and aquatic life passage. Because of the lack of mitigation requirements for upland impacts, we will not object to Certification issuance if the following conditions to protect aquatic habitats are provided to the extent practicable: 1. Bridges are recommended for all permanent roadway crossings of streams, floodplains and associated wetlands to eliminate the need to fill and culvert active floodplains. Bridges should be the standard practice where significant natural resources like trout, listed species, or site limitations like bedrock exist. Floodplain capacities and floodplain functions must be maintained with bridges and culverts. 2. If culverts must be used instead of bridges, culverts should be designed and installed to allow passage of aquatic organisms. Culverts 48" or larger must be buried at least a foot (12") below the streambed. These measurements must be based on natural thalweg depths. Culverts should be situated so that no channel realignment or widening occurs. Widening of the stream channel at the inlet or outlet of structures usually causes a decrease in water depth and velocity resulting in increased sedimentation and diminished aquatic life passage. ;. Natural stream channel dimensions must be maintained or provided/restored. Flat concrete aprons between wing-walls must not be used. Riprap must not be placed in the streambed. 1. If multiple barrels are needed, the second and any additional barrels should be placed so that their bottoms are located on the active bank full elevation. These bank full barrels must be connected to active floodplain benches to provide natural dimensions for the base flow channel with sufficient water depth during low or normal flows to accommodate movement of aquatic species. 5. If culverts are long and/or sufficient slopes exist, alternating baffles should be provided in a manner that conforms to channel bends upstream and downstream, mimics natural meanders, prevents upstream scour and downstream deposition, moves typical bed load materials, and provides resting areas and passage for aquatic species. 6. Stormwater management should be provided if high density development will occur on the site. Stormwater management should mimic predevelopment site conditions. 7. Stream buffers should be permanently protected through contiguous conservation easements as undisturbed forested areas. Intermittent buffers are recommended to be minimum 50' widths and perennial buffers are recommended to be minimum 100' widths. Buffer averaging may be appropriate if buffers provide substantial contiguous wildlife habitats as well as preserve wetlands and floodplains in natural conditions. A V*a>?e?rj ieo Buffer Rules This form is to be used for projects qualifying for any of the U.S. Army Corps of Engineers' (USACE) Nationwide, Regional or General Permits as required by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act, and for the North Carolina Division of Water Quality's (DWQ) associated General 401 Water Quality Certifications. This form is also to be used for any project requiring approval under any Riparian Buffer Rules implemented by the N.C. Division of Water Quality. This form should not be used if you are requesting an Individual 404 Permit or Individual 401 Water Quality Certification. The website also lists the responsible project manager for each county in North Carolina and provides additional information regarding the identification and regulation of wetlands and waters of the U.S. The DWQ issues a corresponding Certification (General or Individual), and cannot tell the applicant which 401 Certification will apply until the 404 Permit type has been determined by the USACE. Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at http://h2o.enr.state.nc.us/ncwetlands to read about current requirements for the 401 Water Quality Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The applicant is also advised to read the full text of the General Certification (GC) matching the specific 404 Permit requested. In some cases, written approval for General Certifications is not required, provided that the applicant adheres to all conditions of the GC. Trout Waters Coordination - Special coordination with the North Carolina Wildlife Resources Commission (NCWRC) is required for projects occurring in any of North Carolina's twenty-five counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC regional coordinator (listed by county on page 4 of this application) prior to submittal of the application. Page 1 of 12 Coastal Area Management Act (LAMA) Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on page 4) the applicant should contact the North Carolina Division of Coastal Management (DCM). DCM will determine whether or not the project is within a designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency. In such cases, DCM will require a CAMA Permit and will coordinate the 404/401 Permits. The applicant may also choose to coordinate with the United States Fish and Wildlife Service to ensure that the proposed project will have no impact upon any endangered or threatened species or critical habitat as regulated by the Endangered Species Act, and the State Historic Preservation Office, North Carolina Department of Cultural Resources to ensure that the proposed project will have no impact upon any properties listed or eligible for listing on the National Register of Historic Places. Compliance with these regulations is required to be eligible for any Department of the Army permit. The addresses for both agencies are listed on page 3 of this application. USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms, photos, etc. to the applicable USACE Regulatory Field Office. Upon receipt of an application, the USACE will determine if the application is complete as soon as possible, not to exceed 30 days. This PCN form is designed for the convenience of the applicant to address information needs for all USACE Nationwide, Regional or General permits, as well as information required for State authorizations, certifications, and coordination. Fully providing the information requested on this form will result in a complete application for any of the USACE Nationwide, Regional or General permits.
