Dear Ms. Bachl:
You have our authorization of exemption from the Neuse River Riparian Buffer Rules [I SA NCAC
2H.0233] for the purpose of installing the wastewater piping via directional boring beneath the creek
bed as described in your submittal dated June 30, 2006 and received by the Division of Water
Quality (DWQ) on June 30, 2006. After reviewing your information, we have decided this impact is
an exempt activity in accordance with the Neuse River Buffer Rules [15A NCAC 02B .0233] and
does not require written authorization.
This authorization is only valid for the purpose and design that you described in your June 30, 2006
submittal. If you change your project, you must notify us and you may be required to send us a new
application.
Requests for appeals of this decision shall be made to the Office of Administrative Hearings. If you do
not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition,
which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This exemption and its conditions are
final and binding unless you ask for a hearing.

Dear Mr. Dorney:
On behalf of Bruce Foods Corporation (Bruce Foods), I am writing to follow up on
our conversation yesterday regarding Bruce Foods' application that is pending in DWQ's
Land Application Unit for a modification to expand its wastewater facility and spray
irrigation fields. During the application review process, Mr. Nathaniel Thornburg and Mr.
Rich Hayes of the Land Application Unit requested that we confirm in writing that there are
no wetlands or stream impacts associated with the proposed expansion of the facility. As we
discussed, the design of Bruce Foods' proposed expansion includes the installation of a pipe
across a stream that runs through Bruce Foods' property. Please see the enclosed
engineering drawings for design details, particularly Sheet 3.2A. Bruce Foods plans to
install this pipe using directional boring techniques that keep the pipe at least five feet below
the bottom elevation of the creek. The directional boring will enter and exit the ground
surface outside the 50 foot buffer required by the Neuse River Basin rules. Assuming that
Bruce Foods avoids the buffer and the United States Army Corps of Engineers (Corps)
determines that there are no wetlands or stream impacts, you indicated to me that there are no
wetlands, stream or buffer impacts associated with the installation of this pipe that require
DWQ's approval. We have received confirmation from the Corps that there are no federal
jurisdictional wetlands or stream impacts as indicated on the documentation enclosed. We
are requesting that DWQ provide Bruce Foods with a similar written determination to satisfy
the Land Application Unit's requests. Bruce Foods must respond to the Land Application

Dear Ms. Manuele:
This correspondence is concerning a parcel of land located within the Neuse River Basin, Contentnea
Creek Watershed, south of Charleston Street, west of Stantonsburg Road, within the City of Wilson,
County of Wilson, State of North Carolina and being more accurately described on a map prepared by
Bartlett Engineering and Surveying, P.C. of Wilson, North Carolina. Being the same parcel as identified
on plans and descriptions provided to us through Cavanaugh and Associates, P.A. Wilmington, N.C. and
titled, Bruce Foods Corporation Wastewater Treatment System Enhancements.
As indicated on the aforementioned plans, more specifically sheet C.3.2 dated May 23, 2006
demonstrating the intention of the installation of a directional bore to facilitate the interconnectivity of a
proposed irrigation system under an existing stream and its adjacent wetlands, as indicated on the
aforementioned plan and sheet number (C.3.2) along an existing roadway as per plan and detail. As
noted, said stream bottom and pipe will have a minimum of 3' of separation between the top of pipe and
the existing creek bottom, as shown on sheet C.3.2 as detailed, and will be approximate 150' in length.
With regards to our meeting of June 6, 2006 whereas the opportunity was taken to review these plans and
details to discuss the necessity or lack thereof of the United States Army Corps of Engineers permitting
